DECISION OF THE PETITION OF JAMES G. CROSBY, TRUSTEE REQUESTING A
VARIANCE FOR THE PROPERTY LOCATED AT 111 AND 119-125 CANAL STREET

A hearing on this petition was held August 23, 2000 with the following Board Members
present: Nina Cohen, Chairman, Richard Dionne, Stephen Buczko, Stephen Harris and
James Hacker. Notice of the hearing was sent to abutters and others and notices of the
hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
The petitioner is requesting Variances for two (2) buildings on one lot and an existing
rear yard setback violation for the building at 119-125 Canal Street and a Variance from
relief for parking for the property located at 111 and 119-125 Canal Street b-4/R-2.
The Variances, which have been requested, may be granted upon a finding by this
Board that:
a. Special conditions and circumstances exist which especially affect the land, building
or structure involved and which are not generally affecting other lands, buildings and
structure involve.
b. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioners.
c. Desirable relief may be granted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent of the district of the
purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1. Attorney George Atkins represented the petitioner.
2. Plans were submitted showing the many improvements and expansions to the
property.
3. Letters of support were presented from neighbors.
4. Councillor Joe O'Keefe, Tom Furey, Leonard O'Leary and Kim Driscoll all spoke in
support of the petition.

5. There was no opposition to the plan and all questions were answered to their
satisfaction.
On the basis of the above findings of fact, and on, the evidence presented at the
hearing, the Zoning Board of Appeal concludes as follows
1. Special conditions exist which especially affect the subject property but not the
district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship to the petitioner.
3. Desirable relief can be granted without substantial detriment to the public good and
Without nullifying or substantially derogating from the intent of the district or the
purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted 5-0, to grant the Variances requested,
subject to the following conditions;
1. Petitioner shall comply with all city and state stature ordinances, codes and codes
regulations.
2. All construction shall be done as per the plans and dimensions submitted and
approved by the Building Inspector.
3. Petitioner shall obtain a building permit prior to beginning any construction.
4. All requirements of the Salem Fire Department relative to smoke and fire safety shall
be strictly adhered to.
5. Exterior finishes of the new construction shall be in harmony with the existing
structure.
6. A Certificate of Occupancy shall be obtained.
7. A Certificate of Inspection shall be obtained.
S. Petitioner is to obtain approval from any City Board or Commission having
jurisdiction including, but not limited to, the Planning Board.
9. Parking spaces for 152 vehicles.

THE CITY CLERK
Appeal from this decision, if any, shall be made pursuant to Section 17 of the
Massachusetts General Laws Chapter 40A, and shall be filed within 20 days after the
date of filing of this decision in the office of the City Clerk. Pursuant to
Massachusetts General Laws Chapter 40A, Section 11. The Variance or Special
Permit granted herein shall not take effect until a copy of the decision bearing the .
certificate of the City Clerk that 20 days have elapsed and no appeal has been filed,
or that, if such appeal has been filed, that is has been dismissed or denied is
recorded in the South Essex Registry of Deeds and indexed under the name of the
owner of record or is recorded and noted on the owner's Certificate of Title.

I've been a regular customer at Crosby's market on Canal street and I've been informed
recently about mr. Crosby's decision to remodel and expand the store.
I am writing this letter to ask you to support his decision which will benefit the city and
the customers.
Anytime in the past I had any requests or concerns, about different issues, the store
manager Katerina Thompson and other Crosby employees would resolve them quickly.
It would be good to have the building improved to macth the attitude of the stuff.
Please give this issue your attention and support .

I've been a Salem resident for 15 years and I've always shopped at Crosby's Market.
I'm well aware of Mr. Crosby intentions to expand and improve his Canal street store and
I support him one hundred percent. His current facility can most definitely use the
upgrade which will be beneficial to the Salem residents by allowing them to find the
variety and specific items they need.
Mr. Crosby and his staff have always been responsive to any request and or needs that
I've had over the years.
In conclusion Mr. Crosby has done much for the community and this will allow him to
provide a better shopping experience for the community.

Dear Ms. Cohen:
I am writing in support of the petition submitted by Jim Crosby, of Crosby's
Marketplace, seeking relief from the zoning ordinance in order to expand the Canal Street
facility.
I have had the opportunity to meet with Jim Crosby to discuss the proposed
project and review the expansion plans. I believe the proposed expansion will be an asset
to the entire City and will be of particular benefit to the South Salem community. The
petition seeks minimal relief from the zoning ordinance and will enable this long standing
business to enhance the services it provides to Salem residents. I am confident that any
concerns relative to this proposed project can be addressed within a Variance decision
and/or the Planning Board Site Plan Review process.
I wholeheartedly endorse this project which not only will serve to enhance the
Canal Street entrance corridor, but will also help to sustain the long term viability of
Crosby's Marketplace in Salem.

Good-day:
I am aware of the plans to expand and improve upon Crosby's market located on Canal
Street in Salem. I am lending my wholehearted endorsement and support to this effort by
means of this letter.
I have been a resident of Salem for almost 20 years, and currently live in South Salem
close to where this store is located. I trade exclusively at Crosby's, and regularly shop at
the Canal Street Store. I cannot say enough positive things about Katarina Thompson-
who serves as the store manager. As a regular customer, she knows me and if I have a
rare complaint I know that she will address it quickly and professionally. I know most of
the folks who work at the store, and find them all to be friendly, courteous and pleasant.
Indeed I am a very satisfied customer. Satisfaction with e customer service combined
with good product and convenience of location, keeps me a regular at that store.
However, through time, it is apparent that the facility and the equipment could use some
serious attention. Even today, there is a refrigeration unit which is down and that limits
the stock which can be used and therefore the choice of product. I have noticed many
times that the freezers have been reloaded due to malfunctions; the deli is limited
compared to other Crosby's and the selection of fresh seafood is less than I would like. It
would be a boon to the customers as well as to the business to have these improvements
become reality. It is not lost on me that the other neighborhood Crosby's have `nicer'
stores. It is heartening to know that now it is our turn.
The Canal Street store is convenient and accessible to the residents of this part of the city.
There are many of us who eschew the mega food stores and firmly believe in supporting
this local business. I urge your most serious consideration and support to Mr. Crosby's
efforts with improving this property ,his business and the fine community service he
provides. Thank you
