Re: 441 Lafayette Street
On Thursday, April ZI, 1988, the Planning Board of the City of Salem held a public
hearing regarding the application of Larry Green for a Special Permit under Section P,
Wetlands and Flood Hazard Districts of the Salem Zoning Ordinance, with respect to a
proposal to construct a deck and the placement of an aluminum ramp onto a float at 441
Lafayette Street, which is located in a Flood Hazard District.
At a regularly scheduled meeting of the Planning Board held on May 5, 1988, the
Board voted by a vote of six in favor, one abstention, to approve the application as
complying with the requirements for the issuance of the permit with the following
conditions:
1. Conformance with Plan
Work shall conform to plan entitled, "Plan of Land in Salem, MA, Proposed Deck and
Docking", dated March 12, 1988.
Z. Conservation Commission
Work shall comply with all requirements of the Order of Conditions issued by the
Salem Conservation Commission on April Z8, 1988.
3. Lighting
All future lighting plans for the deck, ramp and float areas shall be reviewed and
approved by the City Planner.
4. Construction Practices
All construction shall be carried out in accordance with the following conditions:
a. No work shall commence before 7:00 am. on weekdays and 8:00 am. on
Saturdays. No work shall continue beyond 5:00 p.m. There shall be no work
conducted on Sundays or holidays.
b. All reasonable action shall be taken to minimize the negative effects of
construction on abutters. Advance notice shall be provided to all abutters in
writing at least 7Z hours prior to commencement of construction.
5. Violations
Any violations of these conditions shall result in revocation of this permit by the
Planning Board.
This Special Permit shall not take effect until a copy of the decision bearing the
certification of the City Clerk that twenty days have elapsed and no appeal has been filed
or that if such appeal has been filed, and it has been dismissed or denied, is recorded in
the Essex County Registry of Deeds and is indexed in the grantor index under the name of
the owner of record or is recorded and noted on the owner's certificate of title. The fee
for recording or registering shall be paid by the owner or applicant.

The Variance which has been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land,building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to petitioner;
c. desireable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating frau the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1. The northwest corner of the existing deck was constructed 8 feet from
the side line, two feet closer than allowed.
2. Building was constructed in accordance with a building permit issued
August 7, 1979; however, plot plan submitted to building department
at that time did not show the deck.
3. Original construction plans submitted to the building department could
not be located.
4. Neighborhood opposition was recorded concerning potential use of the
building as a multifarrsly unit and tideland encroachment.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1. Special conditions exist which especially affect the subject but do
not affect the district generally;
2. Literal enforcement of the Ordinance would involve substantial hardship
to the petitioner;

from the date of this order unless otherwise stated below pursuant
to Regulation 6.7. The order may be ex-
tended by the issuing authority for one or more additional one-year
periods upon application to the said issuing authority at least
thirty days prior to the expiration date of the order or its extension.
5 . Any fill used in connection with this project shall be clean fill,
containing no trash, refuse, rubbish or debris, including, without
limiting the generality of the foregoing, lumber, bricks, plaster,
wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators,
motor venicles or parts of any of the foregoing.

6. No work may be commenced until all appeal periods have elapsed from
the order of the Conservation Commission or from a final order by
the Department of Environmental Quality Engineering..
7. . No work . shall be undertaken untilthe final Order, with respect to
the proposed project, has been recorded in the Registry of Deeds
for the district in which the land is located within the chain of
title of the affected property. Copy to be furnished to issuer of
this Order showing book and page DMor to Commencement of work.
8. Upon completion of the work described herein, - the applicant shall
forthwith request, in writing, that a Certificate of Compliance be
issued stating that the work has been satisfactorily completed.
9.. A sign shall be displayed at the site not less than two square feet
or more than three square feet bearing the words, "Massachusetts
Department of Environmental Quality Engineering. Number 64-40 " .
10. Where the Department of Environmental Quality Engineering is
requested, to make a determination and to issue a superseding order,
the Conservation Commission shall be a party to all agency pro-
ceedings and hearings before the Department.
11. The work shall conform to the following described plans and
additional conditions.
a. The Salem Conservation Commission has determined that the proposed
work on a coastal bank is significant only to storm damage prevention.
The coastal bank is formed by outcropping rock.
b. The site grading and foundation location shall be in accordance
with the Site Development Plan of Land in Salem, Massachusetts for
Marquis Magee et al, prepared by Essex Survey Service, Inc. , of Salem,
dated October 18, 1978 and revised March 12, 1979.
c. There shall be no fill or riprap placed on the bank. Vegetation
on the bank shall not be disturbed except as required for foundation
preparation at the location of the house-
d. The fall of the bank and the beach shall be kept free of construction
materials at all time.

The applicant, any person aggrieved by this order, any owner of
land abutting the land upon which the proposed work is to be done, or
any ten residents of the-city or town in which such land is located,
are hereby notified of their right to appeal this order to the Depart-
ment of Environmental Quality Engineering provided the request is made in
writing and by certified mail 'to the Oeoartment within ten (10) days from the issuance
of this order.

Foundation Permit
Gentlemen:
I wish to advise we have issued a foundation permit at the
above referenced address. The construction documents furnished in
conjunction with the application, including a "Site Development"
plan prepared by Essex Survey (dated March 12, 1979) raise some
doubts in my mind as not being in conformance with your Orders of
Conditions.
The site plan calls for a "Finish First Floor El. 30.00"
which I am informed is in reality an upper basement level at
elevation 28.31 . There is also a lower basement level at elevation
25.8' on the rear of the house.
The grades shown with solid lines and circled numbers are
meant to be existing grades and not finished final grades as is the
usual practice. Since the entrance foyer will be at elevation 37.00'
six to seven feet of fill will be required at the front of the house to
bring the grade to + 35.001 . Just how this will be placed in relation
to the "bank" referred to in paragraph ll.c of your Conditions is
unclear.
I bring this to your attention to avoid any possible questions
or misunderstandings at a later date, and to give you an opportunity
to review the situation before we issue a superstructure permit.
The plans for the permit are on file in our office should you
wish to avail yourself of them.

The Flood Hazard Districts affected by coastal flooding (zones A3, V3) are
based on elevation 15.36 feet Mean Low Water (11.0 Mean Sea Level) . Boundary
lines trace this elevation contour. Where it can be properly shown that
land is above this elevation, that land shall not be considered as being
included in the District.
Any proposed use to be located within the limits of these Districts as
determined by the Inspector of Buildings under Section IX of this Ordinance
shall be governed by all regulations of this Section as well as all other
applicable provisions of this Ordinance.
The proposed building at 441 Lafayette St. will be located above the
15.36' mlw elevation. The first floor elevation will be at 30' mlw.
