The petitioner is requesting a Variance from side yard setback and front yard setback to construct a farmers porch for the property located at 55 Dearborn Street located in an R- 1 zone. The Variances, which have been requested, may be granted upon a finding by this Board that: a. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structure involve. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioners. c. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district of the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1. Petitioner is requesting variances for relief from side setback and front setback requirements. The requested relied is side setback of 6 feet and the required is 10 feet, front setback of 11 feet and the required is 15 feet. 2. The petitioner's property is an existing nonconforming lot in an R-1 zone and the proposed addition would exceed the side and front setbacks allowable according to the Salem Zoning Ordinance. 3. The right side setback of the existing structure is currently 4' plus or minus and the proposed addition will have a right side setback of 6'. The front setback will be 11' to the farmers porch and 8' to the stairs. The proposed plan is to remove the existing front stairs and deck, and replace it with a larger, roofed over farmer' s porch, as shown on the drawing submitted herewith. The new enlarged porch will set back approximately eleven feet from the front lot line, as does the current, smaller porch. This does not meet the fifteen foot front setback requirement in this R- 1 zone, thus, a variance to front yard setback is requested. Also, the proposed porch sits approximately five feet from the front side yard and, although it is set back further than the existing side building face, a variance is requested to the ten foot side yard requirement. It is the Petitioners ' belief that the proposed porch will be an attractive addition to their home and allow them to better enjoy the river views across the street.
