Dear Ms. Stein:
Pursuant to M.G.L. Ch_40, See. 10, I am writing to request that the Variances granted by the
Board of Appeals with respect to the above referenced property be extended for a period of six '
months. The applicant has been delayed in exercising the rights granted by the Board due to
processing paperwork relating to the now completed environmental cleanup at the property.
1 would appreciate it if my application could be considered by the Board at its meeting on
October 20,2010.
Thank you for your consideration of this request.
Very truly yours,

Subject: 142 Canal St. Issue before Tonight's ZBA Meeting
Danielle,
I cannot attend tonight's ZBA meeting.
I am concerned, however, about the issue before the Board to issue a variance to the owner of
142 Canal St. to not have to meet the specific parking requirements that currently apply to the
site. Additionally, I am concerned about the number of times that the owners have sought
continuance on this issue. I ask that the Board not grant the applicant a variance. Further, if the
owners seek a continuance on this issue, I recommend that they be asked to withdraw the
variance application until they have a reason to seek a variance, which I do not believe exists at
this time.

Subject: RE: 142 Canal
Tom, I do not get to involved with the Planning Board,s decisions or site plans. The issue last night was
that the uses currently on the site meet the zoning requirements for the square footages of each space.
Enterprise came in with a proposed use that would need 15 or so spaces. This could not be
accommodated with the current number of spaces existing in the redeveloped area of the site. The
developer needed a variance from the number of spaces required for the Dollar store building to
accommodate the spaces Enterprise was requesting. Yes Enterprise could park in the rear yard ,but that
was not what they were requesting.Seemed pretty straight forward but it sure got convoluted by the Board
and the Councilor. Tom

Tom,
Can you help me understand how the planning board's decision and approved plan limit Family Dollar's
parking to the area near it and impede Enterprise's fulfillment of its required spaces? I only see parking
mentioned in sections 11 b and 18b of the decision, and it isn't clear to me how either section allocates the
spaces in front of Family Dollar to only Family Dollar or prevents the spaces in the rear lot from counting
toward any business's parking requirement.
