Notice of the hearin�g was sen t Abutters and others and notices of the hearing were properlyFl$ fished in the Salem Evening News in accordance with Massachusetts General lays Chapter 40A. r e Petitioner, owner of the premises, is requesting a Variance from side and rear setbacks to allow existing dwelling and decks in this R-1 district. The Variance which has been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district; b. literal enforcement of the provisions of the Zoning Ordinance would in, volve substantial hardship, financial or otherwise, to petitioner; and c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purposes of the Ordinances. The Board of Appeal, after careful consideration of the evidence presented at the hearing, makes the following findings of fact: 1 . No opposition; 2. Neighborhood showed major support for petitioner; 3. House was built prior to the Zoning Ordinances and apparently constructed in violation of new Zoning Ordinance; 4. Building and decks are currently existing and were built many years ago. On the basis of the above findings of fact and on the evidence presented, the Board of Appeal concludes as follows: 1 . Special conditions exist which affect the lot in question and do not generally affect the district; 2. The relief requested can be granted without substantially derogating from the intent or purpose of the Ordinance and without substantial detriment to the public good. Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the relief requested provided that: I . Building to be used solely as a single family dwelling. a m/des B.
