12 Cleveland St. R-1 Arthur Raby i 1 T CIERK'S OFFICE 14. 01ity of , $Ulem, Aussadjusetts nary of enI DECISION ON THE PETITION OF ARTHUR RABY FOR A VARIANCE AT 12 CLEVELAND STREET (R -1) A hearing on this petition was held September 21, 1994 with the following Board Members present: Stephen Touchette, Chairman; Gary Barrett, Stephen O'Grady, Nina Cohen and Albert Hill. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioners, owners of the property, are requesting a variance from use,lot size and frontage to allow parcel to be divided and to construct a two family dwelling. The Variances which have been requested may be granted upon a finding by this Board that: 1. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures involved. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioners. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district of the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1. There was no opposition to petitioner's application to divide his lot and construct a two-family dwelling. 2. A letter signed by several abutters was submitted in favor of the petition. 3. John Donahue, City Councillor for the ward in which the property is located, argued, in favor of the petition , that the proposed residence would enhance value of the surrounding homes and remove a vacant lot. DECISION ON ,THE PETITION OF ARTHUR RABY FOR VARIANCES AT 12 CLEVELAND STREET. , SALEM page two On the basis of the above findings of fact, and on the evidence pJ J seppted , at the hearing, the Board of Appeal concludes as follows: dCT 40 ';u 9 1. Special conditions exist which especially affect the subject property but not the district in general. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship to the petitioner. 3. Desirable relief can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. Therefore, the Zoning Board of Appeal voted unanimously, 5-0 to grant the variances requested, subject to the following conditions: 1. The Petitioners for 73R Lawrence Street and 12 Cleveland Street both need to file a Waiver From Frontage from the Subdivision Control Law if a Variance is granted from your Board. In addition, 29 Bridge Street is within the Entrance Corridor Overlav District and if the proposed addition is 2 , 000 s .f. or over a special permit is required from the Planning Board. If I can answer any questions that you may have or if you desire additional information, please do not hesitate to contact Debbie Hurlburt at ( 508 ) 745-9595 exc . 311 Sincerely, 8 Walter B. THE VARIANCE WOULD ALLOW THE PREMISES TO BE SUBDIVIDED. WE WOULD ALSO ASK THAT THE BOARD OF APPEALS GRANT A VARIANCE TO ALLOW THE CONSTRUCTION OF A TWO FAMILY DELLING ON THE PROPERTY. WE FEEL THAT THE PETITION SHOULD BE GRANTED IN THAT THE RELIEF GRANTED, ALLOWING THE PROPOSED SUBDIVISION AND CONSTRUCTION OF A TWO FAMILY DWELLING, WOULD BE BE BENEFICIAL TO THE NEIGHBORHOOD IN THAT THE PROPOSED VARIANCE WOULD ALLOW AN ADDITION TO THE PROPERTY TAX BASE AS WELL AS INCREASE PROPRRTY VALUES IN THE NEIGHBORHnOOD.
