Dear Mr. Cabral:
The intent of this letter is to clarify the issues regarding your failure to obtain an
Occupancy Permit.
Your failure to obtain a Certificate of Compliance from the Massachusetts DEP is not the
reason you do not have a "Certificate of Occupancy".
This Department does not enforce the D.E.P.Regulations.
To obtain an Occupancy Permit you must submit the following;
1. A certified plot plan showing the "as built" location of the home.
2. A letter from the City of Salem Engineering Department stating compliance with
all their requirements (driveways, sidewalks) drainage and sewerage issues.
3. Per the State Building Code 780 CMR, Section 3107.6 and 3107.3 a report is
required from the structural engineer of record.
4. All final inspections must be completed.
5. You must address the zoning issue pertaining to the second unit constructed in the
lower level.
If you feel you are aggrieved by any building code items your legal appeal is to
directed to the Board of Building Regulations and Standards in Boston.
If you feel you are aggrieved by my zoning opinion, your appeal is to the City of
Salem Zoning Board of Appeals

After getting complaints from neighbors, I did a walk around your house and have come
to the conclusion someone is living in you house without a Certificate of Occupancy. In
Chapter One, Mass State Building Code, 780 CMR 120.1 No new building or structure
shall occupy without a Certificate of Occupancy. A Certificate of Compliance is
necessary from the State because a super seeding order from the DEP exists.
Please contact this office immediately concerning this issue.

Dear Mr. Munroe:
You have requested my opinion whether or not the above
entitled parcel of land containing 13,296 square feet of
land with 150 feet frontage on Lafayette Street is afforded
the protection of the fourth paragraph of G.L.c40A §6 .
The "grandfather" provision of the aforementioned statute
exempts certain lots for single and two-family use from area
and frontage requirements provided the lot in question has
a minimum of 5, 000 square feet of area and 50 foot of frontage.
In order to qualify for the protection, such a lot must not
have been held in common ownership with adjoining land at
the time of recording the most recent instrument of record
prior to the effective date of the restrictive zoning change
pertaining to the lot.
In the instant case the restrictive zoning change occurred
on May 5, 1977 when the lot area requirement was increased
to 15 , 000 square feet. The most recent instrument of record
prior to that date pertaining to the lot was a plan approved
by the Salem Planning Board on May 16 , 1974 and recorded
May 31, 1974 as Plan No. 217 with Book 6070, Page 439 . At
the time of that recording, the lot was not owned in common
with adjoining land and thus meets the separate ownership
requirement contained in G.L.c40A §6 .

Accordingly it is my opinion that the lot should be
afforded the protection of G.L.c40A §6 and the owner is
entitled to a single family building permit even though the
lot does not conform to the to the current 15, 000 square
feet area requirement of the Salem Zoning Ordinance. However,
this is not to mean that any structure built on the parcel
is exempt from the set back, lot coverage and height
requirements of the same ordinance.

relative to grandfather lots. In response to the questions contained
relative to your department policy, I set forth the following:
1. The lot in question, being Lot 1, as shown on a plan approved
by the Salem Planning board on May 16 , 1974, and recorded in Essex
County South District Registry of Deeds, Book 6070, Page 439, and
being filed as Plan No. 217 in 1974, showed the lot to have 13, 296

Bruce and I met with Mr. Cabral at the property noted above, 8:30 AM, Tuesday, March 23, 2004.
There are only a few outstanding items for Mr. Cabral to resolve before we can sign-off on the
completion of the project and Mr. Cabral's request for a CO.
The asphalt sidewalk has approximately and 8-inch gap, consisting of dirt, between the curb and the
paved sidewalk surface. The idea that the dirt strip will be successfully cultivated for a grass mow
strip is highly unlikely and should be eliminated by scratching out the dirt and paving this area. There
is no such dirt or grass strip associated with the sidewalks to either side of this property and therefore
the dirt strip is not uniform with the abutting properties nor does it conform to good sidewalk practice in
general. We are not altogether against the concept of grass strips but in this particular case it is not
practical nor will it be accepted as a finished City sidewalk.
Mr. Cabral has done an adequate job of protecting the water and sewer services entering the
basement as they cross the air space/gap between the building and the finished ground slope. They
have been protected from the elements and can be accessed, if necessary, for service/maintenance.
The newly constructed stonewall seems well built, aesthetically pleasing and is an improvement to the
safety barrier that previously existed. Structural approval comes under the jurisdiction of the Building
Inspector, but the location of the wall is a point that needs to be clarified by the owner for City records.
Is the wall on City property or on Mr. Cabral's lot? This question goes to future maintenance or
repairs to the wall and ownership. I believe the wall is on City property but would like a definite
answer by a surveyor and clearly reflected on the property's deed.
The purpose of drainage structure located behind the existing stonewall, that takes drainage from the
street catch basin and then discharges to the rip-rapped channel was not clear and by whose
authority it had been installed. The structure itself is sound but the existing stone wall used as the
back wall of the structure needs more work. There should be a barrier between the stone wall and the
inside of the structure; simply repointing the existing stone wall will likely not prevent decay and
erosion of the wall over time given the amount of potential energy that the inside of the structure may
have to absorb from entering storm water. Also who owns the structure? Have it stated on the deed.

