A hearing on this petiiton was held December 2, 1987 and continued till
January 13, 1988 with the following Board Members present: James Fleming,
Vice Chairman; Messrs. , Bencal, Luzinski and Dore. Notice of the hearing
was sent to abutters and others and notices of the hearing were properly
published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
Petitioners represented themselves and requested the Board to grant them
Leave to Withdraw Without prejudice. The Board of Appeal voted unanimously,
4-0, to grant the petitioners there requested leave to withdraw.

Dear Mrs. Machado:
I was very much distressed reading your letter dated December
17, 1987 to the Board of Appeal.
Although you are within your rights to ask to withdraw you application
without prejudice, the Zoning Board of Appeal is required by law to vote in
the majority to allow this privilege. It is my suggestion that you appear
before the Board on January 13, 1988 and ask them, at that time, to withdraw.
If for any reason your withdrawal is not granted the petition would continue
and in all probability it would be denied if you are in fact unable to
present the documents we requested.
Mrs. Machado, there is no question in my mind that you would make a
good neighbor and that you, your husband and children would be an asset to
any community in which you chose to live.
Regardless of what you may think of the neighborhood, the Councillor,
or the members of the Board of Appeal, I can assure you that this Board has
never discriminated against anyone because of heritage, the concerns of this
Board are for the land only.
Whether you choose to live on Alba Ave. , or any location in Salem, or, to
remain in Peabody, I would appreciate your contacting me either at my home,
745-1676 or my office 745-8918 so that I may further assure you your petition
at the hearing was and will be heard with the same high standards that all
petitioners receive. Again, please be assured that the deliberations of the
Board of Appeal are for the land.

I would like to withdraw my request for a variance to build a single
family dwelling on Alba Avenue, Salem, MA. Our case had been
continued and the next hearing was scheduled for January 13 , 1988.
I would appreciate it if you would return my $50. 00 check ( check
number 455) .
I also want to stress to the Board how angered, frustrated and hurt
my husband and I are that because the majority of the residents on
Alba Avenue and surroundings are so concerned with our heritage, and
their selfish and myopic attitudes about what is good for the
neighborhood, we were not given a chance at the American dream - to
build a decent home for our daughter and ourselves. They forget
where they came from. It is a pity because they too have lost
something.
I have attached a self-addressed envelope for your convenience in
returning my check.
