While nurseries are permitted under the Zoning in this area, it is felt that the definition is not broad enough to cover day care services which are to be offered on that site. The building in question on Colby Street described in the Petition, clearly shows that the property meets the density requirements of the underlying zoning, except for the rear yard requirement. it is submitted that day care services, as part of the services offered by Salem Hospital, are compatable with its role in the Salem community. The Petitioner, therefore, respectfully requests a use Variance so as to permit the operation of a day care center as shown on the enclosed plans, together with a Variance from the rear lot line requirement. The area contains several medical facilities and is close to the main Salem Hospital building. There is ample parking on the site as shown on the enclosed plans. The lot in question, because of topography, shape, and a location that places part of the lot in a buffer zone is not a typical R-1 lot, which makes development difficult. The fact that the Zoning Ordinance speaks to nursery care and clinics but does not specifically permit day care creates a hardship for the Petitioner, who operates a hospital, rehabilitation center and various clinics. The ambiguity makes it difficult to obtain the licenses required to operate a day care center. 44 11,783 \A3 — s - -_- -__'_ ti 6 300 \42 Esc- s _ IOAS 0.0 151 \ 00\ril0 0 6 y Po tin✓t ' -3 1 6 ut t, ee e 00 +\ \ \ e 6 .. -1 N T / D6 s P \ Ig \3p ` I /+ \ eb X05 J ,1+ \\0 e ` 1 2 2B Bt ie ce POND \ 5819 a JI yy - \ b 115 4j 4 41 4j 96 113 O AC. \ 10/45 0 If O y e94s Ilk • \ `D ? SCHEDULE A The undersigned Petitioner, Salem Hospital, is the owner of the property, and is desirous of providing day care services on the site, which would primarily serve the employees of Salem Hospital and its affiliated subsidiaries. while nurseries are permitted under the Zoning in this area, it is felt that the definition is not broad enough to cover day care services which are to be offered on that site. The ambiguity makes it difficult to obtain the licenses required to operate a day care center. ./r. 1 ai9 •i i 1 1 • ` bv` 02 24 A G II `.,tJm 4.♦ c0 O 03ch ypol 2 7 i*109 v lo./ B s9 d s VIP 000 m oe e+ qiq 34 e / 'e t ♦ltA yGJ ' 's ♦\SOT "J JFK e of ` O• a 10n tl n so CITY OF SALEM CITY OF SALEM BOARD OF APPEAL BOARD OF APPEAL 745-9595 Ext. 381 745.9595 Ext. 381 Will hold a public hearing for all persons inter- Will hold a public hearing for all persons inter- ested in the petition submitted by Salem Hospital ested in the petition submitted by Salem Hospital for Variance to allow the operation of a Day Care for Variance to allow the operation of a Day Care Center and a Variance from rear setbacks at 1- Center and a Variance from rear setbacks at 1- St. ednes- 3 Colby St.(R-1).Said hearing to be held Wednes- 3 ColSeptember)19a 990 at 7:0Sid hearin0 P.M.eOnto be hld eV Salem day, September 19, 1990 at 7:00 P.M.,One Salem day, Green, 2nd floor.
