A public hearing on the above Petition was opened on June 17, 2015 pursuant to M.G.L Ch.40A, � 11.
The hearing was closed on that date with the following Salem Board of Appeals members present: Rebecca
Curran (Chair), Peter A. Copelas,Jimmy Tsitsinos, Mike Duffy and Tom Watkins.
The Petitioner seeks a Special Permit from the provisions of Sec. 3.3.5 Nonconfomein8 Single- and Two-Family
Residential Structuvrs of the Salem Zoning Ordinance,to alter or structurally change a non-conforming structure
to allow the enclosure of an existing covered porch.
Statements of fact:
1. In the petition date-stamped May 26, 2015, the Petitioner requested a Special Permit per Sec. 3.3.5
Nonconforming Single- and Two-Family Residential Structures of the Salem Zoning Ordinance, to alter or
structurally change a non-conforming structure to allow the enclosure of an existing covered porch.
2. Ms. Susan St. Pierre presented the petition on behalf of the petitioner.
3. The porch is dimensionally non-conforming as the side-setback is three (3) feet away from the side-
yard lot line. In accordance with the Salem Zoning Ordinance, any porch that was constructed before
1965 can be enclosed by right provided that the porch is a minimum of five (5) feet from any side or
rear lot line.
4. The petitioner proposes to enclose a 12 foot long section of an existing side porch.
5. The footprint of the porch is not proposed to change.
6. The requested relief, if granted, would allow the petitioner to alter or structurally change a non-
conforming structure to allow the enclosure of an existing covered porch.
7. At the public hearing, no (0) member of the public spoke in support and no (0) members spoke in
opposition to the petition. A petition of support with numerous abutters was presented to the Board
for the record-

Findings for Special Permit:
1. The proposed change or extension of a non-conforming structure would not be more substantially
detrimental than the existing non-conforming structure to the impact on the social, economic or
community needs served by the proposal.
2. There are no impacts on traffic flow and safety,including parking and loading.
3. The capacity of the utilities is not affected by the project.
4. There are no impacts on the natural environment,including drainage.
5. The proposal conforms to the existing neighborhood character.
6. The potential fiscal impact,including impact on the City tax base is positive.
On the basis of the above statements of facts and findings, the Salem Board of Appeals voted five (5) in favor
(Rebecca Curran (Chair), Peter A. Copelas, Jimmy Tsitsinos, Mike Duffy and Tom Watkins) and none (0)
opposed, to approve the requested Special Permit to allow the enclosure of an existing covered porch subject
to the following terms, conditions and safeguards:

Statement of Hardship COMMUNITY DEVELOPMENT
a)Special conditions and circumstances that especially affect the land, building, or structure involved,
generally not affecting other lands,buildings, and structures in the same district.,
The structure was built as a cottage on a very small lot in the late 1800's and is located on or in close
proximity to the lot lines on all sides. There is no room to construct an addition to the home. The porch
which has a roof, is original to the house and enclosing the porch will not increase the footprint of the
structure or further exacerbate the building setbacks.
There is a paper street in the rear of the dwelling where the porch is located that provides a 15 foot
buffer between the rear lot line of the adjacent properties on Cheval Avenue. Most of the original rear
porches in the area have been enclosed over time.
b)Literal enforcement of the provisions of the Ordinance would involve substantial hardship to the
applicant
The house is a cottage and does not have any closets and lacks a bathroom on the first floor which is a
great inconvenience for the owner. The second floor contains only one small closet in one of the
bedrooms. The extreme lack of closet space and the lack of a second bathroom adversely affects the
functionality and restricts the future resale value of the home.
c)Desirable relief may be granted without substantial detriment to the public good, and without
nullifying or substantially derogating from the intent of the district or the purpose of the ordinance.
The porch is a pre-existing condition and has a roof. The variance would allow the porch to be enclosure
but not extended. Enclosure of the rear porch will not result in further encroachment to existing
building setbacks.
Allowing the porch enclosure will provide the homeowner with a functional area to install a bathroom
and a large closet on the first floor. No public harm will result from the porch enclosure.There is
adequate setback provided through the paper street located adjacent to the rear lot line.
The neighbors located on both side yard of the porch are not opposed to the proposed porch enclosure.

Dear Ms. Curran:
Hopefully the members of the Board of Appeal will consider the suggestions in this letter
regarding the rebuilding at 84-86 Bay View Avenue.
I am certain that those of you who volunteer time in public service intend good outcomes, and
not the criticism this project has generated due to its negative effect on abutting properties.
Neither the boards' decision of March 1.0, 2014 nor the minutes of the Petition hearing of
February 19,2014 mention demolition or excavation. This work was undertaken without
appropriate permits. Expectations for this work should be clearly noted in any Decision
regarding a nonconforming structure. In this case there was approximately four feet between
excavation and the abutting structure. The increase in height of the rebuilt basement level and the
variance which granted additional height allowed a ground level cottage to be replaced by a
structure with four levels of above ground living space.
The permit states it is for the renovation and expansion of an existing structure,as the attached
photo illustrates the newly constructed property was neither.
In the age of Google maps and digital photography it would be appropriate to require an.
illustrated impact statement as part of the petition for a Special Permit.
The Salem Willows neighborhood was fust developed in the 1850's as tent sites for a summer
encampment and later in the 1800"s evolved in to summer cottages. Those cottages were
interspersed with rooming houses and hotels for summer visitors. This produced a charming mix
of large and small dwellings in close proximity to neighboring structures. Year round
conversion retained the overall look and feel of the earlier community.
It is hoped that the board will take steps to protect the historic Willows community.
This construction should not be considered a pattern for future projects.

Application for special permit
Ms. St-Pierre residence was built in 1880 in the Juniper Point neighborhood of Salem. Like most adjacent
properties,the dwelling includes a front porch and a wrap around porch in the rear. Ms. St-Pierre is
proposing enclosing a rear section of the existing porch. We do not know when the rear porch was built but
based on its construction, it was probably built prior to 1965. There is no building permit for it in the
building department file.
Enclosing the rear porch would not affect traffic flow or parking,would not impact drainage or be
detrimental to the neighborhood character. It would be in keeping with adjacent properties who had the
same work done in the past.
Enclosing the rear porch would allow Ms. St-Pierre to rebuild an existing non-code compliant interior
staircase and add a half bath to the first floor.

Permit requesting relief from Sec. 3.3.5 Nonconforming Single- and Taco-Family Residential Structures of the Salem
Zoning Ordinance, to alter or structurally change a non-conforming structure to allow the enclosure of an
existing covered porch located at the property of 83 BAY VIEW (Map 44 Lot 95)(R1 Zoning District).
The public hearing will be held on Wednesday,June 17, 2015 at 6:30 PM, in Room 313, 3`d at 120 Washington
Street in accordance with Chapter 40A of the Massachusetts General Laws. A copy of the application and
plans are on file and available for review during normal business hours at the Department of Planning &
Community Development, City Hall Annex, 3`d, 120 Washington St, Salem, M.A.
