Petitioner, owner of the property, is requesting Variances from use to allow a three family dwelling to be converted to a four family dwelling in this R-2 district. The Variance which has been requested may be granted upon a finding by this Board that: I. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures involved. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: .1. Special conditions exist which especially affect the subject property but not the district in general. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship to the petitioner. 3. Desirable relief can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the variance requested, subject to the following conditions: 1. Petitioner shall comply with all city and state statutes, ordinances, codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted. 3. In its present configuration the building contains three apartments with a combined total square footage of approximately 4, 370 square feet . The petitioner' s proposed re-configuration of the structure would result in two apartments of 1, 100 square feet each, one of 1, 250 square feet and a new fourth apartment at the rear of the premises containing approximately 920 square feet . The present configuration of the building renders the apartments very difficult to rent due to their abnormal size . The use of the property as a four family dwelling will not increase the total number of people allowed to reside therein. The total number of bedrooms in the building will in fact be decreased if this petition is allowed. Off street parking for seven cars is proposed by the petitioner as shown on the attached plan. The petitioner' s proposed use of the premises as a four family dwelling is very consistent with the multi-family use generally found throughout the neighborhood. The conditions described above especially affect the premises but do not generally affect the zoning district in which the building is located. In its present configuration the building contains three apartments with a combined total square footage of approximately 4 , 370 square feet . The petitioner' s proposed re-configuration of the structure would result in two apartments of 1, 100 square feet each, one of 1, 250 square feet and a new fourth apartment at the rear of the premises containing approximately 920 square feet . The present configuration of the building renders the apartments very difficult to rent due to their abnormal size . The-use of the property-as-a-four-family-dwerling-will-not-increase- the total number of people allowed to reside therein. The total number of bedrooms in the building will in fact be decreased if this petition is allowed. Off street parking for seven cars is proposed by the petitioner as shown on the attached plan. The petitioner' s proposed use of the premises as a four family dwelling is very consistent with the multi-family use generally found throughout the neighborhood. The conditions described above especially affect the premises but do not generally affect the zoning district in which the building is located.
