Per your request my answer to your questions
follows ;
111 . It is very uncommon that a permit is issued after the
completion of work. However should a person not know a
permit was required and wanted to have the work completed
and inspected , this office would in fact issue a permit ,
inspect the work performed . If satisfied with work
through visual inspections , would sign work off. If the
visual inspection was not satisfactory we would have the
contractor remove wall covering to expose work. A licensed
contractor is well aware that a permit is required to do
any type of renovations .
0Q . Permit 11218-96 was typed out by one of my clerks not
knowing she was doing anything wrong and without my
approval , per request of the contractor . Normally the
permits are printed from a computer , whoever we have typed
several permits when the computer has malfunctioned .
113 . Dan Tremblay is my nephew.
#4 . I can confirm that no inspections where performed at
33 Lawrence Street by this department and by the Plumbing
Inspectors . I cannot comment on the Electrical Inspectors .
115 . A homeowner who is not a license plumber or
electrician can not apply for a permit .

Dear Mr. Tremblay,
Please be advised that I represent Doreen and Kenneth Bedard in
an action currently pending in the Salem District Court Danco
Builders Inc. , v. Bedard, Docket #9736CV0717 . I am writing to
you to ask your cooperation with respect to giving a statement as
to some of the issues in the case which involve building permits.
In order to keep the costs of this litigation to my clients to a
minimum and to reduce any inconvenience to yourself I am hoping
to avoid conducting your deposition at my office in order to
investigate the origin of the attached documents . I am therefore
requesting that, to the best of your ability you provide me with
a signed statement in response to the following. You are under
no legal obligation to respond to my request but it is my hope
that the information you provide to me will satisfy my questions
and I will not need to seek more formal means of getting this
information.
1 . Attached is building permit #218-97, the application for
which designates that the work described was to be started by
5/97 and completed by 6/97 . The application date is 4/30/97 .
Dan Tremblay who is the applicant had completed the work
described in the application in mid 1996 almost a year prior to
the application being filed. He never performed any of this work
in 1997 . My question is whether or not this application was
properly filed and whether the building permit which was never
posted or obtained while the job was being performed is valid?
2 . Attached is also building permit No . 218-96 dated March 5,
1996 which Mr. Tremblay' s attorney produced to me as the valid
permit for 33 Lawrence Street which is the subject property of
the lawsuit. Since the application # 218-96 is really for the
Home for Boys on Winter Island and not 33 Lawrence Street and I
have attached a copy of that permit for your review, could you
please specifically describe how permit 218-96 was obtained by
Dan Tremblay and in so doing could you please indicate, if you
can, if you ever approved said permit. I would also like to
know, if these permits are normally printed from a computer as
the March 5, 1996 permit appears to be drafted on a typewriter.
3 . Could you please describe any family relationship which you
have with Dan Tremblay.
9 . Could you please confirm that no inspection of the
structure, plumbing or electrical work has been performed at 33
Lawrence Street, Salem MA.
5. Could you please indicate whether or not a homeowner who is
not a licensed plumber or electrical contractor can apply for
plumbing or electrical permits in the City of Salem.
Any cooperation you may afford is appreciated in this matter. If
you decide that you do not want to respond to these questions, as
a courtesy to you I would ask that you provide me with dates
during the month of February during which you would be available
to take a deposition at my office.
