The Stop Work Order is in place until a licensed contractor pulls a permit.

Dear Mr. Bahal:
On Wednesday, July 212004, I was asked by the Health Department to accompany them
on an inspection of your above-mentioned property, Fire Inspector Donald Weston and
Health Inspector David Greenbaum were present.
The overall condition of the house is poor. The building code problems are as follows:
780 CMR (Building Code)
1. Section 103 — Failure to maintain structure.
a Front and rear porches in bad condition
b. Long term roof leaking
c. Soffitts and eaves open to the weather
d. Foundation failing in several locations
e. Building exterior wall showing obvious signs of deflection
f .Two hot water heaters and one furnace installed without proper permits or
inspections.
Most of the items require immediate attention,
You are directed to within 24 hours to secure the services of a licensed gas fitter to pull a
permit and make safe all of the gas devices in the house both in the basement and in the
two units.
You are directed to hire within 15 days a competent structural engineer to survey the
structural deficiencies and to provide this department with a report.
Within 30 days you are directed to have a licensed contractor to make the repairs or if the
Engineers report deems necessary, remove the structure.
If you feel you are aggrieved by this order, your appeal is to the Board of Regulations and
Standards in Boston.
Failure to comply with theses orders will result in a complaint being filed in Salem
District Court.

Upon your request we visited your property at 14 Lathrop Street in Salem, MA. The purpose of
this site visit was to observe the existing conditions of the exterior fieldstone foundation wall at
the middle left comer of the wall.
Masonry repairs are required but currently there appears to be no imminent hazard. This
judgment is based solely on visual observations. No foundation soils exploration has been
performed,no materials testing undertaken,no finishes were removed to expose hidden
structure, and no calculations have been performed to determine if the foundation of the structure
complies with past or present building codes.

Dear Mr., St.Pierre,
I am in receipt of you letter dated July 22 nd 2004.
As you would remember I spoke to about repair work at 14 Lathrop St., even the
contractor Mr. Bobby Harrington had called your office. To renovate the building I had told the
Second floor Tenant i.e. Carol &Ellen Lappas to vacate the unit where they have lived for past
six years. They informed me that they were looking for an apartment but were unable to find a
suitable apartment and would be moving out soon. After waiting over six months I gave them a
30-day notice to quit in May 2004. Court hearing date for this eviction was scheduled for July
27°i 2004.
As soon as the tenant moves each and all the noticed violations will be rectified.
The two new furnaces were installed by Keyspan on the second floor and Dash Plumbing
in the basement, I have been in touch with both who assured me that all necessary permits and
inspection is being scheduled as soon as they get with the inspector this week.
Please be assured I am more eager to renovate the apartment and the building, that is why
I am in the process of moving the tenants on the second floor out.

101.4 Referenced Standards: Where differences occur between provisions of this
code and referenced standards, the provisions of this code shall apply.
SECTION 102.0 ORDINARY REPAIRS
102.1 General: Except as provided in Section 113.1, a permit shall not be required
for ordinary repairs to buildings and structures.
SECTION 103.0 INSTALLATION OF SERVICE EQUIPMENT
103.1 General: When the installation, extension, alteration or repair of an
elevator, moving stairway, mechanical equipment, refrigeration, air conditioning or
ventilating apparatus, plumbing, gas piping, electric wiring, heating system or any
other equipment is specifically controlled by the provisions of this code or the
approved rules, it shall be unlawful to use such equipment until a certificate of
approval has been issued therefor by the building official or other agency having
jurisdiction.
SECTION 104.0 MAINTENANCE
104.1 General: All buildings and structures and all parts thereof, both existing and
new, shall be maintained in a safe and sanitary condition. All service equipment,
means of egress, devices and safeguards which are required by this code in a
building or structure, or which were required by a previous statute in a building or
structure, when erected, altered or repaired, shall be maintained in good working
order.
104.2 Owner responsibility: The owner, as defined in Article 2, shall be
responsible for the safe and sanitary maintenance of the building or structure and
its exitway facilities at all times, unless otherwise specifically provided in this code.

