DECISION OF THE PETITION OF PUBLIC STORAGE INC.REQUESTING A
VARIANCE FOR THE PROPERTY LOCATED AT 2-12 GOODHUE STREET BPD
A hearing on this petition was held December 19, 2001 with the following Board
Members present: Richard Dionne, Stephen Harris, Nicholas Helides, Bonnie Belair and
Joan Boudreau. Notice of the hearing was sent to abutters and others and notices of the
hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A. -
The petitioner is requesting a Variance from the minimum depth of the front yard on
Bridge Street to construct a public storage facility for the property located at 2-12
Goodhue Street located in a BPD zone.
The Variances, which have been requested, may be granted upon a finding by this
Board that:
a. Special conditions and circumstances exist which especially affect the land, building
or structure involved and which are not generally affecting other lands, buildings and
structure involve.
b. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioners.
c. Desirable relief may be granted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent of the district of the
purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1. Attorney George Atkins of 59 Federal Street appeared and represented the
petitioner.
2. Plans were submitted showing the proposed location of the building and the
reasoning of developing a more urban setting: These plans having been worked out
with all surrounding neighboring groups.
3. David Hart, of 104 Federal Street spoke in favor of the petition.
4. Councillor Thomas Furey also spoke in favor and praised the work of the developer
and the various civic groups.
5. Staley McDermot of Historic Salem Inc. also spoke in favor.

6. Dick Lubeke of 2 River St. and Martin Imm of 174 Federal Street also spoke in favor.
7. One person, Mr. Rymer Adams, of 11 Goodhue Street was opposed.
8. A letter in support was sent from Councillor Regina Flynn and Councilor Elect Mike 9(2,
Bencal.
On the basis of the above findings of fact, and on, the evidence presented at the
hearing, the Zoning Board of Appeal concludes as follows
1. Special conditions exist which especially affect the subject property but not the
district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship to the petitioner.
3. Desirable relief can be granted without substantial detriment to the public good and
Without nullifying or substantially derogating from the intent of the district or the
purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted 5-0, to grant the Variances requested,
subject to the following conditions;
1. Petitioner shall comply with all city and state statures, ordinances, codes and
regulations.
2. All construction shall be done as per the plans and dimensions submitted.
3. All requirements of the Salem Fire Department relative to smoke and fire safety shall
be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. A Certificate of Occupancy shall be obtained.
6. A Certificate of Inspection shall be obtained.
7. Petitioner is to obtain approval from any City Board or Commission having
jurisdiction including, but not limited to the Planning Board.
8. Petitioner shall obtain street numbering from the City of Salem Assessors Office
and shall display said numbering as to be visible from the street

1. This complaint constitutes an appealursuant to General Laws c. 4
P OA, section 17
from a grant by the defendants members of the Salem Zoning Board of Appeal (hereafter referred
to as the "Board") of a variance to the defendant Public Storage, Inc. (hereinafter referred to as
"Public Storage').
2. The plaintiff is Ayer Realty, LLC, (hereinafter referred to as the "Plaintiff'), a Rhode
Island Limited Liability Company having a usual business address of 500 Broadway, Everett,
Massachusetts.
3. The defendants members and associate members of the Board are as follows:

4. The defendant Public Storage has a usual place of business at 701 Western
Avenue, Glendale, California 91201-2349.
5. The plaintiff Ayer Realty, LLC, is an abutter to a parcel of land located at 2 -12
Goodhue Street, Salem, MA (hereinafter referred to as the "subject parcel'). The plaintiff is a
person and party aggrieved within the meaning of M.G.L. c. 40A.
6. By decision dated December 19, 2001, and filed with the Salem City Clerk on
January 2, 2002, the Board granted a variance to the defendant for the subject parcel as follows:
(1) a variance from the minimum depth of the front yard on Bridge Street to construct a public
storage facility in a BPD zone. A certified copy of that decision of the Board is attached hereto and
marked as Exhibit "A".
7. A literal enforcement of the zoning ordinance would not involve a substantial
hardship to the defendant.
8. There are no circumstances relating to the soil conditions, shape or topography of
the subject parcel and especially affecting said parcel but not affecting generally the zoning district
in which the subject parcel is located which warrant the grant of the said variance.
9. The defendant-Public Storage is able to develop the subject parcel without any
variance from the zoning ordinance, albeit in a manner different from that proposed pursuant to the
terms of the variance granted by the Board.
10. Any hardship allegedly suffered by the defendant Public Storage is of its own

making and cannot lawfully support the grant of the variance by the Board.
11 , The relief granted by the variance issued by the Board may not be granted without
substantial detriment to the public good and without nullifying or substantially derogating from the
intent or purpose of the zoning ordinance.
12. The defendant Public Storage presented to the Board insufficient evidence to
warrant the issuance of the variance for the subject parcel.
13 The Board failed to make the necessary factual findings to support the issuance of
the variance for the subject parcel.
14. The decision of the Board granting the variance exceeds the authority of said
Board and is contrary to law.
15. The decision of the Board is a mere recitation of the statutory and ordinance
standards and is deficient as a matter of law.
16. The decision of the Board is inherently contradictoryand is deficient as a matter f

law
Wherefore the plaintiff Ayer Realty, LLC, prays as follows:
1. That the decision of the Salem Board of Appeal granting the variance forthe subject
Parcel be annulled,
2. For legal fees and costs incurred by the plaintiff; and
3 For such other relief as this Honorable Court deems meet and just.

As the Councilor-Elect, for the ward in which the proposed Public Storage facility
shall be located, I find it incumbent to offer my views for the design of the facility.
Unfortunately I will be unable to attend the meeting and thus offer my written comments.
My comments and suggestions are;
1. That the exit onto Bridge St. be angled in a way to prevent left turns onto
Bridge,St.,and to minimize the ability of vehicles to enter the,propert- Jli ugh
this exit.
2. That the space between the building and the roadway include a five foot tree
planting-area;a five-foot sidewalk,,and a five-foot green area.This green-area
should have the yege,tation,in.de,mity,and size,app o.priate for.the.area.
3. This set-back plan,alongwiththe appropriate sidewalk,should run
continuous,except for entrances and exits,the length of the property.
-4. No motor vehicles,boats,trailers;-motor homes;or like should-be allow-to
be stored on the property
3. The signs should be-of appropriate sive and-color for-the area. The current
color scheme leaves a very imposing mark on the area. It is my hope that
Public Storage would be able to tone down the signs, as many major
corporations have done to conform to community standards.
I hope to-be able to-attend future meetings andoffermy comments directly-to-the
board. Thank you for your consideration.

from the minimum depth of front yard on Bridge Street so that they can constuct a public
storage facility on 2-12 Goodhue Street located in an area zoned for business park
development.
The developers have been meeting with neighbors since April regarding the size and
character of this structure and the owners,Public Storage,have been agreeable towards
the adoption of an "urban-style"construction, instead of adopting a"suburban"
interpretation.
