Because you expressed concern about our view of your backyard at the Board of Appeals Hearing , we would be willing to increase the height of the back fence by an additional foot ( raising it from its ' present height of five ( 5) feet to a legal limit of six (6) feet) in an effort to maximize privacy. Of course, this addition would be built at our personal expense. Please be advised that at its meeting of December 4 , 1991 , the Salem Historical Commission reviewed and approved an application for a Certificate of Non-Applicability for the construction of a deck at this address . The Certificate was issued on the basis that the proposed deck would not be visible from any public way. No further review by the Salem Historical Commission will be required for the deck unless a decision of the Board of Appeal will result in a change from what the Commission has approved. If this change will render the deck visible from any public way, the applicant will be required to apply for a Certificate of Appropriateness in order for the Commission to review the deck design, color and materials .
