This is an appeal from a decision by the Zoning Board of Appeal of the City of Salem, Massachusetts, (hereinafter the "Board") wherein by denying a petition to grant a special permit for extension of nonconforming use or grant a special permit use with reference to the land and building at 171 Boston Street, Salem, Massachusetts, (hereinafter "Premises"),. the Board exceeded its authority, acted in an arbitrary and unfair manner, and based its decision on a legally untenable ground. Parties 2. The Plaintiff Robert H. Cucurull is a natural person and President of a Massachusetts corporation known as All Star of Woburn, Inc. having a principal place of business at 171 Boston Street, Salem, Massachusetts 01970. 3. The Defendant Nina Cohen is a member of the Board and resides at 22 Chestnut Street, Salem, Massachusetts 01970. 4. The Defendant Richard Dionne is a member of the Board and resides 23 Gardner Street, Salem, Massachusetts 01970. 5. The Defendant Michael Ward is a member of the Board and resides at 4 Hilton Street, Salem, Massachusetts 01970. 6. The Defendant Stephen Buczko is a member of the Board and resides at 27 Surrey Road, Salem, Massachusetts 01970. 7. The Defendant Stephen Harris is a member of the Board and resides at 148 North Street, Salem, Massachusetts 01970. Jurisdiction 8. This court has jurisdiction to hear this matter pursuant to Massachusetts General Laws Chapter 40A, Section 17. 9. On or about January 19, 1999, Plaintiff submitted an application to the Board for a special permit to use the Premises for a truck rental business, and for sales and service of motor vehicles. The Premises is located in a Business (B-2) zoning district under the provisions of the Salem Zoning Ordinance ("Ordinance"). 10. Prior use of the Premises consisted of sales, service, and painting of industrial machinery which use existed prior to the current ordinance. 11.The Ordinance allows as a matter of right in the zoning district, "automobile service stations" defined in the Ordinance as a "retail place of business engaged in supplying goods and services essential for the normal operation of a motor vehicle." 2 12.In accordance with a letter determination of the Inspector of Buildings and Zoning Enforcement Officer of the City of Salem, Plaintiff has conducted a vehicle towing and storage business at the Premises. 13.On February 17, 1999, the Board conducted a hearing without the Plaintiff or a representative of the Plaintiff being present and reached its decision (a) without evidence as to the nature of the prior nonconforming uses maintained in the Premises, (b) without a determination as to existing uses which are allowed by right in the zoning district, and (c) without a fair determination as to whether the rejected uses are contemplated by the Ordinance as being allowable by special permit. 14.After public hearing, the Board denied Plaintiffs petition by written decision dated February 17, 1999, filed with the Salem City Clerk February 25,1999. A certified copy of said decision is attached herewith as Exhibit 1. 15.The Board's decision is arbitrary and unfair since its decision was made following a hearing conducted without the presence of Plaintiff or a representative of the Plaintiff and without presentation of evidence on behalf of the Plaintiff. 16.The Board's decision is legally untenable with regard to the request for extension of a nonconforming use in accordance with Section 5-30) of the Ordinance, since the Board failed to examine or obtain evidence as to the nature of prior nonconforming uses in the Premises and failed to compare the said prior uses with the proposed uses. 3 17.The Board decision exceeded its authority in that it failed to consider that certain of the proposed uses are allowed by right or are uses contemplated by the Ordinance as being allowable by Special Permit. 18.The Plaintiff is a person aggrieved by the decision of the Board in that his property interests are severely, adversely, and irreparably harmed by said decision. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section 5-3 O, which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Sections 8-6 and 9-4, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension or expansion of nonconforming lots, land, structures, and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. The Board of Appeal, after careful consideration of the evidence presented at the hearing and after reviewing the plans, makes the following findings of fact 1. Upon information and belief, petitioner operates the business known as All Star of Woburn, Inc. at the above address. At the hearing, Ward 5 Councillor Leonard O'Leary and Ward 6 Councillor Sally Hayes stated that petitioner is currently in violation of zoning ordinance regulations regarding the businesses in operation at 171 Boston Street Both city councillors opposed the petition on the grounds that an expansion of the existing businesses would have a detrimental impact on the surrounding neighborhood: 4. The petition was opposed by two neighbors, Bob Brophy of 165A Boston Street and Francis Geany of 5 Bow Street, who stated that the petitioner's operations were currently not in compliance with zoning regulations. The neighbors further stated that they would oppose the installation of either a truck rental business or a used car business at that site. 5. The Board was unable to find any basis for hardship in the materials submitted in support of his petition. On the basis of the above findings of fact, and on the evidence presented, the Board of Appeal concludes as follows: 1. The Special Permit requested cannot be granted without substantial detriment to the public good or without nullifying and substantially derogating from the intent of the district or the purpose of the ordinance. 2. The granting of the Special Permit requested will not be in harmony with the Neighborhood and will not promote the public health, safety, convenience and Welfare of the City's inhabitants. Therefore, the Zoning Board of Appeal voted unanimously 0 in favor and 5 in opposition to the motion to grant the relief requested. Having failed to gamer the four affirmative votes required to pass, the motion to grant fails and the petition for a Special Permit is denied.
