The 3 buildings located at 1-2-3- Laurent Road were built as apartments in 1976. The
conversion from apartments to condo requires no process from the City of Salem other
than the required Fire Department Inspection and their regulations.
Also, the only work that has been permitted is for new siding and recently new roofs and
some of the kitchens and baths. No structural work has been permitted.

On Monday, June 24 , 1968 , a continued hearing was held on the application
of the above named Ida M. Talbot requesting a. variance from the application
of the Zoning Ordinance relative to lot size requirement , setback require-
ments and frontage requirements .
At the hearing held on the above described petition, further evidence was
introduced by the petitioner indica.ting the proposed type of construction,
indicating the location of the buildings , and further indica.ting the pro-
posed development of the roadway, together with the utilities . .
Examination of the facts of the situation indicate tha.t this area was zoned
as an R-3 zone in 1965 , and a.s a result , there was insufficient area. left
in the lots as they existed to permit the construction of any building in
accordance with the requirements' of the Zoning law.
It wa.s felt that if petitioner combined the lots a.s shown on the plan sub-
mitted and by granting the variance requested, that he could then make use
of the property without in any way affecting or derogating from the intent
of the Zoning Ordinance , having in mind tha.t the zone is an R-3 zone . .
The petitioner indicated that he wished to construct duplex dwellings on
both sides of Laurent Road as it appears on the plan submitted with the ap-
plication. Further, the intention of the petitioner was to pla.ce one build-
ing on each side of Laurent Road, which building would cover the area.s now
shown as Lots Y and Z , and Lots W and X, each building containing 4 apartments
The Board found tha.t since this area is in an R-3 zone , it would be an undue
hardship not to permit the petitioner to build on the lots in question. It
wa.s further felt that the petitioner would still have to appear before the
Planning Board to comply with all of their requirements pertaining to road-
ways and installation of utilities .
The terrain of the property is such tha.t it wa.s found tha.t the request for
the proposed variance is a reasonable one . There are other dwellings in the
neighborhood and there are some business establishments in the neighborhood
and that since the construction contemplated was of a residential type and
in keeping with the general residences in the neighborhood and, in view of
the fact that the terrain is not conducive to other types of construction and,
in further reference to the fa.ct that the Zoning ha.s been changed to R-3 zone
with larger area requirements , that it would impose a substantial hardship on
the petitioner not to be permitted to proceed as requested. The Board voted
unanimously to grant the requested variances .

A hearing on the Petition of Omer R. Talbot and Ida M. Talbot was held with
mpg,&ers Donald Eames, Arthus Labrecque William : Nott, jAnes Boulger and Douglas
71,oppe:c present. Notices were sent to abutters and others in accordance with Mass.
General Laws, Chapter 808, concerning properties located at 1 and 3 Laurent Road
in an R-3 District.
The property has two buildings, each containing -four dwelling units. Ihe
Petitioner requests a variance from the density regulations in order to add two
additional dwelling units to each building.
Atty. George P. Vallis, One Church St. , represented the Petitioners and pre-
sented the Board with a petition signed by 75 residents in favor of granting the
variance. Or. Vallis noted that the requirements of the zoning ordinance had Changed
with respect: to R-3 unit requirements from 1.,000 s_. ft. to 3,500 sq. ft. per unit.

The Board voted q-0 -to grant the variance for two additional dwelling units to
earn building at 1 F 3 Laurent Rd. James Boul.ge_ refrained from voting-.
The Board felt that it could grant the variance requested ;without substantial
detriment to the surrounding neighborhood and without derogating from the intent. of

In connection with this .Talbot plan of Horton Street land, I wish your opinion
on the following: you have filed with your office a set of plans for four (4)
units, which originally were going to be built on separate lots on this property
on both sides of the street, using the same basic plan.
What we propose to do now is to put up one building on the entire land
owned by,Talbot,on either side of Horton Street for a total of two (2) buildings.
I believe that we can get eight (8) units as outlined on this plan on the left
hand side of the Street going in from Jefferson Avenue, and I believe that this one
building of eight (8) units complies with our zoning requirements insofar as
density-side line restrictions and lot area are concerned having in mind it is an
"R-311 zone.
On the right hand side of the Avenue we are not fully ready to dome in with a
building plan for that as yet.
I do believe that this proposal (one building on 8 units-left hand side) meets
with all requirements of our zoning, but would ask that you give me a verbal
opinion before we go ahead and have a detailed plan drawn showing the one
building.

