I am sorry for the confusion, but when we requested an extension for our
hearing in May, we asked for an extension to August, not July. We left this detail open
on the extension that we filed and were told that the August date would be filled in for
US.

Statement of Hardship for petition requesting variance from Section 7-3(e)(4)(c)of
the Salem Zoning Ordinance(20 foot maximum width of entrance and exit for
driveway)for 32 Beach Avenue.
My wife and I are the owner of the single family residence located at 32 Beach Avenue in
Salem. This is a densely populated neighborhood and a majority of the houses in our
immediate area do not have off-street parking. Many of our abutters are required to use
the town parking lot on Beach Avenue adjacent to the Beach Avenue playground. This
parking lot does not have adequate capacity and most abutters also park at least one car
on the street in front of their homes. This creates a significant inconvenience during
winter snow emergencies (when on-street parking is prohibited) and during the summer
months when the population is increased by seasonal residents and visitors. A number of
the houses in the immediate neighborhood have over the years constructed pull off
parking spaces in their front yards on Bayview Avenue and on Beach Avenue.
Our proposal is to create a pull off parking space for one automobile on the side of the
house adjoining High Avenue. The entire length of the pull off would be 27 feet
measured at the street and the depth would be approximately 10 feet at the deepest
section. However,the front and back of the pull off would taper away from the street at a
45%angle to permit pull in access without the need for parallel parking. We would
construct a stone retaining wall capped with bluestone with a maximum height of 3 feet
along the interior side of the pull off space. High Street is a side street located off of
Bayview Avenue that is primarily used for drop off access for the six houses on the street
and for emergency access vehicles. The pull off space would be used by my wife to park
her SW that she uses to transport our young children and will avoid the need for our
children to walk in the street from the public lot to our house, as well as avoid the need to
park at the Willows Amusement Park parking lot during snow emergencies.
The proposed pull off space would provide desirable relief to the neighborhood by
removing one car from the demand for parking in the public lot and on the adjoining
street. Moreover,the approval of the requested variance would not create a substantial
detriment to the public good since the improvement(i) is consistent with improvements
made to other properties in the neighborhood and(ii) is being constructed on a little used
side street to avoid interfering with neighborhood traffic. Finally, literal enforcement of
the Ordinance would involve substantial hardship on the petitioner since it would require
us to continue to rely on unassigned parking lot availability and on street parking to
access our property.

Petition of Carter Vinson requesting a Variance from number of stories

Beach Ave (11-1):
A public hearing on the above petition was opened on September 19, 2007 pursuant to
Mass General Law Ch. 40A, Sec. 11, with the following Zoning Board members present:
Robin Stein, Annie Harris, Rebecca Curran,Richard Dionne, and Bonnie Belair.
Petitioner seeks variances pursuant to Section 9-5 of the Salem Zoning Ordinance to
allow a third floor expansion for the property located a 32 Beach Ave.
The Board of Appeal, after careful consideration of the evidence presented at the public
hearing, and after thorough review of the plans and petition submitted, makes the
following findings of fact:
1. Carter Vinson, petitioner, presented the petition for the property he owns at 32
Beach Ave in the R-1 Zoning District.
2. Petitioner proposes to remove the three existing second story dormers on the
front of the home and replace them with a combination of gable dormers, and
a shed dormer as show on the plans entitled "Vinson Residence, 32 Beach
Ave, A Proposed Addition", dated August 10, 2007, sheets A.1- A.3. The
addition consists of two-story(2nd and 3rd story) gable dormers (front -
approximately 12' 8" wide, 12' high and extending 16' from the center of the
roofline) and a third floor shed dormer (front and rear- approximately 28'
wide, 9' high and extending 14' from the center of the roofline).
3. In support of the petition was Robert McCarthy of 153 Bay View Ave, who
spoke at the hearing.
On the basis of the above findings of fact and all evidence presented at the public hearing
including, but not limited to, the Plans, Documents and testimony, the Zoning Board of
Appeals concludes as follows:
1. The petitioner may vary the terms of the Residential Single Family Zoning
District to enable thero osed development,p p which development is consistent
with the intent and purpose of the City of Salem Zoning Ordinance.

2. In permitting such change, the Board of Appeals requires certain appropriate
conditions and safeguards as noted below.
In consideration of the above, the Salem Board of Appeals voted, five (5) in favor(Stein,
Harris, Belair, Dionne, and Curran) none (0) opposed, to grant petitioner's request for a
variance, subject to the following terms, conditions, and safeeuards:
1. Petitioner shall comply with all city and state statutes, ordinances, codes and
regulations.
2. All construction shall be done as per the plans and dimensions submitted to and
---- --- - approved by the Building Commissioner-.-
I All requirements of the Salem Fire Department relative to smoke and fire safety
shall be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. Exterior finishes of new construction shall be in harmony with the existing
structure.
6. A Certificate of Inspection is to be obtained
7. Petitioner is to obtain approval from any City Board or Commission having
jurisdiction including, but not limited to, the Planning Board.
8. Unless this Decision expressly provides otherwise, any zoning relief granted does
not empower or authorize the Petitioner to demolish or reconstruct the
structure(s) located on the subject property to an extent of more than fifty percent
(50%) of its floor area of more than fifty percent (50%) of its replacement cost at
the time of destruction. If the structure is demolished by any means to an extent
of more than fifty percent (50%) of its replacement cost or more than fifty percent
(50%) of its floor area at the time of destruction, it shall not be reconstructed
except in conformity with the provisions of the Ordinance.
