DECISION ON THE PETITION OF SALEM HARBOR COMMUNITY DEVL£LdPxEVocc0*RATION
FOR A VARIANCE AT 51-53 DOW STREET. (R-3)
A hearing on this petition was held May 17, 1995 with the following Board
Members present: Stephen Touchette, Chairman; Gary Barrett, Arthur
LaBrecque, Nina Cohen and Albert Hill . Notice of the hearing was sent to
abutters and others and notices of the hearing were properly published in
the Salem Evening News in accordance with Massachusetts General Laws
Chapter 40A.
Petitioner is requesting a Variance from front, side and width setbacks to
subdivide an existing non-conforming property located at 51-53 Dow Street.

The Variances which have been requested may be granted upon a finding by
this Board that:
1. Special conditions and circumstances exist which especially affect the
land, building or structure involved and which are not generally
affecting other lands, buildings and structures involved.
2. Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the
petitioners.
3. Desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district of the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented
at the hearing, and after viewing the plans, makes the following findings
of fact:
1. There was no opposition in this matter.
2. Speaking in favor of the petition where: David Shea, Hanson Street,
Point Neighborhood Action Group, David Carlton, 26 Barnes Road, Peter
Strout, 29 Intervale Road and Ward 1 City Councillor, George Ahmed.
3. This will allow petitioner a fuller use of the property.
On the basis of the above findings of fact, and on the evidence presented
at the hearing, the Zoning Board of Appeal voted unanimously, 5-0 to grant
the variance requested, subject to the following conditions:
1. Petitioner shall comply with all city and state statues, ordinances,
codes and regulations.
2. All requirements of the Salem Fire Department relative to smoke and
fire safety shall be strictly adhered to.

3. All construction shall be done as per the plan and dimensions
submitted.
Petitioner shall obtain a building permit prior to beginning any
construction.
5. A Certificate of Occupancy is to be obtained.
6. Petitioner is to obtain approval from any City Board or .Commission
having jurisdiction, including, but not limited to the Planning Board.
As an Amendment to the Petition, Petitioner is further granted a Variance
from the requirements for parking.

The City of Salem is willing to commit $65,000 of HOME funds to the CDC's project at
51-53 Dow Street based on the revised pro forma dated April 27, 1995. The City supports the
CDC's plan to rehabilitate this 4-unit property, which has been abandoned for over four years,
and reconfigure it into 2 units to be sold to very low or low income working families.
As you know, this property has been on the Neighborhood Improvement Plan's "Bottom
Ten List." The rehabilitation of abandoned properties for affordable homeownership is an
important City goal, and I look forward to seeing this property transformed from an eyesore into
a stabilizing influence in the neighborhood.

Dear Mr. Touchette:
As chairman of the Neighborhood Improvement Plan Task Force, I am writing to express
the Task Force's support for the petition by the Salem Harbor Community Development
Corporation(SHCDC)to reduce the number of units from four to two at 51-53 Dow Street. The
CDC's plan to reconfigure the building into two units to be sold to low income working families
has the support of the City, which is willing to commit housing funds to this project.
The Neighborhood Improvement Plan Task Force (NIPTF), which is made up of City
department heads, focuses on the elimination of problem properties. This building, which has
been abandoned and entangled in a bankruptcy proceeding for over four years, is on the Task
Force's "Bottom Ten List" of the worst problem properties in Salem. Rehabilitation of this
property for affordable homeownership and reduction of density would transform the building
from an eyesore into a stabilizing influence on the neighborhood. The project has the Task
Force's complete support and we urge you to approve the reduction in number of units at 51-53
Dow Street.
