(R-2) A hearing on this petition was held July 23, 1986 with the following Board Members present: James Hacker, Chairman; MessrAU„ B�ncca,j6IRK1% Luzinski and Strout. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem E414f News in accordance with Massachusetts General Laws Chapter 40A. CITYCilc.­ .%,"�H,HASS. The petitioner, owner of the property, is requesting a Variance to allow a Carriage House to be convert to a single family dwelling in this R-2 district. The Variance which has been requested may be granted upon a finding by the Board that: a. special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district; b. literal enforcement of the provisions of the Zoning Ordinance would in- volve substantial hardship, finanical or otherwise, to petition; and c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented and after viewing the plans, makes the following findings of fact: 1 . There is sufficient parking on the premises; 2. Carriage House could be used for garage and/or storage as in the past; 3. Building is currently not in compliance as it is; 4. No hardship. On the basis of the above findings of fact, and on the evidence presented, the Board of Appeal concludes as follows: 1 . Literal enforcement of the provisions of the Zoning Ordinance would not involve substantial hardship to the petitioner; 2. The relief requested cannot be granted without substantial detriment to the public good or without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. w � DECISION ON THE PETITION OF ROBERT KOBI7SZEWSKI FOR A VARIANCE FOR 55 BROAD ST. , SALEM page two Therefore, the Zoning Board of Appeal voted three in favor of granting the requested Variance (Messrs. , Fleming, Luzinski & Strout) ; one opposed to granting the Variance (Mr. Hacker) and one voting present (Mr. Bencal) .
