Statements of fact: 1. In the petition date-stamped June 25, 2014, the Petitioner requested a Special Permit to extend an existing nonconforming structure by adding a roof deck to an existing nonconforming three-family residential building in an R2 zoning district. 2. Mr. Nick Osgood presented the petition for 4 Bentley Street. 3. At the public hearing, three members of the public spoke in opposition to the petition, stating concerns regarding density, infringements on their privacy, and the negative impact of the proposed privacy fence on the value of the property and the character of the neighborhood. 4. Mr. Osgood requested to withdraw the petition without prejudice. s The Salem Board of Appeals, after thorough review of the petition including the application narrative and plans, and careful consideration of the Petitioner's presentation and testimony by the public, voted to grant the withdrawal of the petition for 4 Bentley Street without prejudice by a vote of four (4) in favor (Mr. Watkins,Ms. Curran, Mr. Copelas and Mr. Duffy in favor) and none (0) opposed. I live at 2 Bentley Street, Salem, Massachusetts, which is also the home I grew up in. I am here to oppose the application of Nick Osgood for a special permit to construct a roof deck at 4 Bentley Street, which is next door to my property. My reasons are set forth in a petition which I and my neighbors have signed and I will be submitting at tonight's hearing on Mr. Osgood's application. All of the owners of properties abutting 4 Bentley Street, including across Bentley Street, on either side of 4 Bentley Street(on the same side of the street), and those properties at 1-3 and 5 Daniels Street which share a rear property line with 4 Bentley Street, are opposed to Mr. Osgood's application. To amplify on the reasons for my particular opposition,the roof deck robs me of privacy in my backyard and my bedroom windows. Even though ours is not a local historic district established by Chapter 40C of the Massachusetts General Laws, our neighborhood is nevertheless a National Register Historic District established by Congress, and we should be entitled to no less consideration than if our homes were located in either the McIntire, Salem Common,Derby Street, or Lafayette Street(local) Historic Districts regulated by the Salem Historic District Commission, where such roof decks are not favored. The homes on Essex Street between Webb Street and Hawthorne Boulevard, and between Derby Street and Essex Street, are no less old,no less historic, no less important,and no less deserving of protection from intrusive,non-historic development. The long-term neighbors such as myself have honored each other's privacy. They have enjoyed their backyards and they have not built structures that would rob others of theirs. Even a high fence surrounding the deck would not be an acceptable solution,since it would be unsightly and would lower my property value, and the property values of my neighbors. Would the members of the Zoning Board enjoy losing their privacy if such a structure were built next to them? There is adequate grade-level land in the yard outside 4 Bentley Street for sitting and enjoying the outdoors without resorting to building a deck on the roof of the 2-story el, which would look down directly into my and my neighbors' yards and into our bedroom windows. The dangers from fire and noise are also cited in our opposing petition. A bit of history would also be relevant, particularly for the newer members of the Board. Approximately 6 years ago Mr. Osgood obtained a building permit to build within inches of my property a 3-story exterior staircase to replace an interior second means of egress (he previously removed)to service a third floor apartment that was never a legal apartment to begin with. I challenged the legality of the permit, and to his credit, Mr. St. Pierre agreed with me and revoked the building permit,but only after the exterior 3-story staircase had been built. Mr. Osgood subsequently filed an application for a variance to ratify the staircase as built,but the Salem ZBA unanimously denied the application, whereupon Mr. Osgood appealed the denial to the Essex Superior Court,which ultimately ruled by Summary Judgment in favor of the Salem ZBA and me. Incidentally,the Court also ruled on a technicality that while it was too late for me to challenge the legality of the third floor apartment, even though I had submitted multiple affidavits from neighbors and even residents of 4 Bentley Street at the time of the enactment,of the current Zoning ordinapce- saying that 4 Bentley Street was then being used as a 2-family dwelling, and that an illegal third unit had been surreptitiously installed on the third floor sometime thereafter, I was barred hxr the 6-y ear etat,Ae of limitation fmm challenging came l.,rt it was not tnn ity late for the Cto challen eg same. It should also be pointed out that the building permit that was later revoked only entitled Mr. Osgood to build a catwalk from the 3-story exterior staircase to the 37d door attic,not an expansive roof deck. Yet what Mr. Osgood built,without any color of entitlement, was the kind of roof deck that he now wants to reinstall,and which the Superior Court forced him to remove. I feet that the fact that Mr. Osgood then built something without any semblance of legal authority whatsoever, and the above history,are also important considerations for the Board to take into account tonight. I should also point out that during the multi-year pendency of Mr. Osgood's appeal,I was subjected to any number of indignities from Mr. Osgood, including a thrown beer bottle from this location by Mr. Osgood during the evening of the day the Superior Court decision was published which ruled in my and the Board's favor, for which there was a Salem Police investigation and report at the time. Pursuant to said Section 3.3.3,the Salem Zoning Board of Appeal may award such a Special Permit"only if...such...extension, alteration,or change shall not be substantially more detrimental than the existing nonconforming structure to the neighborhood. Emphasis added. The existing structure does not have a roof deck. Ours is an extremely dense neighborhood of largely wooden 18`x'century dwellings. Indeed,4 Bentley Street is built on the shared side lot line with the neighboring single-family dwelling owned by Linda Moustakis at 2 Bentley Street, and is less than 10 feet from the rear property line it shares with 1-3 Daniels Street and 5 Daniels Street. Anyone using such a roof deck would be able to look down directly down into our yards and into our bedroom windows, and the inevitable likely noise would be unacceptable. Also,to the extent there is grilling on the roof deck, there is an increased risk of fire. We are opposed to Mr. Osgood's Petition because the proposed new roof deck will substantially and adversely affect our privacy and our safety, and thus, our property values, and is contrary to the historic character of our neighborhood. For these reasons Mr. Osgood is not entitled to the Special Permit he is requesting and his Petition should be denied. Although the applicant has found a number of other non-conforming properties in the neighborhood, they do not represent the overall community and character of our neighborhood. The location of his proposed deck would make it highly visible from much of our yard and would eliminate the privacy and enjoyment of our own outdoor space. The lack of outdoor space deeded to the 3rd floor unit is entirely of the applicant's own doing when the property was converted to a condominium.
