Decision
Petition of Louis Seibert requesting a reversal of Building Inspector's denial
of sign permit for the property at 22 Hersey Street
City of Salem Zoning Board of Appeals
A public hearing on the above petition was opened on September 17,2008 pursuant to
Massachusetts General Law Ch. 40A, Sec. 11, The following Zoning Board members
were present: Elizabeth Debski, Rebecca Curran, Bonnie Belair, Richard Dionne, and
Annie Harris.
The petitioner, Louis Seibert, sought a reversal of the Building Inspector's denial of a sign
permit for the property located at 22 Hersey Street, Salem,in the Business and
Automotive (134) zoning district.
The Board of Appeals, after careful consideration of the evidence presented at the public
hearing, and after thorough review of the Petition submitted, makes the following
findings of fact:
1. The subject property is within the Business and Automotive (34) zoning
district.
2. The petitioner is requesting reversal of the Building Inspector's denial of a
sign permit.The proposed mural will be 40 feet by 12 feet and consist of the
words"Restoration+Repair"and a graphic of a welder.
3. During the hearing,Mr. Laurent Ouellete,a resident of 18 Hersey Street,
Salem, submitted a letter supporting the Building Inspector's initial denial.
On the basis of the above findings of fact, including all evidence presented at the public
hearing,including,but not limited to,the Petition the Zoning Board of Appeals concludes
as follows:
1. The petitioner's mural does not constitute signage under the Salem Sign
Ordinance.
In consideration of the above,the Salem Board of Appeals voted, five(5) in favor
(Curran, Dionne,Belair, Debski,Harris)and none (0)opposed,to reverse the Building
Inspector's denial of a sign permit, subject to the following terms, conditions, and
safeguards:
I. The Petitioner shall separate the existing sign, "Restoration+Repair,"from the
proposed mural,the nature of the separation shall be at the discretion of the
petitioner.
2. The Petitioner shall paint the building a color appeasing the abutting residential
neighborhood.

A COPY OF THIS DECISION HAS BEEN FILED WITH THE PLANNING BOARD AND THE CITY
CLERK
Appeal from this decision,if any,shall be made pursuant to Section 17 of the Massachusetts General Laws
Chapter 40A,and shall be filed within 20 days of filing of this decision in the office of the City Clerk.
Pursuant to the Massachusetts General Laws Chapter 40A,Section 11,the Variance or Special Permit
granted herein shall not take effect until a copy of the decision bearing the certificate of the City clerk that
20 days have elapsed and no appeal has been Sled,or that,if such appeal bas been filed,that it has been
dismissed or denied and is recorded in the South Essex Registry of Deeds and indexed under the name of
the owner of record or is recorded and noted on the owner's Certificate of Title.