Dear Mr. O'Brien:
In further explanation of my client's position regarding the issuance of
a permit on the easterly side of Horton Road for the construction of eight (8)
apartment units, as per plans submitted, I believe that the problem has to be
looked at from the following position:
1 . Does he comply with existing zoning ordinances for
I'R-3" zones?
If he does and wishes to utilize all the land which he owns on the easterly
side of Horton Road, and the number of units requested is permissable in accordance
with our density requirements, then I believe a permit should issue.
The fact that at some previous time my c." ' received a variance for the
construction of other type units should not affec.- : its new permit.
I do not believe that our zoning ordinances mean that once a variance is
granted, that the land affected by the variance is so restricted for all time as to
any other permissable uses under our zoning ordinances.
I wish, therefore, that you would consider this application in the licht of a
brand new application for a permit and decide the question on that basis .

A Form "A"_. application and plan, presented for endorsement as not requiring

land Industrial Park and Highland Realty Trust, showing land off Highland
Avenue was the next order of business. This plan is entitled "Preliminary
Road Layout , Salem, Mass. , Highland Industrial Park; Scale: 1" = 100 ' , dated
May 6, 1971, Essex Survey Service, 47 Federal Street, Salem" , and carries a
notation "Total area = 161- 5± Acres" . Several copies were submitted, and a
copy will be sent to the City Engineering Department and Health Department
respectively, together with letters of transmittal requesting the. advice
and counsel of both departments.
A : status inquiry form, regarding land of Hyman Marcus and Building Enter-
prises , received from the bonding company requesting information as to the
progress of work agreed to in the Peter Road area , was answered as follows :
"The contractor has not completed the required work to date" , signed by the
Chairman, and will be forwarded to American Fidelity Company of Cambridge ,
Massachusetts, the bonding company securing the Covenant between the City
Planning. Board and Marcus et ali. It was suggested that the City Solicitor
be contacted with regard to whether or not such Covenants are recorded at
the Registry of Deeds.
The matter of the 1971 contract between this Board and the Planning Services
Group was discussed and compared with the contract for the previous year.
Tadios Sadoski moved that the Board approve this contract, seconded by
Michael Freeman, and so approved by unanimous vote.
At the request of the Inspector of Buildings, Daniel O' Brien, a plan which
had been presented to him in connection with the erection of two eight-unit
dwelling houses on Horton Road, was_ studied by the Members. From records
presented, including approval by this- Board of a definitive plan following
the required procedure for -submission and approval of such definitive plans,
it was learned that originally the Board of Appeals had granted a variance
to Ida Talbot , owner of the land, rto permit the erection of two four-unit}
dwellings. This was to be accomplished by combining two lots on each side

