A hearing on this petition was held September 20, 1989 with the following Board
Members present: James Fleming, Chairman; Messrs. , Bencal , Febonio, Nutting and
Associate Member LaBrecque. Notice of the hearing was sent to abutters and others
and notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
The petitioner, represented by Attorney Chris Drucas, is seeking a variance from
the rear yard setback requirement to allow for the continued existence of the
existing sheds. The locus of the property is in a B-4 district.
The Variance which has been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the zoning ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the public
good and-,without nullifying or substantially derogating from the intent of
the district or the purpose of the Ordinance.
The Board of Appeal , after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
I . No opposition was presented.
2. The continued existence of the sheds will allow the petitioner the
full use of his property.
3. The sheds have existed since 1966.
On the basis of the above findings of fact, and on the evidence presented. the
Board of Appeal concludes as follows :
1 . Special conditions exist which especially affect the subject property but
not the district generally;
2. Literal enforcement of the Ordinance would work a substantial hardship on
the petitioner;
3. The relief requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district of the purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the relief
request, subject to the following conditions:

adhered to.
2. The petitioner obtain a legal building permit.
3. The sheds are to remain as per the plans submitted to the Zoning
Board of Appeal .

This office inspected the above referenced property for possible

Upon our inspection of your property we found a number of possible
violations so we posted a stop-work order on May 3, 1989. You are in

Petitioner appealed to the Board of Appeal for a variance from
the application of the City of Salem Zoning Ordinance after be—
ing refused a permit to occupy this under—sized lot for the re—
location of his metal works building.
A_,lot of 6000 sq, ft. with a frontage of 60—feet is required in
this district. Petitioner's lot contains 5250 square feet and
has a 50—ft. frontage.
A hearing was : held on this appeal in the office of the Inspector
of. Buildings, Room 7, City Hall, Salem, on February 28, 1966,
pursuant to notices mailed postpaid to the petitioner, abutters,
Board members, and others, and advertisements published in the
Salem Evening News.
Appearing in favor of this petition, Att'y. Louis Baker and the
petitioner; appearing in opposition, Raymond Rosmich 25 Laurel
Street, Rita Tessier, 17 Laurel Street, and James Connolly,
13 Laurel Street.
After due consideration thereof, with all Board Members present
and voting unanimously, the variance was granted, provided the
building at the new location conforms to all other requirements
of the Zoning law, and also provided that the petitioner obtain
all necessary and legal permits from the proper authorities in
order to move said building.
The Board voted on the grounds that granting this variance would
not derogate from the intent and purpose of the Ordinance, and
would not cause detriment to the public good.

Dear Bill :
The Salem Cycle Sales, Inc. is presently—operating a repair
shop for motorcycles at 2` 7 L�reet, Salem; which is located
in a B-4 District. The company alsowishes to sell and service
new and used motorcycles in this location and is aware of the
necessity of obtaining a license from the Licensing Board to carry
on such an activity.
The Licensing Board, however, will not issue such a license
until , among other things , it receives assurance from the Building
Inspector that the proposed activity is a permitted use under the
City's Zoning Ordinance.

Some time ago, I discussed this matter with the Building Inspector
and it was his belief that a variance would be required to permit the
corporation to carry its proposed activity because such an activity
is not a permitted use under Section V, Paragraph A-7 (page 18) of
the Zoning Ordinance. He bases his opinion on the fact that although
the section allows for the sale and service of automobiles , it does
not address itself specifically to the sale and service of motorcycles
and he is , therefore, not willing to extend the meaning of the word
automobiles to include motorcycles unless he receives an otherwise
ruling from your office.
The fact of the matter is that nowhere in the Zoning Ordinance
under any district is the sale and service of motorcycles or motor-
vehicles specifically mentioned as permitted uses. For that matter,
neither is the sale and service of snowmobiles , which is obviously
a form of a motor vehicle, specifically mentioned, but, as you know,
there are presently in -Salem businesses in operation which sell and ,
service motorcycles and snowmobiles .

I submit to you that the sale and service of motorcycles is
a permitted use in a B-4 District for the following reasons :
1. Automobile service stations are defined in the Zoning
Ordinance as "a retail place of business engaged in supplying
goods and services for the normal operation of a motor vehicle" .
2. Subsection L of Section 7 , states that included within
the permitted uses are "retail uses relating to the permitted
uses in Paragraph 7" .
3 . The title of Section 7, B-4 District is "wholesale and
automotive business" .
4 . The definition of automobile in Black' s Law Dictionary
is "a vehicle for transportation of persons or property on the
highway, carrying its own motive power and not operated upon
fixed tracks" also "a wheeled vehicle propelled by gasoline"
also "a self-propelled vehicle suitable for use on a street or
roadway" .
It seems incomprehensible to me that a Zoning Ordinance
such as the City of Salem' s which includes as permitted uses in
the wholesale and automotive business district the sale and
service of automobiles and automobile service stations would
exclude motorcycles .
With all due respect to the office of the Building Inspector,
I believe it is drawing a very fine line of difference, which in
my opinion, is not intended by the drafters of the Zoning Ordinance.
I am aware that in Chapter 90 , Section 1 of the General Laws , an
automobile is defined as any motor vehicle excluding motorcycles,
but I submit to you that that definition is pertinent to Chapter
90 and has nothing to do with Zoning Ordinances , which as you
know, are covered by Chapter 40-A.
My office is interested in this matter because I represent Mr.
George Belleau, the owner of the property at Laurel Street, who is
in the process of selling the real estate to Salem Cycle Sales, Inc. ,
which sale is contingent on their obtaining a license which would
permit them to sell motorcycles .

allegations contained therein. We also have contacted your office

Dear Mr. Michaud, -
This office inspected the above referenced property for possible
zoning and building code violations.
Upon our inspection. of your property we found a number of possible
violations so we posted a stop-work order on May 3, 1989. You are in
violation of Salem Zoning Ordinance sect . IX para A & B and Mass State
Building Code Sect . 113 and 121 .
Salem Zoning, section 1X, para A, Enforcement, para B violations.
violations of any of the provisions of this ordinance shall constitute a
misdemeanor. Any person who violates this ordinance shall, upon conviction
and in addition shall pay all costs and expenses involved in the case. Each
day such violation continues shall be considered a separate offense. Nothing
herein contained shall prevent or remedy any violation.
Mass Building Code sect . 113, working without a permit and sect . 121
violations. Violations penalties, anyone who shall violate a provision of
this code shall be punishable by a fine of not more than one thousand dollars
($ 1 ,000. ) or by imprisonment for not more than one year or both, for each
violation. Each day during which any portion of a violation continues shall
constitute a separate offense.
To correct these violations, you should contact this office within forty
eight hours (48) from receipt of this notice, and apply for permits and the
Salem Board of Appeal applications. Failure to do this will result in this
office taking legal action against you.
