The petitioner is requesting a Variance to allow the property to be converted to a two family residence in this R-2 District._. The Variance which has been requested may be granted upon a finding of the Board that: a. special conditions and circuristances exist which Especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district; b. literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner; c. desirable relief_may_ be granted without substantial detriment to_ the,,;._:, ,.,. public good and without nullifying or substantially derogating from the intent .of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented and after viewing the plans, makes the following findings of fact: 1 . The convenience store, recently closed, posed a traffic problem to the area and the conversion to a second dwelling unit will help alleviate this problem. On the basis of the above findings of fact, and on the evidence presented at the' hearing, the Board of Appeal concludes as follows: 1 . Special conditions exist which especially affect the subject property but not the district generally; 2. Literal enforcement of the Ordinance would work a substantial hardship on the petitioner; 3. The relief requested can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. Salem eport by Edward Windsor Car erg -I- With all the facts available on at least a PORTION of this house 's construction one would think that researching the dwelling would be an easy matter That would be the wrong assumption , Also , a very prominent iSalem family was connected with the second portion of construction , and , because of their prominence researching it would seem to be simple. That notion is likewise incorrect . Two points are quickly evident in the Robinson-Silsbee House tale first , that (at least partially) it involves the OLDEST construction (Puri- tan era) of the six structures involved in these reports , and second , its story has been somewhat intimately connected with that of two neighbors , the MOSES T. UPTON HOUSE .,, at 672Essex St . , and the Narbonne House (c . 1672) at 71tfEssex St . The Salem Historic District Committee Report (1 68) states that the first phase of construction at 691rEssex Street took place toward the end of the 17th century specifically by Samuel Robinson, "a Salem baker" . The Salem Vital he- cords (1849) notes that Samuel Robinson was born in Salem in 1639 , and almost certainly this was the house 's builder , in 1669 (Salem Historic Listric� , etc . ) This structure , the back part of the present building , stood a good number of feet to, the rear from the current sidewalk or street line . Robinson is listed in the Registry of Deeds (Vol. 2 ,Pg. 14 ) as buying the .tea Salem fisherman , Essex St. property from Paul '91ansfield ( - ) on epril 7 ,1661 , with )'J.thee sale price being "45 shillings " . This sale is quoted in Sidney Perley 's informa- tive work A Part of Salem in 1700 (1899) , excerpted from "The Essex Antiqua- rian" , and in the deed 's instructions Robinson was ordered not to transfer the property to any one else but his children "or his wife , Constance " . Robinson kept this promise for 8 years , in which time (as noted in the deed that follows ) he "built a house upon the land" , Exactly 8 years after Robinson bought the house from Mansfield , he "con- obinson-Z-ils'bee house neport, cont ' d. -2- veyed the, house and lot . . . .0 65o�s . . . to ivlichael Chapoan (d.1692 ) of Salem , eaman" , on April 7 ,1669 . Chapleman , of whom little is known at present , held he property for a month beyond 23 yrs . , i.e . , until his death on Way 7 , 1692 arly in the year of the notorious "Witchcraft Dilemma" . (Vol. 3 rg.54) And what of Samuel Robinson ? How was the rest of his life spent ? At the resent time 1 cannot give a clear answer . The name "Samuel Robinson" appears n various Salem Town Records toward the end of the 1600s and the beginning of he 1700s , such as the following : Salem Co'mmoners ' Records , 1713-1739 "Samuel Robinson , house in Town (i.e a , alem) .4. .ye house , ytt parnell Liues in 1661 (0) ; 1702 (2) " The notations and archaic spellings of the Puritans makes the modern researcher hink he is deciphering hieroglyphics , but THESE things did have meaning to those ho originally wrote them. ) he Essex lnstitute Historic Collections shows Samuel Robinson buying property in THER parts of Salem , in the late 1690s , but it is difficult to connect the sales ith the man of 691rEssex btreet . Also : A Samuel Robinson, jr, of Salem , and a Mary Whittemore were married at Charlestown (probably ) , "prior to 1695 " Mrs .Martha Robinson -Beane , a widow , daughter of Samuel Robin- son and 1°iartha Hawkins Robinson , married Samuel Pope in Salem in 1709 o different wives appear with the Samuel Robinson in the above listings : was, ' ther of them married to the man in this