Statements of fact: 1. Lee Dearborn,petitioner,presents the petition. 2. In the petition date-stamped January 24, 2017, the petitioner requested a seeks a Special Permit per 3.3.5 Nonconforming Single and Two-Family Residential Structures of the Salem Zoning Ordinance to reconstruct, extend, or structurally change the existing structure and a Variance per Sec. 5.1.8 Tabk of Required Parking Spaces to allow parking within five (5) feet of the street line. 3.+ The property is located within an R-2 Zoning District. 4. The existing non-conforming structure is a two (2) family dwelling. The petitioner is proposing to f change the two-family home into two (2) townhome style units and expand the rear of the property. f 5. The petitioner is proposing to construct a 12'x 18'addition onto an existing non-conforming structure that is within the side yard setback. The existing structure is currently within 6.7' feet from the required 10' foot setback to provide additional living space. 6. The petitioner is proposing to preserve the existing historical features of the home and use materials that are in keeping with the character of the existing structure. 7. There are currently two (2) existing curbcuts at the property. The petitioner is proposing to use one of the curbcuts and create a parking area within five (5) feet of the street line in lieu of using the second curbcut and existing side yard space for parking,which could be done by right. The petitioner ' requested the variance to preserve the existing historic features of the property including the existing sideyard landscape that serves as the front yard to the orientation of the existing historic structure. Currently, there is a driveway that provides two (2) tandem parking spaces.The petitioner is proposing to carve out a 23'x 18' section of existing front yard space to provide a parking space. 9. The requested relief,if granted,would allow the petitioner to reconstruct, extend, or structurally change the existing structure and allow parking within five (5D feet of the street line. 10. At the public hearing two (2) members of the public spoke in favor of,and none (0) in opposition to, the petition. The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and after thorough review of the petition, including the application narrative and plans, and the Petitioner's presentation and public testimony, makes the following findings that the proposed project meets the provisions of the City of Salem Zoning Ordinance: Findings for Special Permit: The Board finds that the reconstruction, extension or structural changes are not substantially more detrimental that the existing nonconforming structure to the neighborhood. 1. Social, economic and community needs served by the proposal. 2. Traffic flow and safety,including parking and loading is adequate. 3. Adequacy of utilities and other public services will not be negatively impacted. 4. Impacts on the natural environment,including drainage will remain the same. 5. The proposal fits with the character of the neighborhood. 6. Potential fiscal impact,including the impact on City tax base and employment is positive. Findings for Variance: 1. Special conditions and circumstances that especially affect the land, building, or structure involved, generally not affecting other lands, buildings, and structures in the same district as the orientation of the historic building is such that the side yard serves as the front yard. The petitioner is proposing to preserve the look and historic character of this fagade and associated landscaping. 2. Literal enforcement of the provisions of the Ordinance would involve substantial hardship to the applicant. Inserting a driveway into the side yard would be a detriment to the unique historic character of the front entry and associated landscaping. 3. Desirable relief may be granted without substantial detriment to the public good, and without nullifying or substantially derogating from the intent of the district or the purpose of the ordinance. An alternative option would be to create parking along the opposite side yard,which does have ample space, however, I would like to preserve the facade along that side yard, as it is the formal "front" of the home that is seen while driving north on Buffum street, and a driveway would be a detriment to the building and yard,as the vehicles would block the front covered entry. It is also my intention to block the visibility of the vehicle parked in the front yard setback, using a privacy lattice fence,that has already been built, and plantings along the front property line. By allowing for two off street parking spots, that are not tandem,this would allow for the future development of my two-family home to be turned into two town homes,one that my family will inhabit, and the other that I intend to sell,with two separate off street parking spots,while preserving the historical facade of 32 Buffum Street, and the large beautiful yard. Special Permit Request: It is my intention to apply for a special permit to construct an addition onto a non-conforming structure on my home at 32 Buffum Street.This addition is being constructed in order to provide additional living space to the home.The existing building is a two-family building,one unit on the first level and one unit on the second level, and I intend to keep the building as a two family, but convert it into two side-by- side town homes,which will require additional living space.The addition, along with renovations to the existing structure,will enhance and preserve the historical features of the home, adding value to the fabric of the neighborhood.