Legal Remedies for Tenants of
Residential Housing
The following Is a brief summary of some of the legal remedies tenants may use In order to get housing code violations
corrected:
1. Rent V ithholdine (Massachusetts General laws,Chapter 239,section 8A): If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if:
A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in-
your rent
B. You did not cause the violations and they can be repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rent uito court if a judge orders you to pay it. (For this,it is best to put the,
rent money aside in a safe place.)

The following Is a brief summary of some of the legal remedies tenants may use In order to get housing code violations
corrected:
1. Rent Withboldine(Massachusetts General Laws,Chapter 239,section 8A):If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if:
A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in
yourrent.
B. You did not cause the violations and they can be repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rent into court if a judge orders you to pay it.(For this,it is best to put the
rent money aside in a safe place.)

Based on the report from the Salem Health Department relative to a property
owned by you and listed above, the following was noted and must be remedied
immediately:
1- The installation of automatic smoke detectors in the rear stairwell both
on the first and second floor landings. (Battery type)
2- Repair or replace the automatic smoke detector in the bedroom on the first
floor apartment.
3- Install an automatic smoke detector in the living room outside the children's
bedroom in the first floor apartment.
4- First floor rear exit door to be replaced or repaired.This exterior door is
off its hingers . This door cannot be freely and easily opened.
5- The front exit door from the first floor apartment must be repaired or re-
placed. This door has a two cylinder type lock. This type of lock is not
allowed. This door is also barricaded by a 2X4.
6- The following will be brought to the attention of the building department;
(a)- A ladder located on the outside of the building is being used as a
fire escape from the third floor. This ladder cannot be reached from
the third floor window or windows .
7- There is evidence in the backyard of activities relative to automobiles being
repaired on a regular basis. Repairs cannot be conducted without a permit from
the fire department.
8- Unregistered vehilcles are to be removed from the property.
9- The following will be brought to the attention of the health department. There
is a large accumulation of dog feces in the backyard. This situation is so bad
that you can' t walk in the yard without stepping on the excrements.

Upon your request we visited your property at 14 Lathrop Street in Salem,MA, The purpose of
this site visit was to observe the existing conditions of the exterior fieldstone foundation wall at
the middle left corner of the wall. An initial follow-up memo was issued on I I.August.2004
regarding the area that was brought to our attention.
After submitting this report it was forwarded to the Salem Building Inspector,Mr. Thomas St.
Pierre. Mr. St.Pierre contacted our office upon receipt of the initial memo. After W. St. Pierre
made it apparent that there are several other issues that you did not bring to our attention and
were therefore not investigated during our site visit.
Because of this,we recommend that a complete inspection be made of the entire property with
W access to all units and all levels including attic space and porches. Please contact our office

On Friday, 17.September2004 we visited your property at 14 Lathrop Street in Salem, MA upon your
request The purpose of this elle visit was to perform a follow-up visit since our report dated
03.September.2004. Currently we aro scheduled for a follow-up visit on Friday,24.September.2004.
Observations&Recommendations:
To date, signifieent mpalm have been made to the existing structure. The following repairs that have
been made to date and/ongderm recommendations are noted below.
Foundatton/13asemsnt
• Currently the foundation has undergone substantial repairs including reconstruction of the area that
had deteriorated and a thorough repointing Job at the front right section of the building. This solution
Is short term and the foundation should be monitored for any changes In Its condition. Our omglnal
report suggested complete removal and replacement or reinforcing with a now gunite wall on the
Interior of the building. Site conditions would make a removal and replacement procedure
prohibitive, and the gunite would be prohibitive schedule Was. We recommend that the reinforced
gunite well on the inferior be Implemented within (1) year and monitored for any movement or
changes until thls solulfon is/mplementad. Please note that thla type of repair Must be property
detailed forconsbuction. We recommendedetaft theta swale be created thatmoves water away
from the bv0ding and the adjacent building, and subsequently to the ftgnt and merof the lot. This
wNdecrease the hydrostafic pressure acting on the wall. We expect the grading to be complete by
Off next tollow-up visit scheduled fcr this friday.
• All wood posts have been replaced with ooncrete-filled steel columns, We recommended that
Improved cap and base plates be installed to increase Me bearing area and Vie base plates set on a
bed of level grout. Although the basement surfaoe is not level, d does not appear to show signs of
settlement at the column locations. The former fooling conditions are assumed to be suf olent
based on hlstorlcal performance. We expect fheao framing items to be complete byournext follow
up visit scheduled for this Friday.
Several of the first floor joists do not have positive support, This was communicated to the
contractor and hanger options reviewed, this repesrN is expected to be complete by our Wow-up
visit scheduled for this Friday.

