Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property, are requesting a Variance from lot size and frontage to allow property to be sold as a buildable single family lot at 73 R Lawrence Street, Salem. Property is in a Residential Two Family Zone (R-2) . The Variances which have been requested may be granted upon a finding by this Board that: 1 . Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures involved. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioners. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district of the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1. There was no oppsition in this matter. 2. Only lot size and frontage are short; all other set backs meet requirements. 3. This is the most feasible solution for the usage of land in question. 4. Owner took title to property in May 1983 and had an understanding that it was a building lot. 5. This will conform to the neighborhood in a R-2 district. Petitioner shall comply with all city and state statues, ordinances, codes and regulations. 2. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 3. All construction shall be done as per the pians and dimensions submitted. 4. Petitioner shall obtain building permit prior to beginning any construction. 5. Need to file a waiver from frontage from subdivision control law. 6. Certificate of Occupancy is to be obtained. 7. Petitioner shall obtain proper street numbering from the City of Salem Assessors office and shall display said number so to be visible from the street. Mr. Leo Tremblay Dear Mr Tremblay, I thought it might be easier to write to you and provide some information and my thoughts on 73-R Lawrence St. Salem. At the Registry this lot is and has always been described as lot 185 and part of lot 186 with a total area of 6050s.f. The lot has frontage on a 30' Court that appears in City of Salem records as a "paper street". Mr Caron did tell me that taxes have never been collected on this court. If a. builder was to finish this court by city regulations would this fulfill item 1 . of the grandfather policy? The description of this lot has not changed in over 100 years. We are aware that Bertram Gagnon et ux owned this lot and an adjacent lot #179 in the 1960's and early 1970's before the lot in question was sold to a different owner: . Except for the frontage issue we can answer yes to items 1 -2-3-4-5. As for question 6 1 am still a little confused. Since . this lot has always had a separate identity it has never been readily available to use with adjoining land. Please let me know at your convenience your decision regarding this lot.
