A public hearing on the above Petition was opened on March 16, 2016 pursuant to M.G.L Ch. 40A, § 1land closed on that date with the following Salem Board of Appeals members present: Rebecca Curran (Chair), Peter A. Copelas, Mike Duffy, Tom Watkins,Jimmy Tsitsinos. 5 The petitioner is seeking a Variance for relief from the provisions of Sec. 3.3.4 of the Salem Zoning Ordinance to increase an existing non-conformity and a Special Permit from Sec. 3.3.3 Nonconforming Structures and alter a nonconforming structure for a substantially different purpose. Statements of fact: 1. In the petition date-stamped February 23, 2016, the Petitioner requested a Variance for relief from the provisions of Sec. 3.3.4 and a Special Permit from Sec. 3.3.3 Nonconforming Structures of the Salem Zoning Ordinance to increase an existing non-conformity and alter a nonconfornring structure for a substantially different purpose. 2. Attorney Grover presented the petition on behalf of the petitioner. 3. The subject property is located in a B1 Zoning District. 4. The petitioner proposes to renovate the existing building and the addition along Turner Street. 5. The property is dimensionally nonconforming with respect to lot coverage and side yard setback. The petitioner proposed to construct two (2) porches that will cause the lot coverage to increase from the existing 42% to 43%lot coverage and requested a Variance per Section 3.3.4 to allow an increase in an existing nonconformity. r 6. The petitioner proposed to convert the existing building, currently owned and operated by the House of the Seven Gables Settlement Association, to six (6) residential dwelling units. The current use of the structure is an alternative high school. The petitioner has requested a special permit per Section 3.3.3 to alter a nonconforming structure for a substantially different purpose. 7. The petitioner proposed nine (9) parking spaces, which meets the required number of parking spaces per the Zoning Ordinance. The property is located in the&f Zoning District,which allows multifamily use by right. However,the existing structure is nonconforming with respect to lot coverage and side yard setback.The addition of two porches will cause the lot coverage nonconformity to increase from 426/6 to 43°/q requiring a varia. under Section 33.4 of the Ordinance.In addition,the alteration of the ncnconformi ig structure for a substantially different purpose requires a Special Penait under Section 333 of the Ordinance. The proposed re-ase of this property would not be substantially more detrimental to the neighborhood for a variety of reasons.This is an opportunity to redevelop a building that is no loner in productive use.There will be adequate parking on site and there will be no negative impact on.drainage and utilities.The natural environment will be improved by significant enhancements to the landscaping of the property.Many of the surrounding homes are multi- family so the proposed use of the property will not be out of character in the neighborchood. Finally,the property will be converted from an exempt use to one that will be a source of substantial tai revenue to the City. Ms.Schaeffer: On behalf of The House of the Seven Gables Settlement Association (the Gables), I would like to express the organization's strong support of the petition submitted by 114 Derby Street Nominee Trust,for a variance to allow an increase in an existing nonconformity and a special permit to alter a nonconforming structure for a substantially different purpose. As you may be aware,The Gables is the current owner of 114 Derby Street.The organization purchased the building in the late 1960s then used it to house its pre-school and after-school programs until those were discontinued in 2010. Because the Gables no longer uses the building,the Board of Trustees decided to divest of the property. Because the building is located directly across the street from our National Historic Landmark Campus. The Gables has a great interest in ensuring that any developer restore and use the property in a way that respects both the historic nature of the building and the character of the neighborhood.We have seen the conceptual drawings of the petitioner's plans and feel that they accomplish both of these objectives.The drawings showed that the architectural character of the building will be maintained;the addition of landscaping will improve the overall appearance of the streetscape; with 6 units,the use of the building will be consistent with the many other multi-family homes in the neighborhood; and,the availability of off street parking will minimize the impact on the availability of on street parking in the neighborhood. I was present at a neighborhood meeting where the petitioners presented these plans to concerned neighbors, I can personally attest to, and was reassured by,the overwhelmingly positive response of residents that live nearby. In light of the above, I respectfully recommend that the Board of Appeals grant the variance and special permit requested in the petition of 114 Derby Street Nominee Trust.
