Dear Mr. Tremblay:
You have inquired as to the legal status of the property above-mentioned as a two
family residence. The following is the undersigned's opinion as to that legality.
The property involves a substantial house sitting near the corner of Lynn Street and
Federal Street. The house itself is non-conforming as to dimensional requirements and has
been such since the adoption of zoning in the City of Salem in 1925. Because of its prior
existence, it is however non-conforming and as such may remain so without modification.
It appears that the house at some point in the past was used as a two family dwelling.
That use was suspended some time ago and it became a one family house on one half of the
house and a physician's office in the other half of the house. The owner was Dr. Melvin
Goodman and he in fact maintained that property as a single family residence with a home
occupation for a number of years.
Dr. Goodman passed away during the 1980's and the house was occupied by his widow
until her demise. The house now is vacant and it is the desire of the new owners to use the
property as a two family dwelling.
I am personally familiar with the site, having lived for a number of years at number
123 Federal Street, which is directly across the street. The house in question is a substantial
house of many thousand square feet of living area, far too much to be economically feasible
for single family use in this day of high energy costs.

The proposal to use the house as a two family dwelling is a permitted use in the zoning
district and does not in any fashion alter the footprint of the building in question. The issue
of parking has constantly been an issue on Federal Street and there is none available on the
site. It is the undersigned's opinion that the lack of parking should not prohibit the use as a
two family because virtually all of the houses on that street lack sufficient parking and the lack
of parking preceded zoning.
It is the undersigned's belief that the use of the house as a two family dwelling would
be nothing more than a continued use of a nonconforming structure in an R-2 zone, which
by definition is a legal use of the property.

You have requested an opinion in relation to property located at 124-12Cj Federal
Street. My opinion follows.
The argument has been made that the property in question is exempt from any
changes n zoning as it was in lawful existence prior to the amendment of the zoning.
It is necessary to research historical data in order to determine whether in fad this
was used in a other fashion,
I had do asion to review Polk's Directory for the years 1954 through 1994 (not all
years were gvallable, although there was a substantial number of Directories available).
For the period in gLMstion, it appears that from 1974 until 1989 the property showed
as a single family in which the family of Melvin Goodman lived and medical offices for
Melvin Goodman and Tobias Goodman. I find no data that supports the theory that this
was used as a two f#mily during that period of time.

The building itself is nonconforming in that it does not meet the necessary
dimensional requirements. It certainly can still be used as a single family and arguably
could be used as an office. It is more likely, however, that it will be necessary for a special
permit to be granted in order to use this as a two family house.
As the property has not be used as a single family and office for more than two years,
regardless of reasons for non-use, the property loses its nonconforming use and reverts to
a single family.

It is my opinion therefore, that the property in question, although previously used
as a single family and doctor's office, has lost its nonconforming use and has reverted to a
single family house. No evidence could be found in the Building Department of any use
other than that above-mentioned and therefore it is impossible for me to determine that this
was used at any time as a two family.

Dear Sirs and Mesdames:
We wish to express our concerns regarding a proposed request to change the zoning of the
property at 124-12411' Federal Street to permit two family use. This change is being
requested by various agents for the Estate of Alyce Goodman. We believe the application
is premature and too vague to evaluate its possible future implications for use and implied
population density impact. Accordingly, we ask that the Board reject the proposal.
We have the following specific concerns:
• Since the property is located in an R-2 district, would each of the two resulting units
become subject to sale and possible additional subdivision,.whether by rental or
condominium conversion, thus creating the possibility of four units`?
• The property currently has no access to off-street parking. Other properties which
have been subdivided(113 Federal, 116 Federal, 120 Federal, 3 Lynn, etc.) have
provided the 1.5 parking spaces required for each new unit, often at significant effort
and expense. What plans do the owners have to satisfy their parking obligations under
the zoning ordinances? The parking issue becomes even more critical if subsequent
subdivision is possible, the parking deficit would go from 1.5 cars in the two unit case
to 4.5 cars if four units could be created.
The agents for the current owners of the property have sent letters to selected neighbors
asking for support for their proposal. They have provided no information describing their
plans for the property with regard to these and other related issues. We have received no
letter and have only'second hand information.
The Federal Street neighborhood is one of great historic value. The neighborhood is under
constant pressure from the problems created by increasing residential density: parking
(particularly in winter, when snow reduces the number of on-street parking spaces), traffic
and noise. We who live here want to preserve the quality and value of our properties and
the neighborhood. We will be sympathetic to proposals which address clearly and
specifcaUy the issues involved and deal in letter and spirit with the zoning ordinances
which protect values of our properties and the quality of life in the neighborhood.
Since we have been presented no specific proposals addressing these issues, we must
assume the owners are asking for a blank check. We hope that the owners will withdraw
their request in favor of a subsequent proposal whose implications for use are clearly
articulated and clearly consistent with the intent of the zoning codes. If they persist. we
ask that the Board deny their request.

We wish to express our concerns regarding a proposed request to change the zoning of the
property at 124-124"' Federal Street to permit two family use. This change is being
requested by various agents for the Estate of Alyce Goodman. We believe the application
is premature and too vague to evaluate its possible firture implications for use and implied
population density impact. Accordingly, we ask that the Board reject the proposal.
We have the following specific concerns:
• Since the property is located in an R-2 district, would each of the two resulting units
become subject to sale and possible additional subdivision, whether by rental or
condominium conversion, thus creating the possibility of four units?
• The property currently has no access to off-street parking. Other properties which
have been subdivided (113 Federal, 116 Federal, 120 Federal, 3 Lynn, etc.) have
provided the 1.5 parking spaces required for each new unit, often at significant effort
and expense. What plans do the owners have to satisfy their parking obligations under
the zoning ordinances? The parking issue becomes even more critical if subsequent
subdivision is possible, the parking deficit would go from 1.5 cars in the two unit case
to 4.5 cars if four units could be created.
The agents for the current owners of the property have sent letters to selected neighbors
asking for support for their proposal. They have provided no information describing their
plans for the property with regard to these and other related issues. We have received no
letter and have only second hand information.
The Federal Street neighborhood is one of great historic value. The neighborhood is under
constant pressure from the problems created by increasing residential density: parking
(particularly in winter, when snow reduces the number of on-street parking spaces), traffic
and noise. We who live here want to preserve the quality and value of our properties and
the neighborhood. We will be sympathetic to proposals which address clearly attd
spec fcalfy the issues involved and deal in letter and spirit with the zoning ordinances
which protect values of our properties and the quality of life in the neighborhood.
Since we have been presented no specific proposals addressing these issues, we must
assume the owners are asking for a blank check. We hope that the owners will withdraw
their request in favor of a subsequent proposal whose implications for use are clearly
articulated and clearly consistent with the intent of the zoning codes.dIf they persist. we
ask that the Board deny their request.

Petitioner further states that the relief requested may be granted without
substanial detriment to the public good and without nullifying or substantiall
