DECISION OF THE PETITION OF JOHN RUSSELL REQUESTING A VARIANCE FOR
THE PROPERTY LOCATED AT 45 BARR STREET R-2
A hearing on this petition was held July 17, 2002 the following Board Members were
present: Nina Cohen Chairman, Nicholas Helides, Bonnie Belair, Richard Dionne and
Joan Boudreau.. Notice of the hearing was sent to abutters and others and notices of
the hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
At the request of the petitioner the Salem Board of Appeal voted 5-0, to grant leave to
withdraw this petition without prejudice for Variance from rear setback, lot coverage and
number of stories to construct an addition for the property located at 45 Barr Street
located in a R-2 zone.
GRANTED LEAVE TO WITHDRAW WITHOUT PREJUDICE

THE CITY CLERK
Appeal from this decision, if any, shall be made pursuant to Section 17 of the
Massachusetts General Laws Chapter 40A, and shall be filed within 20 days after the
date of filing of this decision in the office of the City Clerk. Pursuant to Massachusetts
General Laws Chapter 40A, Section 11, the Variance or Special Permit granted herein
shall not take effect until a copy of the decision bearing the certification of the City Clerk
that 20 days have elapsed and no appeal has been filed, or that, if such appeal has
been filed, that it has been dismissed or denied is recorded in the South Essex Registry
of Deeds and indexed under the name of the owner of record or is recorded and noted
on the owner's Certificate of Title.

the proposed betterment of the property located at 45 Barr St Salem. I have reviewed
these plans and have no objection to the requested addition.

To whom it may concern:
I understand that John Russell has petitioned the Board for
a variance to construct a three story addition on his property at
45 Barr Street .
Although I cannot attend the public hearing being held
tonight , I would like to register my displeasure with the
proposed construction.
Unless Mr Russell can demonstrate how his new construction
will incorporate off street parking, additional space at 45 Barr
Street will likely increase the number of people living in the
building and hence, the number of cars needing parking spaces .
Furthermore, because of parking restrictions on School
Street, several School Street tenants already use Barr Street for
parking.
For the above reasons , I 'd urge the Board to deny John
Russell ' s petition.
