A hearing on this petition was held on May 19, 2004 with the following Board Members
present: Nina Cohen, Chairman, Richard Dionne , Stephen Harris, Joseph Barbeau and
Bonnie Belair. Notice of the hearing was sent to abutters and others and notices of the
hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
Petitioner requests a Special Permit to operate a Dog Day Care Business in a portion of

The provision of the Salem Zoning Ordinance which is
applicable to this request for aSpecial Permit is section

A. Special conditions and circumstances exist which especially affect the land, building
or structure involved and which are not generally affecting other lands, buildings or
stuctures in the same district.
B. Literal enforcement of the provisions of the Zoning Ordinance would involve
Substantial hardship, financial or otherwise, to the petitioner.
C. Desirable relief may be granted without substantial detriment to the public good and
Without nullifying or substantially derogating from the intent of the district or the
purpose of the ordinance.
The Board of Appeal, after careful consideration of the evidence presented, and after

RE: 8-10 Broadway Fence
Dear President Lovely:
I have reviewed this matter with Building Inspector Peter Strout. It appears that
the fence has been erected properly along boundary of said property. I did
review the deed of this parcel and noticed only a City of Salem sewer easement
across the parcel. Certainly, if the MBTA has some sort of access right across
the parcel, they have every right to purse same. No one from the MBTA has
contacted this office to address this issue.
As always, do not hesitate to contact me with any questions.
Very best regards,
AhhD- Keenan,
olicitor

Re: 8-10 Broadway
Dear Attorney Keenan:
Please be advised that I have been contacted by abutting neighbors of the above-
captioned property. These neighbors are concerned about a fence that has been erected
across what appears to be at the end of Ocean Avenue, thereby blocking the MBTA's
access to the railroad tracks at this location. I contacted the Building Inspector regarding
same, and it is his opinion that this fence is erected properly on the property of 8-10
Broadway and is thereby allowed. I communicated this to the neighbors, however, doubt
remains as to the legality of the fence.
Therefore, would you kindly research and issue your opinion as to the legality of
the fence being erected in this location.
Your assistance in this regard is greatly appreciated. Should you require any
further information, please do not hesitate to contact me.
Very,truly yours,
oan B. Lovely
