DECISION OF THE PETITION OF ANGELO MEIMETEAS-REQUESTING A VARIANCE
FOR THE PROPERTY LOCATED AT 22 LATHROP STREET R-1
A hearing on this petition was held February 16, 2000 with the following Board Members
present: Nina Cohen, Chairman, Stephen Harris, Michael Ward and Stephen Buczko.
Notice of the hearing was sent to abutters and others and notices of the hearing were
properly published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
The petitioner is requesting a Variance from side setback setback requirements to add
an addition to the rear of the building for the property located at 22 Lathrop Street
located in an R-1 zone.
The Variances, which have been requested, may be granted upon a finding by this
Board that:
1.Special conditions and circumstances exist which especially affect the land, building or
structures involved and which are not generally affecting other lands, buildings and
structures involve.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioners.
3. Desirable relief may be granted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent of the district of the
purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1. Attorney Scott Grover of Salem representing the petitioner stated that by allowing the
petition, the construction when completed would eliminate an eyesore that has
existed for some time.
2. The property is an existing non-conforming use.
3. Two letters in favor of the petition were read into the record. One from Ms. Dorothy
Conley and the other from Ms. Donna Cauley, both abutting neighbors.
4. The petitioner's plans would not be a detriment to the neighborhood.
5. There was no opposition to the proposed addition.

On the basis of the above findings of fact, and on, the evidence presented at the
hearing, the Zoning Board of Appeal voted unanimously, 4—0 to grant the variances
requested, subject to the following conditions;
1. Petitioner shall comply with all city and state statures ordinances, codes and codes
regulations.
2. All construction shall be done as per the plans and dimensions submitted and
approved by the Building Inspector.
3. All requirements of the Salem Fire Department relative to smoke and fire safety
shall be strictly adhered to. ti
4. Petitioner shall obtain a building permit prior to beginning any construction. f:,.v

THE CITY CLERK
Appeal from this decision, if any, shall be made pursuant to Section 17 of the
Massachusetts General Laws Chapter 40A, and shall be filed within 20 days after the
date of filing of this decision in the office of the City Clerk. Pursuant to
Massachusetts General Laws Chapter 40A, Section 11. The Variance or Special
Permit granted herein shall not take effect until a copy of the decision bearing the
certificate of the City Clerk that 20 days have elapsed and no appeal has been filed,
or that, if such appeal has been filed, that is has been dismissed or denied is
recorded in the South Essex Registry of Deeds and indexed under the name of the
owner of record or is recorded and noted on the owner's Certificate of Title.

Upon receiving complaints from concerned neighbors, pertaining to people coming and
going in the home at 22 Lathrop Street. I made an inspection of the property on
September 14, 1999 and found signs of this to be true. In further inspection I then found
this structure to be an unsafe structure. Under Massachusetts Building Code 121 and
121.5, the Building Department of Salem has ordered the building boarded up. The
building as been deemed dangerous and unsafe.
If you feel aggrieved by this order, you can appeal to the BBRS, State Building Code
Appeal Board. Failure to respond to this office within fifteen (15) days will result in
legal action being taken against you.

conducted an inspection of your property and found the following violation:
1 . 780 CMR 103 .0, Building not maintained in a safe, operable and sanitary
conditions.
2. 780 CMR 121 .0, Foundation in unsafe condition.
Please notify this department within fifteen (15) days upon receipt of
this letter, to inform us as to what course of action you will take to rectify
these violations.
Failure to do so will result in legal action being taken against you in
Salem District Court.

Dear Mr. Goggin,
We have been in Maine, therefore did not rec .lve
your letter of September 7, 1998, until today. Sorry
for the delay answering .
We had tried constantly to get Mr . Szybiak to take
care of his obligation regarding above property as we
live in Florida . WE wrote him many times regarding his
non-payment of rent and the condition of the property as
relayed to us . Our letters sent him, "return receipt
requested" were returned to us unclaimed . He had no phone .
We are just as disgusted as the neighbors with the
condition of the property. We have taken Mr . Szybiak to
court now for the 3rd time . After the first two , he
agreed to live up to his obligations including paying his
rent. We , foolishlyb believed him.
Now, in September , he was issued a summons to appear
in court , owing over $4000 in rent and the court has issued
an eviction notice to him. He did not appear in court . He
is supposed to but of the house by October 5th.
I hope to be in the area by the 18th of this month
and hope he will have vacated. Also, I hope he takes care
of the rubbish around the house but 1 guess that ' s wishful
thinking .
When I can get into the house (have no key) I will
get someone to see what has to be done to improve the
property .
