DECISION OF THE PETITION OF PETER COPELAS REQUESTING A VARIANCE
AND SPECIAL PERMIT FOR THE PROPERTY LOCATED AT 69 BOSTON STREET

A hearing on this petition was held May 21 2003 meeting with the following Board
Members were present: Nina Cohen Chairman, Richard Dionne, Bonnie Belair, Nicholas
Helides and Joan Boudreau. Notice of the hearing was sent to abutters and others and
notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
At the request of the petitioner's Architect, Richard Griffin, the Salem Board of Appeal
voted 5-0, to grant leave to withdraw this petition without prejudice requesting a Variance
for the property located at 69 Boston Street located in a R-2 zone.

THE CITY CLERK
Appeal from this decision, if any, shall be made pursuant to Section 17 of the
Massachusetts General Laws Chapter 40A, and shall be filed within 20 days after the
date of filing of this decision in the office of the City Clerk. Pursuant to Massachusetts
General Laws Chapter 40A, Section 11, the Variance or Special Permit granted herein
shall not take effect until a copy of the decision bearing the certification of the City Clerk
that 20 days have elapsed and no appeal has been filed, or that, if such appeal has
been filed, that it has been dismissed or denied is recorded in the South Essex Registry
of Deeds and indexed under the name of the owner of record or is recorded and noted
on the owner's Certificate of Title.

I am writing in opposition to the application for a special permit at 69 Boston Street,
Salem
The Samuel Pope house was built in 1740. As a rare surviving first period house it is a
significant part of Salem's historic fabric and architectural heritage.
Special permits are not a right they are a privilege.They should be granted only when a
genuine hardship exists. Persons who buy historic buildings knowingly take on the
responsibility which accompanies that ownership. The proposed special permit would
reward the worst kind of civic cynicism wherein an Owner intentionally
uses abandonment and neglect as a justification for demolishing an historic structure.
Even if 69 Boston Street were not a rare and historicPtnPertY a Special Permit allowing

the Owner to escape the rubes governing side yards and density of habitation would be
detrimental to the Boston Street neighborhood. Six Units means 9 cars and the
associated increase in traffic at one of the most congested intersections in Salem
Perhaps the Applicam should sell the Samuel Pope bouse to a responsible party and go to
some less vigilant community to build his six-plea. The current limit of two Units and
the attendant requirements for front, side and rear yard should be upheld by the Board
and the request for permission to demolish the Samuel Pope house should be denied.

Dear Ms. Cohen:
I am writing to you and the board of appeals to express my concerns over the
proposed plans for 69 Boston Street brought forward by Peter Copelas. Many of
the neighbors are concerned about the demolition of the existing property, given its
historical significance to this main entrance corridor. Also, I personally would like to
express my concern over the fact that the property in question was allowed to
deteriorate to the extent that it presently has. This is not the first property that has
been left in deplorable condition by Peter Copelas, and it is my opinion that
allowing the property to decay was intentional,with the intended purpose of
demolishing it to profit from new multi rental units.
I respectfully request that the board review the proposed plans and possibly
consider other options for this property. In closing I would also like to emphasize the
fact that though we all would like to see our neighborhoods improve, there may be
other avenues worth investigating, perhaps an avenue that could save a great piece
of Salem's architecture! Thank you for your attention to this matter.
