Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The petitioner is requesting a Variance for relief from side setback for the property located at 44 Balcomb Street located in an R-2 zone. The Variances, which have been requested, may be granted upon a finding by this Board that: a. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structure involve. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioners. c. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district of the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1. Petitioner seeks relief from side setback requirements to upgrade an existing deck by installing a 3-season sunroom on the deck at the property line. 2. Petitioner submitted plans showing that the house currently extends to within 5.6 ft of the property line. The proposed addition will rest atop the existing deck at the outer edge, thereby falling within the required setback line. 3. There was no opposition to the proposed request. DECISION OF THE PETITION OF EMMA GARDNER REQUESTING A VARIANCE FOR THE PROPERTY LOCATED AT 44 BALCOMB STREET R-2 pagetwo On the basis of the above findings of fact, and on, the evidence presented at the hearing,the Zoning Board of Appeal concludes as follows 1. Special conditions exist which especially affect the subject property but not the district in general. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship to the petitioner. 3. Desirable relief can be granted without substantial detriment to the public good and Without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. Therefore, the Zoning Board of Appeal voted 4-0, to grant the Variances requested, subject to the following conditions; 1. Petitioner shall comply with all city and state statures, ordinances, codes and regulations. 2. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 3. All construction shall be done as per the plans and dimensions submitted. 4. Petitioner shall obtain a building permit prior to beginning any construction. 5. Exterior finishes of the new construction shall be in harmony with the existing construction. A) The zoning ordinan cc of 10 Foot side yard set back was put into place after the house was built where as other homes may have been built after the set back was put in place and therefore may not be affected in the same way. There is currently 6 feet to the side lot line on the right side of house from the deck and10 feet is required under the new set back the house is 5.6 feet from same lot line.. B) Prevent the construction of the 3-season sunroom on their existing deck decreasing their quality of life and the value of property. Q The construction of the 3-season sunroom on the existing deck will not cause any detriment to the public in any way and due to the fact the house itself is 5.6 feet from the right side lot line the construction of the3-season sunroom on the existing deck would be 6 feet from the lot line not effecting anything more than the house does currently.
