Petitioner, owner of the property is requesting a Variance from minimum parking requirements and a Special Permit to increase a permitted use in a nonconforming structure by allowing the construction and renovation of the apartments on the second and third floors of the building for individual rooms with shared kitchen and bath facilities on each floor. The petitioner is requesting an increase in the number of rooms to eighteen (18) . The petitioner was represented by Attorney John Serafini Sr. The Variance which as been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the land, building, or structure involved and which are not generally affecting other lands, buildings or structures in the same district; b. literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner; c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section V B 10, which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section VIII F and IX D, grant Special Permits for alterations and reconstruction of non- conforming structures, and for changes, enlargement, extension or expansion of nonconforming lots, lands, structures, and uses, provided, however,that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. (B-1 ) A hearing on this petition was held June 6, 1990 with the following Board Members present: Richard Bencal , Chairman; Edward Luzinski , Vice Chairman; Joseph Correnti , Secretary; Richard Febonio and Mary Jane Stirgwolt. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property is requesting a Variance from minimum parking requirements and a Special Permit to increase a permitted use in a nonconforming structure by allowing the construction and renovation of the apartments on the second and third floors of the building for individual rooms with shared kitchen and bath facilities on each floor. The petitioner is requesting an increase in the number of rooms to eighteen (18) . The petitioner was represented by Attorney John Serafini Sr. The Variance which as been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the land, building, or structure involved and which are not generally affecting other lands, buildings or structures in the same district; b. literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner; c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section V B 10, which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section VIII F and IX D, grant Special Permits for alterations and reconstruction of non- conforming structures, and for changes, enlargement, extension or expansion of nonconforming lots, lands, structures, and uses, provided, however,that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. In more general terms, this Board is, when reviewing Special Permi requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City' s inhabitants. The petitioner seeks to operate a rooming house on the premises and would be required to make available twenty-seven (27) parking spaces per the Ordinance. 2. The petitioner presented, to the Board, a list of all the rooming houses in the City which included the number of rooms along with the number of tenant' s cars. 3. That as of 5/25/90 no rooming house in the City has more than seven (7) cars on the premises, while many had between two and four cars only. 4. The petition has paring to accomodate seven (7) vehicles and has make arrangements with the adjoing landowner for an additional nine (9) cars. 5. That most inhabitants of rooming houses do not have motor vehicles. 6. that there was no opposition to the petition. 7. That strict enforcement of the zoning ordinance would involve substantial hardship to the petitioner. 8. SCHEDULE-A The Petitioner is the owner of- the premises at 89 Congress Street, which consists of a single building and garage, and is used as a rooming house and multi-family resident property. The building is a non-conforming building and has been so for many years prior to the adoption of the current Zoning Ordinance. The premises have been used for a rooming house for many years. The Petitioner wishes to upgrade the building and to install a full sprinkler system and to utilize the apartments on the second and third floors of the building for individual roomers with shared kitchen and bath facilities on each floor. All work will be done to Code and in conformance with State building regulations. There is a shortage in this City of rooming houses, and upgrading the premises can provide the types of services that rooming houses have provided for a number of years, namely reasonable accommodations for people who do not normally have automobiles and who either work in the community or are here for a short period of time and who cannot afford to pay for hotel or apartment type space. The need is great. The Petitioner wishes to contribute to the fulfilling this need and at the same time upgrade the building to install a full sprinkler system. He would ask the Board to grant the increase in number of rooms to eighteen (18) , which would be accomplished by converting the second and third floors into six (6) units with shared facilities on each floor. Because of the expense involved in upgrading the building and installing sprinkler systems, the conversion is necessary to help defray a portion of the expense. There is parking to accommodate seven (7) vehicles; a total of twenty-seven (27) would be required under the R-3 Zone in effect in that area. The Petitioner has had a survey made of the number of rooming houses in the