The overall condition of the house is poor. The building code problems are as follows: 780 CMR (Building Code) 1. Section 103 — Failure to maintain structure. a Front and rear porches in bad condition b. Long term roof leaking c. Soffitts and eaves open to the weather d. Foundation failing in several locations e. Building exterior wall showing obvious signs of deflection f .Two hot water heaters and one furnace installed without proper permits or inspections. Most of the items require immediate attention, You are directed to within 24 hours to secure the services of a licensed gas fitter to pull a permit and make safe all of the gas devices in the house both in the basement and in the two units. You are directed to hire within 15 days a competent structural engineer to survey the structural deficiencies and to provide this department with a report. Within 30 days you are directed to have a licensed contractor to make the repairs or if the Engineers report deems necessary, remove the structure. If you feel you are aggrieved by this order, your appeal is to the Board of Regulations and Standards in Boston. Failure to comply with theses orders will result in a complaint being filed in Salem District Court. The purpose of this site visit was to observe the existing conditions of the exterior fieldstone foundation wall at the middle left comer of the wall. Masonry repairs are required but currently there appears to be no imminent hazard. This judgment is based solely on visual observations. No foundation soils exploration has been performed,no materials testing undertaken,no finishes were removed to expose hidden structure, and no calculations have been performed to determine if the foundation of the structure complies with past or present building codes. As you would remember I spoke to about repair work at 14 Lathrop St., even the contractor Mr. Bobby Harrington had called your office. To renovate the building I had told the Second floor Tenant i.e. Carol &Ellen Lappas to vacate the unit where they have lived for past six years. They informed me that they were looking for an apartment but were unable to find a suitable apartment and would be moving out soon. After waiting over six months I gave them a 30-day notice to quit in May 2004. Court hearing date for this eviction was scheduled for July 27°i 2004. As soon as the tenant moves each and all the noticed violations will be rectified. The two new furnaces were installed by Keyspan on the second floor and Dash Plumbing in the basement, I have been in touch with both who assured me that all necessary permits and inspection is being scheduled as soon as they get with the inspector this week. Please be assured I am more eager to renovate the apartment and the building, that is why I am in the process of moving the tenants on the second floor out. You did not cause the violations and they can be repaired while you continue to live in the building. C. You are prepared to pay any portion of the rent uito court if a judge orders you to pay it. Giardi received a letter of request by the City of Salem Building department to conduct an electrical inspection in regard to electrical safety,after numerous attempts were made by your tenants to contact you for a remedy to their concerns. Upon my investigation, I found the following: 1. Front hallway entryway light was all rusty from water leaking into it & needed a shield for the light bulb. 2. Excessive use of extension cords as they were draped over door openings, because of inadequate receptacles being available. 3. A junction box with exposed romex cable leading into the kitchen area is subject to mechanical damage because of the foot traffic that has to pass by the entry leading into the kitchen. 4. The bathroom fan was not working , water was also leaking from it. The fan was improperly wired. 5. Their was exposed romex cable running along the inside of a kitchen cabinet which was installed improperly as well. 6. A receptacle in the bedroom has to be replaced, it was worn to the point of making poor to no contact at all. 7. A receptacle in the living room behind the couch, the wiring was damaged. The outlet shall be removed & rewired. 8. A light switch is also faulty and shall be replaced in the living room. 9. The hot water tank is wired improperly with romex cable unsecured with an open junction box, open to a persons touch. 10.3`d floor hallway, romex cable was exposed going to a light fixture. A light switch was also broken. 11.3`d floor hallway light fixture was operating off an extension cord. As you can see there are numerous safety violations, not to mention articles 110 Requirements for electrical installations, 300 wiring methods, In the Massachusetts & national electrical codes. Dear Mr. Bahal please employ a licensed electrician to correct the violations listed above within seven days upon receipt of this letter. A permit must be filed with the city of Salem as well.