house report ? The answer remains un- own . Samuel Robinson , the creator of the original dwelling at 69AEssex Street, s 30 when he sold the house , and he slides into the background afterward , He y have lived 'til after 1700 sometime , but his story will have to wait for Pu- re research . Returning to the story of the Robinson House itself , it is not certain at changes Chapleman made in the structure during his tenure of ownership al- obinson-Silsbee House eport,cont 'd. -3- ;hough the precise changes arliot known for certain (poAw ly some form of EXPAN_ ION) . The house was built "gable-end to the street " to begin with , and every- hing would be added to that basic plan . The administrator of Chapleman 's estate fold the property to young Nathaniel Silsbee , jr. (2674-1769) , a 26 or 27 yr. -old alemite , a "joiner" by trade , "on Jan.5,1700-1701 , for30 pounds (oc,a) Es_ ex County Registry of Deeds ) This material is listed in book 14 , Leaf 136 . Nathaniel Silsbee 's purchase of the Robinson-Chapleman estate began long period of ownership by that family . Succeeding generations would make the ilsbee name one of Salem 's most prominent and distinguished , but the family 's period of ownership would also bring to the fore confusion in terms of historical esearch about certain events and WHO specifically took part in them . One source tates that Nathaniel Silsbee left his Essex Street property to his son , William ilsbee (d.1783 ) , a Salem housewright ( who was born in 1715) , and then Silsbee s widow , Joanna Fowles Silsbee ,(113-1793 ) , inherited it and "died possessed f the estate " . However , Sidney Yerle,y 's Salem in 1700 (2899) states (almost ertainly erroneously) that William Silsbee (1674-1769) owned the Wichael Chaple- an Estate , east of the Narbonne House with HIS wife , Joanna Fowles Silsbee , 'wning it after his death In reality Nathaniel Silsbee (1674-1769 ) was married �o MARY DANIEIS (1696(?, ) and his SON , William (married to Joanna) held the roperty for a while after Nathaniel 's death . The strange part about all this is hat Nathaniel 's son , William (d.1783 ) is NOT IMENT1ONED in the deaths in the 6a- em Vital Records (1849) . The second mystery involving the Robinson House deals with the time.. of s EXPANSION to the sidewalk boundary . The Salem Historic Listrict Study Report tes that in Dr.William Hentley (1759-1819) 's Diary it was recorded that , in 90 "Silsbee near the meeting house a � :d: afame, a�ljoiing-1�iS1 ?t`ore and Lwel- 'ng" A check of the Liary itself notes that this event occurred before to Nov. h of that year when the event was recorded . The Historic District Study , how- er , states that in a list of Salem houses alledgedly had the building "still t that time ) setting back from the street" , so there is another point of confu- Robinson-Silsbee House xeport , cont ' d. -4- -sion and. conflict l origioly believed that "ailsbe*had built an addition to his house in the form of a store , but it may be that the front addition was in the form of a RESIDENCE , with the store being in the "lean-to " portion of the ancient Narbonne House , to the west of it . In fact , my research leads me to conclude that NO STORE was present in the Robinson-Silsbee House until c .1921 . NO 19th century photos of the house show ANY SORT of changes which would indicate the presence of a store (then) in the building . The Silsbee family owned the Narbonne House for some time , and it was during that period that the "cent shop" opened in the "lean-to " . (Of course , there is a chance that the street numbers were increased slightly over a number of years , but this is uncertain. ) The other problem connected with this dwelling in the 18th century is 'determining WHICH Silsbee built this addition onto the original Robinson House Sidney Verley 's Salem in 1700 continues that Mrs .Joanna F. Silsbee owned the Ro- binson House , and after her death and sometime before Oct.5,1798 (according to Perley ) , HER widowed daughter lvlrs .lylartha Silsbee Babbidge (1742-1804) , (whose late husband had been Capt .Christopher Babbidge (1741-1792 ) ) , took con- trol of the property , and afterward entered into an agreement along with her son ,Christopher Babbidge (1770-1837 ) • Rut to backtrack a bit , it seems that 14014E of the above parties were involved in the building of the frontal ad- dition . That "honor" would fall on either Capt .Nathaniel Silsbee ,Sr. (1749-1?91 ) or his more famous son , Capt. (and later U.S .Senator) Nathaniel Silsbee ,Jr. (1773-1850) . The irony connected with this association is that William Silsbee , who departed this life at the age of 48 , was a housewright , trained for such tasks nd practicing them before death took him in 1.783 , but apparently had nothing hysically to do with expanding the Robinson dwelling . The first candidate would e his