A hear'_r., on this petition was held December 17 , 1986 with the fc11ca:ing Board

Associate Mem-ber LaBrecdue. Notice of the hearing was sent to abutters and others
and notices of the nearing were prc:,erly published in the Salem; Evening News in
accordar.-e with M=assachusetts General Laws Chapter 4OA..
Petitioner is requesting a Special ?err_it to extend nonconforEing rear setback to
alloy; construction of an egress in this R-2 district.
The provision of_. ths Salem Zoning Ordinance which is applicable to this request
for a Special Permitois Section V E. 10, which provides asrloi;s:
Notwithstanding anything to the contrary appearing in this Ordinar:ce, the Board of
Appeal nay , in accordance with the procedure and conditions set__`Drth in Section
VIII F and IX D, grant Special Permits for alterations and reconswrociton of non-
conforming structures, and for changes, enlargement, extension or expansion of
nonconforming lots, land,_ structures, and uses, provided, however, that such change,
extension, enlargement or expansion shall not be substantially more detrimental than
the existing nonconforming use to the neighborhood.

In more general terms, this Board is. when reviewing Special Permit requests,
guided b*:• the rule that a Special Fermit request may be granted upon a finding
by the Board that the grant of the Special Permit will prom.:ote the public health,
safety, convenience and welfare of the City' s inhabitants.
Appeal, after careful ccnsilderation of the eviden=ce presented a` the
hearing, and after viewing the plans, rakes the following findings Of fact:

2. There was no opposition;
3. Second egress will act as a mayor safety factor and strcctll re was
built na`"ly years a_O in its present state.
On the --asls q the above findings q_` act, and on the evidence presented at the
hearing. the Board of Appeal concludes as follows:
1 . The croccsed egress Will pre=y:c-e the public health, safe; convenience and
r;elfare of the City' s inhabitants;
2. The _proposed egress will not be substantially detrimental to the public
good and will not nullifv or substantially derogate from the intent or
purpose of the Ordinance.
