Dear Mr. & Firs. Kelley:
Janice and I are very concerned with your reaction to our
wish to add a deck to our backyard . Because you expressed
concern about our view of your backyard at the Board of Appeals
Hearing , we would be willing to increase the height of the back
fence by an additional foot ( raising it from its ' present height
of five ( 5) feet to a legal limit of six (6) feet) in an effort
to maximize privacy. Of course, this addition would be built at
our personal expense.
Even though we have yet to hear from you , please be assured
that we are still interested in meeting with you in order to
arrive at a mutually satisfactory solution.

DECISION ON THE PETITION OF DR. JANICE LEBEL FOR A
VARIANCE AT 8 CHESTNUT ST. (R-2 )
A hearing on this petition was held December 16, 1991 with
the following Board Members present: Richard Bencal ,
Chairman; Richard Febonio, Francis Grealish, Jr. , Edward
Luzinski and Mary Jane Stirgwolt. Notice of the hearing
was sent to abutters and others and .notices of the hearing
were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
The Board of Appeal , after hearing evidence and at the
request of the petitioner, voted unanimously, 5-0, to grant
leave to withdraw this petition for a Variance from rear
and side setbacksd to allow construction of a deck.
GRANTED LEAVE TO WITHDRAW WITHOUT PREJUDICE

Dear Chairman Bencal :
The Salem Historical Commission is in receipt of your agenda
for December 16 , 1991 of which a petition will be heard for 8
Chestnut Street which is located within the McIntyre Historic
District. Please be advised that at its meeting of December 4 ,
1991 , the Salem Historical Commission reviewed and approved an
application for a Certificate of Non-Applicability for the
construction of a deck at this address .
The Certificate was issued on the basis that the proposed deck
would not be visible from any public way. No further review by the
Salem Historical Commission will be required for the deck unless a
decision of the Board of Appeal will result in a change from what
the Commission has approved. If this change will render the deck
visible from any public way, the applicant will be required to
apply for a Certificate of Appropriateness in order for the
Commission to review the deck design, color and materials .

The Salem Fire Department has no objection to the granting of a Special Permit and/or
Variance to allaa: construction of a deck.
subject to the following conditions:
1- This property (ka2*ft6) (is in) compliance with the provisions of the Massachusetts
General Laws, Chapter 148, Section 26E, relative to the installation of automatic
smoke detectors.
2- Plans for the proposed construction are to be presented to the Salem Fire Prevention
Bureau for approval prior to the issuance of a building permit.
3- The proposed construction shall conform to all applicable provisions of the Massa-
chusetts State Building Code, the Salem Fire Prevention Code, 527CMR(Code of Massa-
chuestts Regulations) , the Salem City Ordinances, and Massachusetts General Laws
relative to fire and public safety.
4- The applicant and/or contractor shall arrange for an inspection by the Salem Fire
Prevention Bureau upon conpletion of the work.