of Horton Road. Copies of this decision were presented to this Board with
a plan of land for subdivision approval of this definitive plan. The Board
found that the plan submitted to the Building Inspector, now showing two
structures proposed to house eight units each is not the same plan approved
by this Board for subdivision on Horton Road. The Board recommends that
no permit be issued by the Building Inspector in accordance with the plan
submitted as said plan is not the same plan which was approved by the Plan-
ning Board.
The Members reviewed the matter of amendments to the City Building Code
which have been presented to the City Council on previous occasions. Since
no action has been taken to date , it was felt that a recommendation from the
Planning Board, urging their approval and acceptance of these amendments as
proposed, be forwarded to the Councillors for their next meeting to be held
on May 13th. Jane Lundregan will draft this recommendation.
Mention was made of the fact that election of Board officers is usually held
in May. Nominations and election will take place at the next meeting, May 20t1l.
A communication from the Massachusetts Roadside Council, advising that in-
stead of allowing the House to consider the bill, H-522 , with regard to out-
door advertising complying with local zoning in granting permits for bill-
boards, the Speaker dismissed it to House Ways and Means. The letter from
Margaret Welch, Legislative Chairman of the Roadside Council, strongly urges
that a letter to Chairman Anthony M. Scibelli of the House Ways and Means
Committee be dispatched promptly, urging that the bill be returned to the
House floor as soon as possible. On motion of Abby Burns, the Board voted
to follow this suggestion.
.Tbe._ Chairman, Gerald McCarthy, presented a communication from the North
Shore Gas Company. This was in relation to a plan endorsed by this Board
in December, 1970, as not requiring subdivision approval. A copy of that
plan and alsq a copy reproduced from the same plan showing changes after
the approval, accompanied the letter. Mr. Freeman moved that the Board
reply to the Gas Company as follows:
"We accept the plan, and are thankful that you notified us, but we do not
expect-'that changes in plans will occur after they have been signed by
members` of the Planning Board" .
Thomas a seconded this motion, and with Tadios Sadoski refraining
from voting, it was voted approved.
A copy of "Proposal for Planning Study - Harbor Area of Salem, Massachusetts"
was brought to the meeting and discussed among the members. Copies will be
made—and- distributed to all members.
This was the final businessof the evening, and the meeting was adjourned
at 9: 45 P.M.

This henr:i.ng was opened at 7: 30 P.M. by Acting Chairman Gerald McCarthy, .
with hoard Members Albert Pitcoff and Tadios Sadoski present.
The Chairman read the advertisement .as it Appeared in The Evening News
notifying all interested persons or the hearing.
John R. Serafini , Counsel for the developer, appeared with his client ,
and stated that the Board of Appeal had given permission to . erect one
building on each side of this road, each containing four apartments.
The decision of that Board further stated that the petitioner would
still have to appear before this Board to comply with all of the re-
quirements pertaining to roadways and installation of utilities:
Counselor Serafini presented postal receipts showing that abutters had
all been notified.
The Chairman asked if anyone present wished to be heard in favor or in
-_--- opposition to this proposal. No one replied. The Board voted to request
the City Engineer to comment on this plan.
The hearing was then declared closed at 7 : 45 P.M.

The first order of business for the regular meeting which immediately a.n
followed the public hearing referred to above , was a Form A application
submitted with a plan showing land on Highland and Cherry Hill Avenues .
The applicants, John and Maureen Downey, propose to convey lots 546B
and 547B to the R. & H Realty Trust , present owners of Lots 4 and 5, for
expansion of esistent facilities with access to Highland Avenue . Mr.
Pitcoff moved that we endorse this plan, the motion being as follows :
"I move that this endorsement bemadewith the condition that Lots 4 and
5 and 546B and 547B shall all be considered as one building lot , and that
no separate conveyance of either lot 546B or lot 547B, or both, hereafter
be made for building purposes" . Motion was seconded by Mr. Sadoski , all.
in favor, and so voted approved.
A communication from George Vallis , Counsel for Salem Acres , Inc. . , was
read. This letter made reference to Witchcraft IIe:ights , Puritan Road ,
and requested that the Board grant three waivers , they being the width
of the street to 40 feet, bituminous curbs be installed instead of ran-
and overhead electrical installations be allowed rather than un-
_iorground. On motion made and seconded, it was voted to grant these,
waivers .