• The area that was originally noted on our very first site visit Is in need of masonry repairs. A
qualified mason should reconstruct this section of foundation way before temperatures below
f easing are encountered.
• A section of foundation at the front right of the building is out of plumb at the center due to the
foundation bulging Inward. This section Of wall should.be removed and replaced with a new
rwonshucted CMU or Cip concrete wall or reinforced with a ralnkmed gunite wall on the Intedon
This type of repair must be property detailed for consbuctlan.
• Posts at supporting the first floor framing Consist of wood logs,and several have rotted post bases
and/or are out of plumb. These posts should be removed andreplaced with standard steel tube or
plea columns with appropriate cap and base plates, and eppropa ste concrete footings.
• Several of the first floor joists do not have positive support These joists are supported by trailed or
notched connections and are either showing separation from the main beams or spliting at the
notch kxatlons. These Mats should be re-supported with Simpson type hangers. A plumber and
elecMclan volt need to relocate piping and wiring before any Naming modlflcaWns can take place.
e The condition of the slits is currently unknown. A qualyted conbaetor fivmft exteWarshould hn*er
lmrestigats this during repairs noted below. This should be done byramoving exter/or siding and
sheathing to fully investigate this condlilon.

floor investigation was also limited by an overwhelming fecal odor that made extended periods of
time in the epees unbearable.

" The exterior of the building shows obvious signs of recdnq towards the right of the buRdft. The
exact cause and solution to this problem would require a gut-rehab of the'endr a structure. We

Dear Mr. Bahal,
Please be advised, City Electrician John J. Giardi received
a letter of request by the City of Salem Building department to conduct an
electrical inspection in regard to electrical safety,after numerous attempts
were made by your tenants to contact you for a remedy to their concerns.
Upon my investigation, I found the following:
1. Front hallway entryway light was all rusty from water leaking into it
& needed a shield for the light bulb.
2. Excessive use of extension cords as they were draped over door
openings, because of inadequate receptacles being available.
3. A junction box with exposed romex cable leading into the kitchen
area is subject to mechanical damage because of the foot traffic that
has to pass by the entry leading into the kitchen.
4. The bathroom fan was not working , water was also leaking from it.
The fan was improperly wired.
5. Their was exposed romex cable running along the inside of a kitchen
cabinet which was installed improperly as well.
6. A receptacle in the bedroom has to be replaced, it was worn to the
point of making poor to no contact at all.
7. A receptacle in the living room behind the couch, the wiring was
damaged. The outlet shall be removed & rewired.
8. A light switch is also faulty and shall be replaced in the living room.
9. The hot water tank is wired improperly with romex cable unsecured
with an open junction box, open to a persons touch.
10.3`d floor hallway, romex cable was exposed going to a light fixture. A
light switch was also broken.
11.3`d floor hallway light fixture was operating off an extension cord.
As you can see there are numerous safety violations, not to mention
articles 110 Requirements for electrical installations, 300 wiring methods, In
the Massachusetts & national electrical codes. Dear Mr. Bahal please
employ a licensed electrician to correct the violations listed above within
seven days upon receipt of this letter. A permit must be filed with the city of
Salem as well. Failure to comply will result in further action from this office.
