Pursuant to a Decision of the Salem Zoning Board of Appeal granted on February 19, 1986 and date stamped March 4, 1986, the property was granted a Special Permit for the nonconforming use, subject to the following conditions: 1. No less than seven (7) non-piggyback parking spaces be provided on the premises; 2. Access to the parking spaces be hottopped; 3. A Certificate of Occupancy be obtained; 4. The premises be owner occupied. The applicant requests that the City of Salem Zoning Board of Appeal allow an amendment of the earlier decision to remove the condition of owner occupancy. The Board of Appeals, after careful consideration of the evidence presented at the public hearing, and after thorough review of the Petition submitted, makes the following findings of fact: 1. Thomas MacDonald, the owner and petitioner, represented himself at the hearing. 2. In a petition date-stamped October 28, 2009, the petitioner requested the removal of the clause from the previously issued Board of Appeals decision requiring owner occupancy for a three-family use. 3. As grounds for his request, Petitioner states that each of the three units in the building is improved for use as a rental apartment, and each unit was so used from the time he purchased the property in 1995 until several years ago, when he R became aware that the property could only legally contain two units if not owner- occupied. In late 2005 the petitioner undertook to improve the parking area to create seven parking spaces. After a delay caused by the nonperformance of a 1 landscaping contractor, he was able to complete the improvements to the parking area, and he provided the Board with photographs of the improved parking area at the hearing on December 16, 2009. 4. Although Petitioner does not occupy the building, he stated that he is a committed landlord with a responsible attitude toward his tenants and toward the neighborhood. He further stated that if the building were used as a two-family, one of the units would be overly large and would be difficult to rent out. 5. Petitioner submitted a petition with 105 signatures of neighborhood residents who supported the use of the building as a non-owner occupied 3 family residence, including both resident and non-resident owners and tenants. Five neighbors also submitted letters in support of the petition. Support letters indicated that the property had been well maintained and that the petitioner was a conscientious landlord who made sincere efforts to address neighborhood concerns. Two residents spoke in support of the petition at the hearing. 6. One neighbor called two sent letters in opposition to the petition, including Ward 6 City Councilor Paul Prevey. Opposition letters stated that the property had not been properly maintained and managed with regard to issues such as parking and snow removal. No one spoke in opposition at the hearing. In consideration of the above, the Salem Board of Appeals voted, four (4) in favor, none (0) opposed, to grant the petitioner's request for an amendment to the March 6, 1986 Decision of the Zoning Board of Appeal, subject to the following terms, conditions, and safeguards: 1. With the exception of the owner occupancy requirement, the terms and conditions of the 1986 special permit are incorporated herein. Where the concerns that often result in this Board requiring owner occupancy for an additional unit, such as adequate parking and property maintenance are not at issue here, amending the special permit as requested by the petitioner is consistent with the guidelines and safeguards of our zoning ordinance. He has worked diligently on solving all problems concerning parking for both tenants and visitors and the tenants currently living in the property have been residing there for quite some time without issue. To those who may object to this proposed change, I feel it is important to weigh the options carefully. Should Mr. McDonald be forced to sell this property we may end up with an even bigger problem on our hands. Who knows who would buy the property and if they would take into consideration the neighbors and our concerns before renting to just anyone. Our house is located diagonally across from 11-13 Bryant Street. I am writing to show my support for Tom McDonald's request to be allowed to make his property a 3 family dwelling. I feel Mr. McDonald has made the necessary updates, repairs and corrections to rectify any past problems there may have been. I voiced concerns in the past and was assured they would be addressed. They have in fact been addressed and corrected above and beyond my expectations. Tom has gone out of his way to be a good fellow property owner and although he does not reside in the property he makes himself known to neighbors and visits the property often. I am aware there are people opposed to allowing this request to be honored and I don't feel they have logical or valid concerns. In fact one major opponent should take a lesson from Mr. McDonald and maintain her property better as it is need of maintenance and clean up. Another opponent has issues with parking and school bus accessibility.This same person has visitors that park on the street