Dlt. Vallis then sought approval for his client , Salem Acres , Inc . , of a sub

division plan, previously submitted, and on which a public hearing was held
on October 3, 1968, entitled "witchcraft Heights - Puritan Road" . Mr. Pitcoff''
moved that the Board approve this plan as of the date of this meeting, which i
October 17 , 1.968 , subject however, to the condition that the applicant obtain
for this Board a letter from the Board of Health to the effect that the Board
of Health now has no objection to our approval of this plan, and subject also,
to the further condition that the applicant arrange to grant a drain and
water casement to the City of Salem over a portion of his land between lots
75r and 75G, and further, that immediately following receipt of a letter from
the Board of Iloalth , this Board notify the City Cleric of its action of approv-
al of this plan. Seconded by Mr. Sadoski, all in favor, and so voted approved
Mr. Vallis then asked for a reduction in -the amount of security held by the
Citv from his client Salem Acres, Inc . ; discussion followed as to the proper
amount of security which would be required. The Board decided that further
discussion must be held before a decision can be reached, and voted to dis-
cuss this matter further with the Chairman of the Board.
The Board next voted. to ratify a vote to withdraw recommendation of amend-
ments to the City Council with regard to the Zoning Ordinance submitted pre-
viously. Motion was made by Mr. Pitcoff to ratify the vote as follows :
"Mr. Chairman, it appearing that the Chairman has written to the City Coun-
cil to the effect that this Board withdraws its recommendations previously
made to the City Council as the result of hearings on proposed amendments
to the Zoning Ordinance , and this being in consequence of a conference held
by members of this Board with members of the. City Council , I move that we
ratify the letter which has been written in. this regard by the Chairman for
this Board, dated October 81 1968" Motion seconded by Mr. Sadoski, all in
favor and so voted.
A discussion followed on preparing ordinances to provide rules and regula-
tions regarding gas service stations with particular regard to storing and .
selling used cars , motorcycles, etc . Mr. Pitcoff suggested that he discuss
this further with Mr. Dobbs, the City Solicitor, and get his views on this. .
This concluded the business for this meeting, and it was voted to adjourn. .

on January 2, 1969, it was voted to approve the definitive plan of
Narcisse Talbot developer of land on Horton Road, subject however to the
proviso contained in a memorandum from the Chairman of this Board, dated
January 29 1969, to th effect that for a distance of 100± feet from Jef-

project expected to be undertaken by ,the City of Salem next
year.
This Flood Control project calls for a major change in the ,
grade of Jefferson Avenue, and the construction of a new trople-m
pipe culvert in the area where Horton Road is planned to enter
Jefferson Avenue.
The final approval of the lower end of Horton Road should be
delayed until the details on the Jefferson Avenue changes are
available.
A temporary grade, to meet the present conditions, could be
permitted with the proviso that the final (higher) grade, and
the necessary extension of the proposed triple—pipe culvert
will be done by the developer .at a future date .

George Nowak and Michael Freeman present .
The first order of business was approving and accepting minutes of last,:
meeting.
--------A memo was read to the meeting relating to the zoning map being '
prepared
by Mr. Carter of Carter & Towers F,ngineering Corporation, and also con-
cerning a conversation with the Chairman of the Board of Assessors, Mr.
Walter Groszyk, with regard to assessors' maps being prepared by the- New
England Survey Company. A letter from Mr. Joseph Carter was read, re-
q uesti.ng that he be heard at the next meeting of the Board, April 16, to
discuss finalizing preparation of the new zoning map. Mr. Groszyk in-
formed the Board that copies of the assessors ' maps will be available
by the time the Board holds its next meeting. A letter will be forward-
ed to Mr. Carter requesting his presence at the next meeting.
A Form A application with plan of land on Cedar Crest Road was presented
for the owner, Donald Winter, by Counselor George P. Vallis . The endorse-
ment of the Board was requested on this plan for purposes of conveying a
portion of the area shown as Lot #1 . On motion of Mr. Nowak, seconded by
Mr. Garrity, it was voted unanimously to endorse this plan as not requir-
ing approval under Subdivision Control Law, as the land , has sufficient
area and frontage on a public way.,
A letter from this Board to Counselor Vallis who represents Salem Acres ,
Tnc .. , developers of the Witchcraft Heights area was read, requesting his
comments with regard to complaints of residents of the ,area relating to
drainage and street in§tall.ations . Mr. Vallis was present at this meet-
ing, and stated that Mr. Joseph Carter, who is the architect for his
client will be at the April 16 meeting of the Board , and requested that
this matter be discussed fully at .that time to acquaint the Board with
measures which have been taken to correct the situation . The Board
agreed to this request . Mr. Garrity informed Mr. Vallis that he had vis-
ited the area , and in his opinion__a._very real problem exists , and he would
.like to see a survey made by Mr. Carter.
A letter to Counselor John ' Serafini from the Board was read ; this co
ned his request for
a waiver for his client Narcisse Talbot , requesting
that he appear at this meeting for clarification of this request . Mr. .
Serafi.ni explained by Statute a Covenant can be givenin lieu of a bond
furnished by the developer. He further stated they were asking to do
the following: "Since this is the only dwelling we would seek to build
at the present time , this would not be sold, nor would he apply for any