area and the number of parking spaces available. It is clear that most inhabitants do not have motor vehicles and there is not any problem with the parking requirements. However, he has made arrangements with the adjoining landowner for an additional nine (9) spaces. Please see attached letter. Rooming and lodging houses are permitted in R-3 and B-1 Zones as of right. We, therefore, request a Special Permit to increase the permitted use in a non-conforming structure. No exterior alterations or additions are planned. The Building will remain the same, but the existing use would be expanded. The Petitioner also requests a Variance from the parking, so as to permit parking as shown on the plans submitted herewith. A hardship is created in that-=the land is such and the building on it is location in such a manner that further on-site parking cannot be provided. -Therefore, the Petitioner respectfully requests a Special Permit to extend the non- conforming use and a Variance from the parking requirements. SCHEDULE A The Petitioner is the owner of the premises at 89 Congress Street, which consists of a single building and garage, and is used as a rooming house and multi-family resident property. The building is a non-conforming building and has been so for many years prior to the adoption of the current Zoning Ordinance. The premises have been used for a rooming house for many years. The Petitioner wishes to upgrade the building and to install a full sprinkler system and to utilize the apartments on the second and third floors of the building for individual roomers with shared kitchen and bath facilities on each floor. All work will be done to Code and in conformance with State building regulations. There is a shortage in this City of rooming houses, and upgrading the premises can provide the types of services that rooming houses have provided for a number of years, namely reasonable accommodations for people who do not normally have automobiles and who either work in the community or are here for a short period of time and who cannot afford to pay for hotel or apartment type space. The need is great. The Petitioner wishes to contribute to the fulfilling this need and at the same time upgrade the building to install a full sprinkler system. He would ask the Board to grant the increase in number of rooms to eighteen (18) , which would be accomplished by converting the second and third floors into six (6) units with shared facilities on each floor. Because of the expense involved in upgrading the building and installing sprinkler systems, the conversion is necessary to help defray a portion of the expense. There is parking to accommodate seven (7) vehicles; a total of twenty-seven (27) would be required under the R-3 Zone in effect in that area. The Petitioner has had a survey made of the number of rooming houses in the area and the number of parking spaces available. It is clear that most inhabitants do not have motor vehicles and there is not any problem with the parking requirements. However, he has made arrangements with the adjoining landowner for an additional nine (9) spaces. Please see attached letter. Rooming and lodging houses are permitted in R-3 and B-1 Zones as of right. we, therefore, request a Special Permit to increase the permitted use in a non-conforming structure. No exterior alterations or additions are planned. The Building will remain the same, but the existing use would be expanded. The Petitioner also requests a Variance from the parking, so as to permit parking as shown on the plans submitted herewith. A hardship is created in that the land is such and the building on it is location in such a manner that further on-site parking cannot be provided. The building is a non-conforming building and has been so for many years prior to the adoption of the current Zoning Ordinance. The premises have been used for a rooming house for many years. The Petitioner wishes to upgrade the building and to install a full sprinkler system and to utilize the apartments on the second and third floors of the building for individual roomers with shared kitchen and bath facilities on each floor. All work will be done to Code and in conformance with State building regulations. There is a shortage in this City of rooming houses, and upgrading the premises can provide the types of services that rooming houses have provided for a number of years, namely reasonable accommodations for . people who do not normally have automobiles and who either work in the community or are here for a short period of time and who cannot afford to pay for hotel or apartment type space. The need is great. The Petitioner wishes to contribute to the fulfilling this need and at the same time upgrade the building to install a full sprinkler system. He would ask the Board to grant the increase in number of rooms to eighteen (18) , which would be accomplished by converting the second and third floors into six (6) units with shared facilities on each floor. Because of the expense involved in upgrading the building and installing sprinkler systems, the conversion is necessary to help defray a portion of the expense. There is parking to accommodate seven (7) vehicles; a total of twenty-seven (27) would be required under the R-3 Zone in effect in that area. The Petitioner has had a survey made of the number of rooming houses in the area and the number of parking spaces available. It is clear that most inhabitants do not have motor vehicles