and obstruct the road. She often fails to realize that there are other people that live on the street that have a right to park on and utilize the road. As I will be working on that evening, I am respectfully requesting that the following letter be distributed and read during the process. I have owned and lived at 53 Buffum Street in Salem , ma for more than 15 years. In this time, I have shared an abutting yard with the property located at 11 Bryant Street and I am very concerned with the possibility of the house at 11 Bryant Street being limited to a (2) two family residence. If limited to a (2) Two family residence, the house would have one small unit and one very large unit. A unit of this size would require that the space be leased to a large group or student coop. I believe a group of this size could have a negative impact on the quality of life in the neighborhood. As the property owner and closest resident to 11 Bryant Street , I feel that our family will suffer greatly if it is a 2 family only residence. We have an infant daughter with a difficult sleep schedule and cannot tolerate the noise levels that may be associated with such a large group. Until the resent past, 11 Bryant Street has had three small apartments. These smaller units allowed for plenty of parking and promoted a quieter and more civil environment. It must be said that the property at 11 Bryant has always been well maintained. Whether it has had 2 or 3 resident units, the owner has done an excellent job of cleaning and up-dating the property. This is not the case for many of the other multi family homes in the area. The house at 55 Buffum Street also abuts 11 Bryant and 52 Buffum Street is located immediately across the street from our home. These houses appear to be able to operate as legal (3) family residences even thought they are not owner occupied and are in a continuous state of dis-repair. The owner of 55 Buffum Street has been negligent in cleaning yard waste as well as snow removal. The owner has been cited for non removal of snow and would have been fined many more times if the owner of 11 Bryant Street had not graciously removed the snow for him. The residents of 52 Buffum Street continuously leave trash and household waste items in the street and the owner has done nothing to remedy the situation. I believe that the owner of 11 Bryant Street has shown a clear pride of ownership. He takes great interest in the behavior of his tenants and the concerns of his neighbors. Any additional restrictions placed on his property would be grossly unfair to both him and the community at-large. Please feel free to contact me if you have any questions or suggestions. I am writing in opposition to the petition to remove the"owner occupied" clause from the previous zoning board decision.for 11-13 Bryant Street. The Bryant St/Barr St Extension area is one of high density and narrow roadways. Increased density and absentee landlord problems are a major concern for this tight knit neighborhood. To remove this requirement would be a step in the wrong direction and simply add to the problems facing this neighborhood. Also, over the past six months I have received complaints about the owner and their lack of regard for the neighborhood. Additionally, in imposing this requirement the previous Board of Appeal did not feel that such a restriction placed an undue hardship on the property. The failure to do conduct a proper title search and discover this clause, or ignoring it until discovered by outside parties, is also not a hardship that would justify the removal of this clause. Therefore,I would ask that you deny this request and help preserve this neighborhood. I have a personal matter to attend to this evening and am unable to attend to address the Board on 11-13 Bryant Street. The Petitioner, Thomas McDonald, requests relief from the owner-occupied requirement for 11-13 Bryant. I know that this is not the first time that the Petitioner is before the Board on this request. I recall that the last time the matter was before the Board over two years ago, I was in support of the Petitioner because of the improvements he made in connection with the property at that location. He convinced me that parking was would not be an issue since he was providing for it on his property. He also indicated that his property would be very well maintained and that there would not be any negative impact on the neighborhood. After being denied over two years, he comes, yet again, before the Board seeking relief from that restriction. My understanding is that when the Petitioner purchased the property some years ago, he was made aware of that restriction. Despite his awareness of the limitations on this particular property, he continues to seek relief on a matter that appears appropriately settled. It has also come to my attention that there have been issues with managing the property in an unacceptable manner. In particular, snow removal and on street parking have been issues which neighbors recently have raised with me. While I do not have direct knowledge of the specifics of these issues, 1 know that neighbors will be present to address the Board on these items.
