(R-2/B-2) - CITY CLERK. SALEF;.MASS A hearing on this petition was held November 23, 1987 with the following Board Members present: James Hacker, Chairman; Messrs. , Fleming,Strout and Associate Members Dore and Labrecque. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property, is requesting Variances from use, lot area, lot coverage, front yard depth, side yard setbacks, rear yard depth, height and parking to allow construction of eleven ( 11 ) residential units. Petitioner is also requesting a Variance from use to allow existing building to be used as an auto- mobile parts store. Property is located in an R-2/B-2 district. The Variances which have been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district; b. literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner; c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing and after viewing the plans, makes the following findings of fact: 1 . Parking is at a premium in this neighborhood; 2. This is a main corridor into the City and is a highly congested area, the granting of this project would exacerbate this situation. On the basis of the above findings of fact, and on the evidence presented, the Board of Appeal concludes as follows: 1 . Special conditions do not exist which especially affect the subject property but not the district generally; 2. Literal enforcement of the provisions of the Ordinance. would not involve substantial hardship to the petitioner; ! ' DECISION ON THE PETITION OF DONALD R. The relief requested cannot be granted without substantial detriment to the public good or without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. Therefore, the Zoning Board of Appeal voted 4-1 against the granting of the requested variances (Mr. Labrecque voted in favor) . The motion to grant failed to carry the required four votes needed to pass, therefore, the petition is denied. The petition, submitted by Mr. Donald Burnham, requests appropriate variances to continue a retail business in the former Condon' s Drugstore, and the construction of a twelve ( 12) unit condominium complex on the adjacent lot. I strongly oppose the granting of said variances. I have studied the proposed plan and have walked the locus of the project several times. I strongly feel that the proposed project is much too dense for this location. I believe that the size and density of this proposal will adversely impact the existing neighborhood. Furthermore, I feel that the mixture of uses, commercial and residential, will exacerbate the density problem. I am of the opinion that the proposal is based solely on the rationale of the greatest economic return for the developer, with little or no concern for the neighborhood, or the spirit of the Salem Zoning Ordinance. If the Board were to grant the requested variances, I believe that this would be in dereliction of our duty and in derogation of the ordinance. This is, I believe, another example of a developer asking for the proverbial "moon" , when , in reality, he would settle for something less than requested. -2- If this project were for eight ( 8) condominiums, and the demolition of the old drugstore, I would support the project. I have reviewed the proposed plan for the site and believe that such a development will be an asset to the community. As you know, Boston Street is a major entrance corridor into the City, and it is vitally important that we make certain that all new development be architecturally sound. This proposal presents a high quality design, and will substantially contribute to the aesthetics and architecture of Boston Street. In addition, it is important that new development not cause excessive traffic flow, and it is clear that this development will not do so. Because of the residential nature of the development, traffic flow on Boston Street will not be substantially increased.