son , Capt .Nathaniel Silsbee . James Duncan Phillips in Salem in he 18th Century (1937 ) wrote that the senior Silsbee owned the brigantine "Fame ", privateer in the Revolutionary War , in partnership with the great trading mag- ate , Elias Hasket Derby , with the vessel being commanded by Samuel Hobbs ( 17 )binson-Silsbee House teport , cont ' d. -5- 1779.) . I (z3ilsbee ,Sr. ) wase merchant , but did not wive the Revolutionary Var by many ,years , dying "married , on shipboard , entering New York Oiarbor) , une 25 , 1791 , age 42 yrs . Silsbee had married aviary Crowninshield (1778-1835 ) of the prominent Crowninshield family , in 1802 , and was part-owner of 18 ships during his successful career . He retired from business in 1835 . Tax records no doubt would speak of the addition to the Robinson-Sils- bee House ; most records 1 have consulted , unfortunately , do not . Many of the changes dealing with this dwelling deal more with change in ownership than any- thing else . Until 1 see further explanatory data , 1 will put the addition 's e- rection in 1797 . Ivirs . Iviartha Silsbee Babbidge and her son , Christopher , sold " 3/5ths of the estate to Samuel Townsend (1762-1801) of aalem` , mariner" in 1798; unfortunately , this Salemite was "lost at sea" not long after the beginning of the new century . Mansfield Burrill,Jr. (1768-1837) , another 'Salemite , and a , took control of the other portion of the estate before 1798 . Townsend's widow was ivlrs .Iviercy Stevens Townsend (1766-1844) , and she lived in the house until her death , selling the 69>tEssex Street property to her widowed daughter , Ivlrs .111ercy TownsendUpton (1796-1855) , who died "possessed of the estate" (SEE MOSES T. UPT014 HOUSE REPORT,6721 EaSEX STREET) , Showing the (business sense of the era , Ivirs .Townsend sold the property to her daughter for 850. 00 on Sept.20, 1838 (as noted in Parley 's Salem in 1700) . Mansfield Burrill had acquired his portion of the Robinson-Silsbee Estate from "another (? 1 of the children and heirs of Ivlrs.oilsbee (who ) released his or her share of the estate " at an unnamed date , sometime before Ivlansfield sold his 4oldings to Samuel Town- send , (that sale mentioned in Registry of Leeds . Vol. 164,f, 138) , for p480. 00 . The mystery of the Silsbee heirs in the late 1700s (and as to whether Nathaniel Silsbee ,Jr, was involved in any dealings connected with the property ) , is also complicated by trying to decide WHICH Ivlansfield Burrill bought the Robin- son Iilsbee land from them . i had always believed the buyer was the YOU14GEH Bur- rill (mentioned toward the beginning of this page) , but it could well have been his FAT14ER , Iviansfield Burrill,ar. (1739-1826) , a Lynn native , who settled in Salem in his younger years and married Joanna Gilsbee (1738-1832) , daughter of Robinson-Oilsbee nouse Heport, cont 'd. -8- William -zilsbee and Joanna lales 6ilsbee . Like his fuer-in-law Burrill,6r. was a housewright . (Joanna Silsbee was the older sister , of course of Gapt. Nathaniel Silsbee ,Sr. , the partner of the Derbys in the American Revolution and the father of the prominent politician , Nathaniel Silsbee ,Jr. ) yerley wasn 't certain , in Salem in 1700 , whether Burrill was Joanna Silsbee 's HUSBAND or 6014 , but present research shows he was the former . The other important point was that he was a housewright , who even built a house "about 1776 on Es- sex Street , next west of the rhillips school house " . So , 1°iansfield Burrill entered the Silsbee family through his marriage to Joanna , and it put him in a very good position to acquire ailsbee property . (as his wife OUTLIVED him , of course , it is obvious he did not inherit it from her will) Yet why would a man in his 50s or 60s , who had already built a house on Essex Street , buy into this estate ? I suppose the idea is not unreasonable , but because of his years I had believed the junior Mansfield Burrill , in his 30s (probably) when a land transfer occurred , would have been more likely to take this property (after all , the man whom Burrill later sold the property to would only have been 8 yrs . younger) . The problem here is that a number of sources (including the Burrill Genealogy Chart) say little about Aansfield,Jr. ; they don 't even give his year of birth and say NOTHING about his occupation . (A check of the Sa:Lem City Hall records gave me the surprising revelation that Mansfield Burrill,Jr. 's death notice for 183.7 is NOT LISW) , nor is there a death notice for his wife , Sally Randall Burrill , whom he married in 1794 up through the year 1880. ) Nathaniel Silsbee ,Jr. went quite far from his 'roots ' at 69trEssex St. he served as U.