Dear Board Members:
I am writing to support a request for a variance at 95-101 Congress Street to
allow the construction of sixteen (16) housing units.
As you know, the need for affordable housing in Salem is critical, and we
must take all possible steps to address it. Adequate housing is beyond the financial
reach of many of Salem's families and households, and the City must take an active
role in attempting to increase the supply of such housing.
The addition of sixteen (16) new units, which will be sold at affordable prices,
possibly with financing for first time homebuyers being provided by the
Commonwealth and its Massachusetts Housing Partnership, will be very helpful to
our efforts of providing affordable housing to our residents.

A hearing on this petition was held April 27, l6 t�i. tha -ollowing Board :
Members present: James Hacker, Chairman; Scott Cha `sActing Secretary, Messrs. `
Hopper, Luzinski, Bencal. Notice of this hearing was sent to abutters and others
and a notice of the hearing was published in the Salem Evening News in accordance
with Massachusetts General Laws Chapter 40A.
The petitioner has requested a. variance for the property in question to allow the
premises to be converted from a two-family to a three-family dwelling.- Petitioner
has also requested a variance from the minimum parking requirements.
The Board of Appeal, after consideration of the evidence, presented at the. public
hearing and after viewing plans of -the property, makes the following findings of fact:
1. No opposition was raised to petitioner's plan by neighbors;
2. The proposed use of the property is consistent with that of
surrounding lots.
On the basis of the above findings of fact, and the evidence presented at the
—- = hearing, the Board of Appeal concludes as follows:
1. The property in question is unique because of it's size and
configuration;
2. The conditions above described especially affect the land in
question but do not generally affect the zoning district in which
the land is located;
3. The conditions described above which affect the land in question, but
not the zoning district generally, causes special financial hardship
to the petitioner;
4. The-desired-variances may be granted without substantial detriment to
the public good.
Therefore, the Board of Zoning Appeal voted in favor of granting the variances
requested by petitioner. The Board grants variances to the petitioner under the
following terms and conditions: ,
1. Petitioner may convert the premises to a three-family dwelling;
2. The property may have less than the minimum amount of parking spaces
otherwise required by the Salem Zoning Ordinance, but may not have less
than four (4) on-site parking spaces;

3. Petitioner must obtain a Certificate of Use and Occupancy
for the premises;

We the undersigned petition the city of Salem to stop the addition
of a fire escape at 50 Balcomb *. Salem MA. This residence was;.4.
originaly a one family domicile, and is presently a two family. We feel
that the addition of the fire escape to make this domicile into a three
family house will be an eyesore in the neighborhood and will detract
from our property value. Furthermore'- we object to the manner in which
the permit for this construction was obtained. Many of us recieved no
notice of the intention to build said fire escape until construction
started. Those of us who were notified were told of the plan to make
a third 'floor apartment and not of the fire escape. We wish this
construction stopped. .

Dear Mr. Hacker:
At its last meeting, the Planning Board reviewed the upcoming
Board of Appeal agenda and would like to comment on the following
petitions:
The Planning Board opposes the petition of John M. Martins for a
Special Permit to convert to a three-family dwelling and a Variance
from parking requirements at 50 Balcomb Street on the basis of
the fact that the area is already congested and allowing a variance
from parking would only exacerbate the problem.
The Planning Board opposes the petition of Raymond and Elberta
Cloutier for a Variance to divide a parcel of land into Lots
A and B, neither lot having sufficient square footage to construct
a single family dwelling on Lot B at 18 Abbott Street, on the
basis of creating undersize .lots in an R-1 area.
The Planning Board opposes the petition of Jeffrey L. Musman for
a Special Permit to convert to three family dwelling and a Variance
to reduce parking requirements to one space per unit at 70 Essex
Street on the basis of the fact that once again, this is a congested
area and variance from parking requirements would only add to the
problem.
We appreciate the opportunity to provide input into your
agenda and look forward to continued cooperation between our
two Boards.

hearing for the above listed name and address, the Salem Fire
Department, requests the following items to be placed on record.
1. The Salem Fire Prevention Bureau records indicate this owner
has failed to obtain the required Certificate of Compliance
for smoke detectors, under provisions of Chapter 14.$, of

2 . This occupancy is therefore in violation of law and we are

The Application for Permit was denied by the Inspector of Buildings for the following
reasons:

The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem
Zoning Ordinance and/or the Building Code and order the Inspector of Buildings to
approve the application fee permit to build as filed; as the enforcement of said
Zoning By-Laws and Building Code would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially dero-
gating from the intent and purpose of the Zonfng Ordinance and Building Code for
the following reasons: Petitioner is the owner/occupier of the premises. It is a three story,
two family dwelling. He wishes to create an apartment on the third floor since the.building is
Large enough for three apartments. He will continue to live in one of the apartments. There is
Presently a two car garage on the premises. As shown on the attached plan petitioner wishes
o expand the available on-site parking to four spaces. The ordinance requires four and a half
spaces . Because of the size and shape of petitioner's lot, he is unable to provide any parking
beyond four spaces nor can he change his building to provide more living space. Petitioner is
requesting a variance to allow use of the premises as a three-family dwelling, .and also a
variance allowing use of the premises with four parking spaces, instead of four and a half.
Without the requested variances, petitioner will be unable to fully utilize his land and will
suffer financial and other hardship.
