Copies of this letter are being sent to the Mayor's office, City Solicitor, Planning Board, a Councillor-at-large, and the Board of Appeals. We spoke with you at length some time age concerning our deck and the problems we were having getting it approved. At that time you ex- pressed ignorance about the appeal process and said we would just have to go through the system. It was quite a shock to us to discover that you wrote a lengthy letter in opposition to the deck that was publicly read by the Chair- man of the Board of Appeals at a meeting on September 30, 1992. Your alleged innocence of the system was grossly misleading at best. You didn' t even have the courtesy to inform us of your opposition, never- the-less write such a damaging letter. We have since come to discover that you spoke with one person in the entire ward - the one neighbor who is in opposition to the deck. This hardly constitutes advocating for the people in the ward. Ever single neighbor and abuttor has signed our petition approving our plans. Enclosed please find a copy. Please note over fifty (50) signatures. You are also aware that the Planning Board is unanimously in favor of our deck. The job of a ward councillor is to represent the interests of the entire ward. Your actions clearly favor the interest of a single in- dividual. This is most disconcerning behavior from an elected official. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioners, owners of the property, are requesting a Special Permit to extend nonconforming rear and side setback to allow construction of a deck. The property is located in an R-2 district. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section 5-3(j ) , which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Sections 8-6 and 9-4 , grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension or expansion of nonconforming lots, land, structures, and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. It has a gambrel roof and a 3—bay symmetrically arranged facade with a center entry. Decorating this entry is the Victorian feature of a. bracketed doorhood supportii,g a second story bay. other features are the pedimented dormers, rear leanto, west end wing, and placement of the second story windows close to the roof eaves. Later it was purchased by Frank E. Locke (see J1 Dearborn Street ) who rented the house to teamster Howard A. Sylvester and Julia E. Smith, occupation unknown. Because of the large number of tanner;cs located along the batiks of tae North River, many shoemakers and leather workers lived in North Salem during the 19th century. The area also developed as a suburban neighborhood for professional and clerical people who worked in downtown Sale-. Before such residential subdivision began, ownership of land in the Morthfields, as this part of Salem was called, was based on a system of communal proprietorship for argricu'_tural our roses. In its vernacular character, the dwelling is similar to many in Salem. It hes a eambrel roof and a 3—bay symmetrically arranged facade with a center entry. Decorating this entry is the Virtorian feature of a bracketed doorhood supportii,g a second story bay. Other features are the pedimented dormers, rear leanto, west end wing, and placement of the second story windows close to the roof eaves. Deed researcS would be needed to identify the early owner(s) of th$c property but by 1851 it was the home of shoemaker Joseph Smith. The house remained in the Smith family as late as 1897. Later it was purchased by Frank E. Locke (see 31 Dearborn Street) who rented the house to teamster Howard A. Sylvester and Julia E. Smith, occupation unknown. F' Because of the large number of tanneries located along the banks of the North River, many shoemakers and leather workers lived in North Salem during the 19th century. The area also developed as a suburban neighborhood for professional ar,d clerical people who worked in downtown Sales. Before such residential subdivision began, ownership of land in . the Northf.ields, as this part of Salem was called, was based on a system -f communal proprietorship for argricu'_tural purposes.