� .senator from Massachusetts from 1823 to 1835 , and retired from politics the same year he retired from active involvement in his own bu- siness concerns , 1835 He may have had a 'passing interest ' (literally ) in the house of his birth the domain of two of his aunts and grandparents , but he had no involvement with what happened in its precincts . In the 1830s-1850s era , the latter period of the ownership reign of Robinson-Uilsbee House Heporont 'd. -9- "Irs .0lercy' Stevens Townsend an through that of her daugh'Per , virs .idercy Townsend (IUpton , a 'cent shop ' or 'penny shop ' was in operation in the ancient Narbonne house , west of the Silsbee residence , in the 'lean-to ' ell portion of that (structure , and on the other side , in the home which formerly stood at 67irEssex ')t . (torn down and replaced in the late 18OOs ) , lived Joseph Preston (1780-1840) , a former privateer commander in the War of 1812 . Ile was Salem-born , commanding the privateer-vessel "Diomede " during that war , and having been captured by the Royal Davy in battle , he spent time in the infamous Dartmoor Prison in England Joseph Preston , it seems , has no direct connection with this report although there may have been a partial relationship (SEE MUSES T. Upton (son of 1°irs .LIiercy 'Townsend Upton) , think of his OWN posthumous father 's experiences in the War of 1812 , experience also shared by Orange St. resident , Robert Hussey las noted in the 7ffOrange 6t . house report) Preston 's widow , "Irs . Rebecca Peale Freston (1778-1875 ) lived next door to the Upton landholdings for many years , in later life under the care of her daughter ivlrs . Richard S . Noble . Things were quiet , for the most part , at 69trEssex btreet , for the greater bulk of years in the 19th century . The house 's use was strictly residen- ial , and did not 'make the headlines ' either as the home of prominent people nor s the location of exciting events . lyloses T. Upton was busy with his housewright business at this time , living in the house for a number of years , and after his death (and even though his widow , Lv1rs ,Sarah E. The sales of portions of the 69ffEs.sex St. estate rambled "back and 'orth" into the 1900s . Anna G. Hubon came into possession of the property in No- ember , 1901 , acquiring it from F. A. Newell , Collector of Taxes (in Salem) , s recorded in Vo1. 1658 , Pg,224 . The estate was listed as sold by Moses J. Up- on and John i'. Upton , "by the will of 'Mercy P. Upton of Lialem , deceased , (will ) ironed July 3 , 1855 (Vol. 1693 , Pgs .490,491 ) . It is elsewhere explained that Mrs . -ubon bought the property from Jeremiah C. O 'Callaghan on Lec . 26 ,1902 (this sale .Iso mentioned in Vol.2823 ,Pg,126 ) , Jeremiah C . O 'Callaghan , an auctioneer , sold the Silsbee-Robinson roperty at public auction , on Oct . 7, 1902 , to William P. Hubon , for 452300.00. . nna G. Nikiel also bought a separate chunk of the estate from Sarah -,�aalem and Aq G. But the estate would remain under Polish-American control , at least 'til he end of the 1920s . Changes were occurring on the property , probably some of hem to the house itself . One difference that might have come outof these years as the change in the building 's long roofline . An old drawing of the Silsbee- obinson House , featured in Sidney Perley 's Salem in 1700 , shows the house 's oofline to be straight , without any lower levels without any 'dips ' . The RESENT roofline , however , shows the back 'half' of the structure to be 'lightly IAWER ,;perhaps about,:aaFOOT below. .the front section of the roof , t're- isely when and WHY this change came about is uncertain , but it may have come n the early. 1900s . The protruding addition on the east side of the Silsbee-Robinson House lust have been constructed for the store at this time , in 1921 . The house 's his- tory has slid into the background but its use as a variety store has been a con- ;tant over the years . Ever since 1 was a little boy on Orange St, in the early :950s , 1 can remember this place as ."Armand 's Variety " , after longtime owner , Irmand Richuits . Armand has retired in recent years , and his old store now bears the odd name , "Ram Mart" but it still continues in use as a variety market and will continue on into the future . The Silsbee-Robinson House is alive and vell in the late 20th century even if very few people are aware of it . (The sale is recorded i1.n Vol.142 , Pg.l2 , of the Registry of weeds . ) Burrill was 43 yrs , old when he (made this purchase , and Silsbee was 67 yrs , of age . Mansfield Burrill,Jr. 's oc- cupation thus remains unknown , even though he later died in Salem . The PROBLEM with the senior Burrill 's holdings , however , is that a search for his sale of the land to Samuel Townsend (Vol. 164 , Pg. 138) , on Oct-5 ,1798 , has been frus- trated by a rearrangement of the deeds for this period in the photostatic copies of that particular deedbook , so a FINAL settlement of this issue has still proved to be impossible .
