DECISION ON THE PETITION OF RAYMOND MCDAID FOR A SPECIAL PEAP CLERK. SAL EH. MASS.
FOR 4 BURKE ST. (R-1 )
A hearing on this petition was held November 23, 1987 with the following Board
Members present: James Hacker, Chairman; Messrs. , Fleming, Strout, Associated
Members Dore and Labrecque. Notice of the hearing was sent to abutters and others
and notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property, is requesting a SpecialPermit to extend non-
confroming setbacks and density to allow construction of a two story addition in
this R-1 district.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance,
the Board of Appeal may, in accordance with the procedure and conditions set
forth in Section VIII F and IX D, grant Special Permits for alterations and
reconstruction of nonconforming structures, and for changes, enlargement,
extension or expansion of nonconforming lots, land, structures, and uses,
provided, however, that such change, extension, enlargement or expansion shall
not be substantially more detrimental than the existing nonconforming use to
the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the grant of the Special Permit will promote the public health,
safety, convenience and welfare of the City's inhabitants.
The Board of Appeal, after careful consideration of the evidence presented at th=
hearing, and after viewing the plans, makes the following findings of fact:
1 . Neighbors submitted a petition signed by six individuals and
families in favor of the proposal;
2. Councillor Leonard O'Leary spoke in favor of the petition;
3. There was no opposition to the petition;
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . The proposed addition will be in harmony with the neighborhood and
will promote the convenience and welfare of the City's inhabitants;
2. The Special Permit requested can be granted without substantial detriment
to the public good and without nullifying or substantially derogating
from the intent of the district or the purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the relief
requested subject to the following termis and conditions:
1 . All requirements of the Salem Fire Prevention Bureau must be
adhered to; --
2. A Building Permit must be obtained;
3. Exterior finish must conform with existing dwelling;
4. A Certificate of Occupancy.

On July 23, 1987 in accordance with Chapter 40A, Section 16, the
Planning Board reviewed the petition of Mr. Judith Gianareles, regarding
her petition for a variance to allow the construction of a 2 story
building at 165 Boston Street, which was denied by the Board of Appeals
on June 17, 1987.
As required by State law for this petition to be resubmitted to the
Board of Appeal within 2 years of unfavorable action by the Board of
Appeal, the Planning Board agrees that specific and material changes

Piemonte and Associate Member Bencal. Notices of the hearing were sent to
abutters and others and notices of the hearing were properly published in
accordance with Massachusetts General Laws Chapter 40A.
Petitioner is requesting a Special Permit to allow the sale of used automobiles
in this B-2 district.
The provision of the Salem Zoning Ordinance which is applicable to this request

3. The business will be owner operated.
On the basis of the above findings of fact and on the evidence presented at th
public hearing, the Board of Appeal finds that:

1 . The proposed use of the property will not be substantially more
detrimental to the neighborhood than the existing use;
2. The proposed use of the property is in harmony with- the Salem
Zoning Ordinance.

FORA SPECIAL PERMIT FOR 165 BOSTON ST. , SALEM
Accordingly, the Zoning Board of Appeal approved the granting of a Special
Permit. The Board voted as follows: Messrs. Hacker, Luzinski, Piemonte and
Bencal voted in favor of the Special Permit. Mr. Hopper voted to deny.
Therefore, the Special Permit is hereby granted in accordance with the followir
terms and conditions:
1 . No flamables are to be stored on site;
2. No repairs, other than minor emergency repairs, are to be made on the
premises;
3. Any lighting is to placed so as to face inward and away from residence--
4. There is to be no parking of any vehicles on the public way;
5. There will be no more that ten (10) vehicles on the premises;
6. A Certificate of Occupancy and Use must be obtained;
7. Premises must be in compliance with all Fire Codes;
8. Subject to the approval of the Licensing Board, and subject to any
restrictions they may impose.
