Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial detriment, financial or otherwise, to the petitioner. c. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district of the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1 . Petitioner failed to prove hardship as required for variance requests. 2. The neighborhood in question is densely populated and parking both on and off street is at a premium and any futher relief from parking would cause further problems. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Board of Appeal concludes as follows: 1 . Special conditions do not exist which especially affect the subject property and not the district in general. 2. Arranged on a cross-gable plan, the house has a side hall entry with a bracketed door hood supporting a second story oriel windows. Other features include the fully pedimented gable ends and deep cor- nices with heavy brackets grouped in two's and three's. The' architect or builder gave a great deal of attention to the window treatment. There are paired round- headed sash in the pediments, drip cap moldings on several other windows and an elaborately bracketed 1st floor window hood with a fanciful frieze. HISTORICAL SIGNIFICANCE (Explain the role owners played in local or state history and how the building relates to the development of the commmity.) Directories show that this house was standing by 1857. Its first owner was J. Lovett Whipple, a partner in the gum copal works, Stephen Whipple and Brothers. Albert Whipple, probably J. Lovett's brother, lived next door at 45 Essex Street. Gum copal, a hardened resin from the copal tree, was processed as a base for varnishes. Salem began importing the material in 1832 from Zanzibar in East Africa. Whereas the gum had previously been cleaned with a knife , the Whipple Company (founded by Jonathan Whipple in 1835) introduced the process of washing it with alcohol. The business operated successfully at its waterfront site between Turner and White Streets until 1861 when an import duty of 100 pound was imposed on the gum, increasing production costs.
