JESORALDO FOR A VARIANCE AT 23 BECKET ST. (R-2) A hearing on this petition was held on January 16, 1991 with the following Board Members present: Richard Bencal , Chairman; Joseph Correnti , Richard Febonio, Edward Luzinski and Mary Jane Stirgwolt. Notice of the hearing was sent to abutter and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property, is requesting a variance from the undersized lot and parking requirements in order to convert this property back to its original design as a two family dwelling in this R-2 zone. The variances requested may be granted upon a finding by this Board that: a. Special conditions and circumstances exist which especially affect the land, building, or structure involved and which are not generally affecting other lands, buildings and structures in the the same district. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. c. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal , after careful consideration of the evidence presented at the hearing makes the following findings of fact: 1 . That the dwelling was historically used as a two family and that there were no structural changes made when it was used as a one family. 2. That the dwelling is located in an R-2 zoning district and that there are numerous other two family dwellings in the immediate vicinity. 3. That a written petition was presented to the Board with eleven signatures of abutters and neighbors of the dwelling, all of whom are in favor of the petition. 4. That City Councillor O'Leary spoke in favor of the petition, as he grew up in the home across the street from the dwelling in question and he remembers it as a two family unit. 5. That there was no opposition to the petition during the public portion of the hearing. 6. That the houses on Becket Street are particularly close to each other and many do not have any off-street parking. DECISION ON THE PETITION OF PHILLIP D. JESORALDO FOR VARIANCES AT 23 BECKET STREET, SALEM page two On the basis of the above findings of fact, and on the evidence presented at the hearing, the Board of Appeal concludes as follows: 1 . Special conditions exist which especially affect the subject property but not the district in general . 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship to the petitioner. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. Therefore, the Zoning Board of Appeal voted 4-1 , with Chairman Bencal voting against, to allow the variances requested, subject to the following conditions: 1 . That petitioner obtain all necessary building permits. 2. That a Certificate of Occupancy be obtained. 3. That all rules and regulations of the Salem Fire Department and the Fire Prevention Code be strictly adhered to. 4. That all City and State Building Codes be strictly adhered to. Historical significance (include explanation of themes checked above) This house is another of the five "Federal" structures standing on the east side of Becket St. ,built probably a few years before 1 '00, In general size and design,it is practically a twin to no. 19, and the 1836 Salem Directory recorded that�a"Daniel Bowditch, carpenter," lived there, doubtlessly a rela- tive of Salem' s famed navigatcr,Nathaniel 7.owditch, (Daniel probably did not owb th =1-.La=g,however. The 1851 map for Salem _s By 1874, the Salem Atlas records that the "Henry N:. Bar- ker family" owned all four properties ,from 17 through 423 Becket St. The :an Victorian store addition could well have been the first major change in the )tr house ' s general design ( c. 1881 ) #followed by the window changes ( especially the the modern picture window) , and the aluminum siding c6vering the dwelling. AftgThe trapezoidally-curved chimney (broad base, smali top) , only found on #19, be sides , on the street, is an interesting feature, but, though it is on the roof's c enter,I doubt that its present design dates hack beyond the mid-Victorian period , the same applying to 419. (The Barkerperiod of ownership may have see this change, ir. fact. ) One striking feature of the house is that the main en- trance is not centered on the front,but is off to one side (a common practice 1 . The grocery-store addition was apparently made into another room in the house when the store closed, c . 1902 . 10.