all that is required . " Ward TIT Councilor, Joseph Tngemi , stated plans are
available and a copy is now in the City Engineer' s office relating to the
Flood r'ontrol plan; the State is in the process of. accepting the plans from
the consulting engineers; nothing in Jefferson Avenue is going to be
changecLas- of last Wednesday, Mr. Schuyler told him, and stated they would
--aceept the plans as they are now., The Councilor further stated he did *not
think we would run into any big problems with Mr. Talbot ; for this matter,
of tving into Jefferson Avenue, we are waiting for HUD money.

had been requested by the Board with relation to the 60-day Statutory re
quirements with regard to developments of Carrollton and Frederick Streets,
owner Hewitt Bros . , represented by Counselor John R. Serafini.
The next order of business was reading a letter of resignation submitted to
the Board by its recording secretary, Christina Callahan .
Counselor George Vallis spoke to the members stating, this was a preliminary
presentation of proposed plans for future construction; his client , DiBiase
Bros . purchased two very large tracts of land , one formerly owned by the
T.or:ing Hills Associates, and prior to that ownership by the Loring Realty
Trust , abutting streets Surrey Road, Moffatt Road , Preston Road and some
of the others in that area ; also , an area of approximately 200 acres off
Marlborough Road , formerly owned by .Tames Grasso . Mr. Vallis pointed out
that this City is running out of land area . These parcels are mostly zoned
for residential use , some areas are zoned presently for, Conservation. Mr.
Vallis stated that some future date , he will come in to the Board request-
ing that all of these be rezoned for residential use , both for single fam-
ily and multi family residence . districts . '
This brought to a conclusion all matters brought to this meeting, and it
was voted to adjourn at 9:40 P.M. I '

Sometime ago the Salem Planning Board approved a
subdivision plan of Narcisse A. Talbot, a copy of which I
am enclosing herewith. This land is located off Jefferson Ave.
It is Mr . Talbot ' s wish that he now be permitted
to build, on one (1) lot of land and, would litre to seek a
building permit for this purpose.
We have a provision, which unless waived,, requires
a person involved in a subdivision to file a bond .to secure
the installation of roadways and utilities , such as sewer
and water . Since Mr. Talbot wishes to build. on this first
lot only, at this time, he will agree that if your Board.
would. waive the provision as to a "monetary bond," , he would
substitute in place thereof, .a Covenant that would. be bind-
ing on the land, and, would. not permit him to sell or transfer
said. lot without securing a release in writing from the
Salem Planning Board..
The release would not- be issued, until the Board,
is satisfied that all its rules and regulations have been
complied with.
Mr . Talbot has executed, the enclosed. Agreement, which

These new Members are Mrs. Abby L. Burns, Mrs. Jane Lundergan, Mr. Thom-
as Berube, and Mr. Michael Freeman.

Meeting was opened at 7: 30 P.M- �On motion made and seconded , it was Vo-
ted to approve and accept minutes of previous meeting.
Mr. McCarthy gave a brief summary of the regulations for Subdivision
Control.
A reminder from the City Clerk regarding the due date for submitting the
annual report to his office was read.
A Form "A" application and plan were presented by Counselor John F. Mur-
phv, Jr. , in behalf of Scangas Brothers, 129 Dartmonth Street , Lynn., Mass.
The plan showed a parcel of land between #106 and #108 Highland Avenue ,
on which a variance with regard to lot frontage had been granted by the
Board of .Appeals in April of 1966. On motion of Mr. Sadoski , seconded
by Mr. Garrity, it was voted to endorse this plan as not requiring ap-
proval under subdivision control regulations.
A letter from the o£fice 'of Counselor John R. Serafini for his client
Narcisse Talbot was read to the meeting. This letter which was accom-
panied by an agreement and plan of land of Mr. Talbot , requested avlaapv- 1
er as follows:"We have a provision, which unless waived, requires a per- \,
son involved in a subdivision to file a bond to secure the installation
of roadways and utilities, such as sewer and water. Since Mr. Talbot j
wishes to build on this first lot only at this time, he will agree that

