BOARD OF APPEAL 0 3 of ttlrm, ttsstttltusetta N "' J n W BOura of -ALt}lelll omw T a a ma N (.O N n) DECISION ON THE PETITION OF JAMES PICONE FOR VARIANCE AT 5 CHEVAL AVE. (R-I) A hearing on this petition was held July 22, 1992 with the following Board Members present: Richard Bencal, Chairman; Richard Febonio, Francis Grealish, Stephen Touchette and Associate Arthur Labreque. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property, is requesting variances from lot coverage and all setbacks to allow existing garage to be demolished and to construct a new structure. Property is located in a Residential Single Family district. The Variance which has been requested may be granted upon a finding by this Board that: 1. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures involved. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1. There was no opposition. 2. The existing garage was built during the 1930's and cannot accommodate modern motor vehicles. 3. The new structure would be more in harmony with the adjoining structures. 4. If not granted the structure could only be used for dead storage which was not the intended nor desired use. The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem Zoning Ordinance and/or the Building Code and order the Inspector of Buildings to approve the application fee permit to build as filed, as the enforcement of said Zoning By-Laws and Building Code would involve practical difficulty or unnecessary hardship to the Undersigned and relief may be granted without substantially dero- gating from the intent and purpose of the Zoning Ordinance and Building Code for the following reasons: The structure in question, located at 5 Cheval Avenue, Salem, is a metal 4-door garage contiguous with 18 other garages on that street. The building is prefabricated and was erected to shelter cars built during the 1930' s. Present day cars do not fit in the garage. The overhead doors strike the trunk lids of full -size cars preventing the doors from meeting their intended purpose. The building needs to be expanded by 18 inches which will equal the depth of all other garages in that row. The neighbors who abut the property are supportive of this request since the improvements made to the garage will benefit their property. II Owner.
