The Schedules A &B attached thereto have been amended to reflect changes in the proposal resulting from community and official comment. The primary changes are as follow: 1, elimination of the proposed 16-unit building on Flint Street, leaving a proposal for three buildings, one on Mason Street and two in the center of the property; 2. reduction of the number of proposed dwelling units from 164 to 148; 3. 296 on-site parking spaces instead of the 247 originally proposed; 4. the addition of proposed public access walkway areas, and 4. a proposed condition to grant to the City of Salem for One Dollar an easement to construct an extension of Commercial Street through the property at any time within ten years after the project is approved. Our site engineer, Eastern Land Survey Associates, is preparing a revised Site Development Plan to reflect these changes, and I expect to file multiple copies of that with the Board by the end of next week. SCHEDULE B RIVERVIEW PLACE, LLC PROJECT DESCRIPTION The site of the proposed Riverview Place development is about 4.4 acres of land bounded by Flint and Mason Streets and the North River Canal, made up of two parcels, being the former Salem Suede industrial leather facility, and a smaller 2-story tannery fronting on Mason Street. The Salem Suede industrial site contains a massive multi-story wooden factory and warehouse building that covers most of the site. Both structures are obsolete and not viable for modernization. The development site is now completely contained within the recently enacted North River Canal Corridor(NRCC) Neighborhood Mixed Use District (Section 7-21 of the Zoning Ordinance). Mason Street is defined as a "Main Corridor" under the Ordinance. The stated purpose of the Ordinance is to create appropriate development within the district, consistent with the City's Master Plan, while preserving and promoting the best interests of the neighborhood and the residents of the City. The two existing buildings are functionally obsolete, and cannot feasibly be rehabilitated for modern uses. The site been used for leather-industry purposes for many decades. Any re-use and development of the property will require the owner to incur great demolition and site clean-up costs that have to be factored into the financial viability of any new development of the site. In recent years, residential development has proven viable in Downtown Salem, and is fueling a resurgence of the Downtown economy. The new development has provided important new tax revenue to the City. The new residents are supporting new businesses and restaurants, making Downtown Salem more vibrant place to live, work and socialize. The mixed-use provisions of the new Ordinance now provide a basis to continue at this site the process of bringing people back to live in the center of the City and fuel Salem's economic surge. Riverview Place proposes to construct three 4-story structures on the site, one facing onto Mason Street, and the other two centered on the site with a large landscaped courtyard facing the North River Canal. The Mason Street building will contain about 5,540 sf of commercial space with 28 residential apartments on the upper floors. The two center buildings will contain 64 and 56 residential apartments respectively, for a total of 148 dwelling units. There will be 247 on-site parking spaces(139 garage spaces and 108 surface parking spaces). Thirteen (13) of the apartments will be subjected to a fifteen-year affordability restriction in compliance with state and federal requirements. The project lay-out and building design is specified in the plans submitted to the Board as follows: "Site Development Permit Plan, Riverview Place"prepared by Eastern Land Survey Associates and dated May 24, 2007; and Set of four(4) elevation plans entitled"Salem Suede Residential Project (Sheets A.1 —AA) prepared by H. H. Morant & Co., Inc, Architects, dated 6/25/07. ZONING RELIEF REQUESTED In order to construct the project as proposed, the applicant seeks zoning relief in the form of variances from certain provisions of Section 7-21 of the Ordinance as to 1) minimum lot area per dwelling; 2)number of off-street parking spaces; 3) height and number of stories for the building facing Flint Street, and 4) to allow use of common building entrances for those units within 100 feet of abutting residences in an adjacent zoning district along Flint Street, all as specified in Schedule A hereto. This application to the Board of Appeal is just the first in a number of municipal approvals that will be required for the project, which it is anticipated will include: 1. Special Permit from Planning Board for multi-story residential uses under Section 7-21(e) 2. Site Plan Review by the Planning Board under Section 7-21 (g) 3. Design Review Board also under Section 7-21 (g) 4. Order of Conditions from Salem Conservation Commission 5. C. 91 License from Mass. DEP GROUNDS FOR FINDING OF HARDSHIP Conditions relating to the site and soils of the property that are unique to it, and not to other properties in the district, and, together with the financial hardship of excessive demolition and site clean-up expenses, constitute adequate legal grounds for the Board to grant these variances, subject to such conditions as the Board may impose. I The bulk of the site (Salem Suede) consists of an irregularly shaped parcel of about 3.7 acres, which is unusually large in comparison to its abutters, and is it is surrounded on its west and north sides by much smaller residential and commercial parcels. The parcel is inaccessible for much of its south side, as it is bounded on that side by the North River Canal. Both parcels contain the large but functionally obsolete buildings that have historically been used for leather industry purposes. Each building covers most of its parcel. The prior Industrial zoning that allowed such uses has been amended to make such uses, and most other industrial uses, non-conforming. The owner will incur an unusual and substantial financial hardship of having to demolish and remove the existing structures, and of performing hazardous waste clean-up of the soils at the site, and the substantial costs related thereto, before any redevelopment can occur. These factors relating to the size and shape of the property, and the condition of the soils thereon, together with the substantial financial costs that will be incurred from the demolition and soils clean-up, are unique to the site, and constitute adequate legal grounds for the variances requested. COMPLIANCE WITH MASTER PLAN The proposed development seeks to be in compliance with the Master Plan for the North River Canal Corridor, October 2003, as required by Section 7-21(a) of the Ordinance. In its Urban Design Recommendations, page 3.4 of the Master Plan recommends redeveloping this site (the "Salem Suede" site) "for housing and commercial" uses, which are the uses proposed by the applicant.
