Petition of MS KLEIN, seeking a Special Permit requesting relief from Sec. 3.3.SNonconlormrng
Single-and Two-Family Residential Structures of the Salem Zoning Ordinance, to raise the existing
non-conforming structure approximately two (2) feet to install a foundation and construct a second
floor dormer at the property of 48 BAY VIEW AVE (Map 44 Lot 141)(8-1 Zoning District).
A public hearing on the above Petition was opened on August 16,2017 pursuant to M.G.L Ch. 40A, g 11 and
closed on that date with the following Salem Board of Appeals members present:Rebecca Curran (Chair),
Tom Watkins,Jimmy Tsitsinos,Mike Duffy,and Peter A. Copelas.
The Petitioner is requesting a Special Penmit requesting relief from Sec.3.3.5 Nonconforming Singk-and Two-
Family Reridenkal Slmdures of the Salem Zoning Ordinance,to raise the existing non-conforming structure
approximately two (2) feet to install a foundation and construct a second floor dormer.
Statements of fact:
1. In the petition date-stamped July 20,2017 the Petitioner requested a requesting relief from Sec. 3.3.5
Nonrnnformixg Single-and Two-Family Raidential Slane mea of the Salem Zoning Ordinance,to raise the
existing non-conforming structure approximately two (2) feet to install a foundation and construct a
second floor dormer.
2. The property is a single family home in an R-1 Zoning District
3. The property is called the William Bates House and was constructed in 1885 in the style of a Queen
Anne/Stick Style. The property is listed as a contributing building in the Salem Willows National
Register District
4. The property owner is proposing to restore as much of the original architecture as possible,raise the
existing non-conforming structure approximately two (2) feet to install a foundation and to construct
a second floor addition, to make the second floor big enough for a bedroom, bathroom and closet
The petitioner is also proposing to improve the basement space and will serve as living space.
5. There will be no expansion of the building footprint
6. In a letter dated August 10, 2017, from the staff planner of the Historic Commission, there were
several recommendations to the Zoning Board of Appeals including encouraging the applicant to
preserve the original window openings and restoration of the original window configurations. Staff
also recommended that the applicant retain as much of the original architectural decorative trim in the
gable and on the porch as possible.
7. The Board requested that the replacement materials including, but not limited to the deck railings,
stairs,and decking be made of A2ek and not shiny PVC.

S. The requested relief, if granted,would allow requesting relief from Sec. 3.3.5 Nonconforming Single-and
Two-Family Residential Structures of the Salem Zoning Ordinance, to raise the existing non-conforming
structure approximately two (2) feet to instill a foundation and construct a second floor dormer.
9. At the public hearing, ten (10) members of the public spoke in support and none spoke in opposition
to the petition.
The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and
after thorough review of the petition, including the application narrative and plans, and the Petitioner's
presentation and public testimony, makes the following findings that the proposed project meets the
provisions of the City of Salem Zoning Ordinance:
Findings for Special Permits:
The Board finds that the structure meets the definition of a historic carriage house and the proposed
use will not outweigh its beneficial impacts to the City or the,neighborhood.
7. The social, economic, or community needs are served by the proposal as this project is a significant
improvement to the neighborhood including the historic conservation of this historic structure.
2. There are no impacts on traffic flow and safety, including parking and loading as the on-site parking
requirements are met.
3. The capacity of the utilities is not affected by the project.
4. There are no impacts on the natural environment, including drainage as the footprint of the building
is not proposed to expand beyond the existing footprint.
5. The building is a historic property and the proposed architecture and conservation of the existing
historic features of the building has a positive impact on the neighborhood character.
6. The potential fiscal impact,including impact on the City tax base is positive.
On the basis of the above statements of facts and findings, the Salem Board of Appeals voted five (5) in favor
(Rebecca Curran (Chair),Tom Watkins,Jimmy Tsitsinos,Mike Duffy,and Peter A. Copelas)and none (0)
opposed to allow a historic carriage house to be converted into a dwelling unit,subject to the following terms,
conditions and safeguards:

STATEMENT OF GROUNDS FOR SPECIAL PERMIT
FOR 48 BAY VIEW AVENUE
As owner, petitioner seeks approval of a Special Permit under Section 3.3.5 of the Ordinance
(Use Regulations)for the alteration of an existing non-con forming dwelling located at 48 Bay View
Avenue by raising the house about two (2)feet to install a foundation, and constructing a second floor
dormer so that the second floor will be big enough for a bedroom, bathroom and closet. All proposed
work will be in accordance with submitted plans,and there will not be any expansion of the existing
building footprint, which is non-confirming in some dimensions.
Applicant is advised that this alteration requires a Special Permit under Section 3.3.5 of the
Ordinance.
The applicant's proposal and plans are for a restoration of the premises, including a new
foundation and the second floor dormer. The building will remain as a single-family dwelling.This will
be a significant improvement to the property, and will enhance the neighborhood.
The proposal will not be substantially more detrimental than the existing use, based upon the
following criteria:
(a) The social, economic and community need to preservation the historic fabric of the
neighborhood is served by this proposal
(b) Traffic flow and safety are unchanged by this proposal.
(c) Adequate utilities and public services already service the property
(d) Impact on the natural environment and drainage are unaffected,as there is no expansion of
the structure footprint.
(e) The house has existed in the same location at the property since at least the early 1900s, so
the proposal has no negative impact on the character of the neighborhood, and
(f) the renovation of the house will have a positive fiscal impact on the City by generate more
real estate tax revenue from the increased assessment for the renovated structure.

