Grealish, Chairman; George Ahmed, Stephen O'Grady and Associate Member Arthur Labrecque. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioners, owners of the property, are requesting a Variance from lot size and frontage to allow construction of a single family dwelling at 11 Clark St. A Variance was granted on December 7, 1988 to allow 24 Barnes Circle to be divided thus creating the lot now known as 11 Clark St. located in an R-1 zone. The Variance which has been requested may be granted upon a finding by this Board that: 1. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures involved. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1. There was no opposition to the proposed request. 2. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Board of Appeal concludes as follows: 1. Special conditions exist which especially affect the subject property but not the district in general. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship to the petitioner. 3. Desirable relief can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. One lot would be a house lot with a dwelling and for purposes of this Petition shall be referred to as "Parcel 111 . The second lot to be created shall be a buildable lot , upon which the Petitioners plan to build a two - story house , and for purposes of this Petition shall be referred to as "Parcel 2" . This is a statement in support of the petition of. Stephen J . Masella and Peggy E. Masella for a Variance to allow the creation of the two lots . It is believed that Mr . & Mrs . Masella meet all of the requirements for granting the Variance . There would be no detriment to the public good in that no additional city services would be required to be added by the city. There would be no substantial increase in the traffic on either Barnes Circle or on Clark Street , and both Clark Street and Barnes Circle are wide enough streets to accommodate entering and exiting from the lots by automobiles . Adequate fire protection can be provided to both properties . There would be no substantial derogation from the intent and purpose of the By Law despite the fact that the Variances are sought to reduce the area from 17 , 985 square feet to 12 , 985 square feet for one lot and 5 , 000 square feet for the second lot . Nor would there be a substantial derogation from the intent and purpose of the By Law despite the fact that variances are sought to reduce the frontage requirements from 100 feet to 51 . 13 feet for one lot and for 50 feet for "Parcel 2" . In regard to "Parcel 1" , the Parcel currently, and since 1918 , has had a frontage along Barnes Circle of 51 . 13 feet . No change is sought in the frontage for "Parcel 1" . Rather , the current frontage would remain the same whether the variance is granted or denied. Entry onto and off of Barnes Circle will not be affected in any way. Both "Parcel 1" and "Parcel 2" would conform in size and shape to the lots on all sides of the newly created lots as well as to other lots in the neighborhood. In fact , most of the homes in the immediate vicinity are built on lots of approximately the same size as the lots which are to be created, that is , on undersized lots .
