DECISION ON THE PETITION OF JOSEPH F. KERWIN FOR VAfgQLCE
AT 21 GLENDALE ST. , R-1
A hearing on this petition was held December 17, 1986 with the following Board
Members present: James Hacker, Chairman; Richard A. Bencal, Secretary; Messrs. ,
Luzinsk.i, Strout and Associate Member LaBrecque. Notice of the hearing was sent
to abutters and others and notices of the hearing were properly published in the
Salem Evening News in accordance with Massachusetts General Laws Chapter 4OA.
Petitioner requests a Variance from density, rear and side setbacks to allow an I
existing garage to be demolished and a larger garage to be constructed in this
R-1 zone.
The Variance which has been requested may be granted upon a finding of the Board
that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are n4tF generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner; and
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after hearing the evidence presented at the hearing, and a_`ter
v.,ew ng the plans, makes the following findings of fact:
1 . The present garage, constructed almost 100 years ago is in
disrepair and presents a hazard to the petitioner and others;
2. The present garage is suitable only for one car and the new
one would accomodate t::o vehicles.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property but
do not generally affect other properties in the same district;

2. Literal enforcement of the Ordinance would involve a substantial
hardship to the petitioner;
.3. The relief requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district of the purpose of the Ordinance.

Therefore, the Zoni-.= Board of Appeal voted unanimously, 5-0, to grant the
Variance recuestec, sub ect to the following conditions:
1 . Petitlo-er rust comply with all regulations of the Salem Fire
Dept. relat_ve to smoke and fire detectors for this address;
2. All construction rust be done as per the plans submitted and must
meet all Ci and State Euilding Codes;
The roof of the new garage must be guttered in the rear and the
downsoouts are to drain on the petitioners property;

4. A legal building permit must be obtained.

A request was recieved on August 15, 1986 from Mr. Joe Kerwin to
demolish a one-story, wood-frame garage at 21 Glendale Street. This
structure has been reviewed and was discovered to have been built
between 1874 and 1897. The building has no architectural or historical
significance. Therefore, according to the City' s Demolition Delay
Ordinance, signed into law on May 12, 1986, a majority of the following
people designated to review such structures under Section 1,
Paragraph (e) of the ordinance agree that a demolition permit should be
issued immediately.