Ahn and I wish to thank you all for your warm welcome to the neighborhood. We have
truly enjoyed the last few months of getting to know and reacquaint ourselves with all of
you. As you all are aware we purchased 48 Bay View and could not be more excited
with our decision.
The two major improvements we want to make are, raising the house two feet to add a
new foundation, as well as adding a dormer to make the second floor big enough for a
bedroom, bathroom and closet. All renovation will be made on the existing footprint.
Our plan is to bring the house back to its glory days by,keeping its character and charm.

Located within the recommended Salem Willows Historic District,
eligible under Criteria A and C.
ARCHITECTURAL SIGNIFICANCE Describe important architectural features and evaluate in terms of
other buildings within the community.
48 Bay View Avenue retains a greater degree of, decorative
detail than many of Salem Willows ' summer cottages , and has
characteristics of the Queen Anne and Stick Styles . It is 1 . 1/2
stories` high , with a steep front gable roof that is clipped` at the
facade. A broader gabled section extends behind . The front porch
wraps to a one-story entrance ell on the southeast side of the
bouse 'and wraps to the rear on the northwest side. Porch details
include a stickwork balustrade, brackets and jigsawn details. The
first floor windows have tab-bracketed gabled hoods above a panel
over the windows . The sash is 2/2. There is a dormer on the
southeast side of the gable with one window. s
HISTORICAL SIGNIFICANCE Explain the role owners played in local or state history and how the
building relates'to the development of the community.
This. House-. is one of the finest extant examples of Salem
Willows ' 19th century resort architecture. William M. Bates
purchased this lot , number 73 on a plan ofcottagelots dated
October 1875 , from developer, Daniel Gardner in January of 1885.--
In April of 1885 Bates requested a building permit for a 1 .1/2
story pitch-roofed dwelling on Juniper Point.. Bates; a dentist ,
used the house as a summer residence at least until 1897 .

Architectural Description:
As stated on the inventory form completed for this property,this cottage on Juniper Point is"one of the finest extant
examples of Salem Willows' 191h century resort architecture". Exhibiting both Queen Anne and Stick Style decorative
elements,this building is one of the best preserved buildings in the neighborhood in terms of scale, massing,and
retention of decorative detail.The building is 1 y:stories with a steep front gable roof that is clipped at the facade. A
broader gabled section extends behind.An open porch wraps around the front of the building and extends to the rear
on the northwest side.Original porch details include bracketed posts and jagsawn details(the original stickwork
balustrade has been replaced with square balusters since inventory form was completed in 1989).While windows have
been altered with replacement sash,the original fenestration pattern is still intact, including a panel over first story
windows on facade.The building has one shed-roofed dormer on the southeast corner of the gable with one window.

Staff Comments:
48 Bay View Avenue is one of the best preserved historic summer cottages on Juniper Point. Its scale and massing is
nearly original to the 1885 construction and architectural details are still present.This building is listed as a contributing
building in the Salem Willows National Register District; it is not listed in a local historic district.
The applicants are proposing to retain the original historic cottage building intact by positioning the proposed addition
at the rear. However,the drawings indicate that several changes will be made to the window fenestration of the historic
cottage and the proposed addition appears to be significantly taller than the cottage,which could potential overwhelm
the scale of this cottage as well as nearby cottages on Bay View Avenue. The application also indicates that this cottage
will be raised 2'to allow a taller basement, although it is unclear what visual impact this will have on the cottage.
Requesting the applicant to provide drawings of the existing building would help to clarify these changes and determine
the full impact of the proposed expansion on the historic cottage. Identifying these drawings by coordinates(north
elevation,east elevation,etc.)would also be helpful.
Based on my review of the drawings as presented, I offer the following initial comments for the ZBA to consider:
• Encourage preservation of the original window openings and restoration of the original window configurations.
The drawings indicate a number of design changes to the historic cottage, including replacement of two (2)first
story sash windows with a smaller triple window on the facade(east); removal of first story sash window on
right/north elevation;and change in window configuration to 4/1 (original historic window configuration was
2/2).
• Encourage restoration of existing architectural details on the cottage. The building retains some of its
architectural decorative trim in the gable and on the porch,although some elements are missing. It appears
from the drawings that this trim will be retained and replicated where missing. It is unclear how porch lattice
will be treated.
