Dear Bill:
I have been asked whether there is sufficient
records available to establish 5 Larchmont Road as a legal
three-family dwelling. I have attached hereto copies of an
Affidavit plus two pages from the 1940 and 1950 polling book
which were made available to me by Attorney Peter Merry.
Each document shows that the subject property has
been used as a three-family dwelling prior to more
restrictive zoning changes being made, and that the use has
not been abandoned. Therefore, it would be safe for your
office to conclude that 5 Larchmont Road is a legal,
nonconforming three-family dwelling.

remember our =conversation about"Bill- Munroe ' s unwillingness to "
ratify (by way of issuance of an occupancy permit) the historic
three family use of 5 Larchmont Road because his file had
nothing indicating as a three family use .
You suggested that I obtain an affidavit for the building
department jacket and that you would write Bill to give him the
comfort he needs . I will deliver the original of the affidavit
to Bill and suggest that he contact you.