and there is not any problem with the parking requirements. However, he has made arrangements with the adjoining landowner for an additional nine (9) spaces. Please see attached letter. Rooming and lodging houses are permitted in R-3 and B-1 Zones as of right. We, therefore, request a Special Permit to increase the permitted use in a non-conforming structure. No exterior alterations or additions are planned. The Building will remain the same, but the existing use would be expanded. The Petitioner also requests a Variance from the parking, so as to permit parking as shown on the plans submitted herewith. i A hardship is created in that the land is such and the building on it is location in such a manner that further on-site parking cannot be provided. Therefore, the Petitioner respectfully requests a Special Permit to extend the non- conforming use and a Variance from the parking requirements. Notice of the hearing was sent to abutters and others and notices were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioners are requesting a Special Permit in order to increase a permitted use in a non-conforming structure by allowing the construction and renovation of the apartments on the second and third floors of the building for individual roomers with shared kitchen and bath facilities on each floor . The Petitioner is requesting the Board to grant an increase in the number of rooms to eighteen (18) . The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section B 10, which provides as follows : Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section VIII F and IX D, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension or expansion of nonconforming lots, land, structures, and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City' s inhabitants . The Board of Appeal, after consideration of the evidence presented at the public hearing, makes the following findings of fact: 1. The premises and building in question consists of a single building and garage. 2 . All abutters of the premises were notified by certified mail and the certified mail returns were presented to the Board. 3 . That there is a need in the city for additional rooming spaces and a letter to that effect, from the Salem Housing Authority, was presented to the Board. 4 . That there will be a twenty-four hour, seven days a week on-site manager at the premises . 5 . The proposed changes can be implemented in harmony within the present non-conforming structure, both structurally and aesthetically. 6 . That there was no opposition to the petition during the public portion of the hearing. On the basis of the above finding of fact, and of the evidence presented at the hearing, the Board of Appeal concludes as follows : 1. The proposed changes will not be substantially more detrimental to the neighborhood than the existing non-conforming use and can be granted in harmony with the Zoning ordinance and without derogating from its intent or the public good. Therefore the Board of Appeal voted 5-0 to allow the Special Permits requested subject to the following conditions : 1 . That the proposed changes be implemented as per plan submitted. 2 . That all necessary state and local permits be obtained, including but not limited to building and fire permits and inspections . 3 . That a Certificate of Occupancy be obtained as required. 4 . That there be single person occupancy only per room. 5 . That there be a maximum of fifteen (15) rooms at the premises excluding common areas . Board of Appeals Joseph C. Petitioner is requesting a variance from the parking requirements 61 in this 23PS zone. The variance which has been requested may be granted upon a finding by this Board that: 1 . Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other land, buildings and structures in the district . 1 2 . Literal enforcement of the provisions of the zoning ordinance would involve substantial hardship, financial or otherwise to the petitioner. 3 . Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing makes the following findings of fact : 1. That the petitioner seeks to operate a rooming house on the premises and would be required to make available twenty-seven (27) parking spaces per the ordinance. 2 . That the petitioner presented to the Board a list of all the rooming houses in the city which included the number of rooms along with the number of tenant ' s cars . 3 . That as of 5/25/90 no rooming house in the city had more than seven (7) cars on the premises, while many had between two and four cars only. 4 . That the petitioner has parking to accommodate seven (7) vehicles and has made arrangements with the adjoining landowner for an additional nine (9) spaces . 5 . That most inhabitants of rooming houses do not have motor vehicles . 6 . That there was no opposition to the petition. 7 . That strict enforcement of the Zoning Ordinance would create a particular and substantial hardship to the petitioner . On the basis of the above findings of fact and on the evidence presented at the hearing, the Board of Appeal concludes as follows : 1 Special conditions exist which especially affect the subject property but not the district in general; 2 . Literal enforcement of the provisions of the zoning ordinance would involve substantial hardship to the petitioner; 3 . Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the ordinance. Therefore, the Zoning Board of Appeals voted 5-0 to allow the variance requested subject to the following conditions : 1 .