N"Teetter from the City Engineer with regard to proposed silbdivisi.ons
on Carrollton and Frederick Streets was read to the meeting; the letter
called attention tothe fact that-_:a-, portion of the developer' s lots ,
"B" and "C" on Frederick Street,: were part of the entrance to the, pro-
posed Witchcraft Heights School.. It was voted to request that Counsel-
or John R. Serafini who represents this developer, grant a waiver with.
rc?ard to .the time limit applicable to disposition of definitive plans
submitted to this Board.

mCounselor Serafini next presented a definitive plan of land for his client ,
Narcisse Talbot , showing lots of land on Horton Road. Mr. Pitco£f made a
mot,i.on as follows : "Stith regard to the application for approval of this
srnhdivision plan of Horton Road, the applicant being Narcisse Talbot , in
connection with which a public hearing was held by this Board on October
1.7, 1968 , T move that we approve this plan , subject however to the pro-
vibo contained in a memorandum from the Chairman of this Board, dated Jan-
uary 2 , 1969, to the effect that for a distance of luu± feet from 'Jeffer-
son Avenue, the operation of Morton Road within said 100± feet , will in
the future be regraded so that it will be raised to meet the then exist-
ing new grade of Jefferson Avenue which will be determined by p'.'ans cur-
rently being made for the Commonwealth of Massachusetts, Department of
Public Wori:s :in relation to the Flood Control project of the South River,
such regrading raising the possibility or probability that changes wi.11
,-itsome later date be required regarding the installation of street util-
ities w:itnin said distance of loot feet; such future regrading be done in
accordance with the requirements to be indicated by the City Engineer;
pending the final determination of such changes, construction of utilities
may take place by the applicant throughout the entire extent of Horton
Road, including the luO± feet , but subject to the changes which may be
required at a later date ; any such regrading° which may be required at a
later date shall be . at the sole expense of the applicant" . This motion
was seconded by Mr. Sadoski , all in favor, and so. voted approved.* '
This concluded the business brought to this meeting, and it was voted to
adjourn at 7: 25 P.M. to the Council Chamber where the City Councillors
were waiting to meet as a committee of the whole with this Board and with
Mr. Fallon and Mr. Young from the: Department of Commerce and Development .

At the meeting with Councillor at Large John Burke presiding, the Council-
lors asked pertinent questions of the representatives of the Department
of Commerce and , Development who answered all questions addressed to them.
State Representatives. Michael .Harrington and Samuel Zoll requested infor-
mation as to when the City can expect the Urban Renewal program to get
under way. Mr. John Barrett , Director of the Redevelopment Authority,
answered questions directed to him. State Senator Kevin .Harrington ques-
tioned Acting Chairman GeraldMcCarthy of the Planning as to the duties
of the Board and declared that the program should be started immediately.
The Senator further stated that the federal government has passed a number
of good programs which could benefit a 300-year city like Salem.
The City Councillors suggested another meeting with the Planning Board and
its consultants, the Planning Services Group, Inc. , and Mr. Fallon and Mr.
Young.
This meeting being concluded at 9 : 15 P.M. business for the evening was com
pleted and the Board voted. to adjourn.

Gentlemen:
I presume that the preliminary plan and profile relative to Horton
Ed. is the one reviewed by me some time ago . If so, the details
relating to utilities appeared to be the best that can be done under
the local conditions. The applicant' s engineer determined that the
sewer could be connected to the existing main by excavating the
existing sewer and obtaining the exact elevation of it.
I believe this is to be a subdivision and so call attemtion to the
fact that the grade of the road is shown as over the maximum.:of lOJ
as limited in the regulations. Details of the portion of the road
that extends over the existing brook should be s7gown in detail on
the definitive plans.
A more complete report can be had after the definitive plan is
submitted.