Dear Mr. Brennan:
At the meeting at the National Park Service Visitors Center on Wednesday, October 4,
2000 you brought to my attention the condition of the sidewalk and storm drain at the
above captioned address.
On Friday, October 6, 2000, I visited this property with Mr. Stanley 1. Bornstein,
Salem City Engineer. After an inspection of the sidewalk Mr. Bornstein advised me the
gap in the pavement would be repaired near the storm drain. Since work may resume on
the construction of the home at this address he was reluctant to install a new pavement
sidewalk until spring 2001. He agreed other bituminous concrete sidewalks in the area
along Lafayette Street needs replacement and he indicated he would add them to the 2001
replacement schedule. He advised me the catch basin was clear and was discharging
storm water to the sea.
It is my understanding this property has been sold. Mr. Peter Strout, City Building
Inspector did not know the new owner's name. Mr. Strout will have the weeds and brush
cleared from the fence and obstructing the passage at this address.
As usual I will keep your and other neighbors advised of activities at 435 Lafayette
Street.

Dear Chairman George, and members of the Commission:
I would like to share my concerns about a proposed two
(2 ) story (full basement) house to be built at 435
Lafayette Street. This lot contains a small wooded area
of trees and overgrowth. A large part of this project
appears that it would be erected on the beach and ocean.
I live in the area of this proposal, and have
witnessed numerous snow and rain storms. These storms can
produce waves which may create a hazard to this property.
The non-current flood insurance rate map ( 1985) does not
give a true picture of the elevation of the tide. A site
visit during high tide should display a true picture of a
higher tide.
Located in a Wetlands and Flood Hazard District, this
project would need a special permit from the Salem
Planning Board, and approval by the Army Corp of
Engineers, D.E.P. (Division of Wetlands and Waterways) ,
and the City of Salem Building Inspector.
Would you please read my concerns into the record of
your meeting. Because the City Council meets at the same
time as the Conservation Commission, I may not be in
attendance. Thank you for your concern.

Enclosed you will find an updated Notice of Intent for you to complete in
order to comply with the Wetlands Protection Act, Chapter 131, Section 40.
I am also enclosing the Commission's requirements for seawall construction
for your information. If you have any further questions, please contact
the Conservation Commission office at 745-5056. -
I would also like to inform you that it will be necessary for you to
obtain a Wetland/Flood Hazard Special Permit from the Salem Planning Board
before any work can commence. Further information can be obtained relevant
to this special permit by contacting Michael Moniz of the Planning De-
partment at 744-4580.

Please be advised that per your request, I have reviewed the ownership history of the above
property, as well as that of all parcels immediately abutting it. Based on this investigation, I
have determined that the parcel in question was created under a Form A subdivision plan
submitted by Ernest Belleau,Jr., signed by the Planning Board on May 16, 1974, and recorded
as plan 217 of 1974,with a deed(Book 6070, Page 439) transferring ownership of the lot in the
subdivision abutting the subject lot to Bronislawa Moore. The subject property was held by
Belleau until 1980 when it was sold to the current owner, Philip S. Webster. The abutting lot
to the north of the subject has not at any time been owned by either Belleau or Webster since
1965 zoning ordinance was enacted.
Therefore,at no time since the subdivision plan was recorded on May 31, 1974,has the subject
lot been held in common ownership with either of the two abutting lots.

As you are aware the Conservation Commission voted at the public hearing,
April 6, 1976, to continue the hearing at a later date. This decision
was necessary due to the lack of information enclosed with the application
or supplied at the heating. The information needed is:
A. Final detailed engineering drawings, with cross-sections from Lafayette
Street through the house and pool to the beach and from the street
through the boathouse;
B. The basis for selection of grade elevation adjacent to the water;
C. The elevation of the 100 year water elevation.
Please note that it is important for the Commission to have details of the
footing of the retaining walls, the final elevations of all foundations,
basement and first floors. As soon as you supply the information we will
arrange the continuation of the public hearing on as early a date as possible.
I suggest that you contact the Corps of Engineers as you will also need a
permit from them.

Dear Mr. Cabrel:
This letter reports our assessment of the structural platform which supports the house structure.
As you know, the house and parking area are supported by timber piles with a steel-beam grid
across their tops. The steel beams, in turn, support a reinforced concrete deck at the garage and
parking area, and conventional timber framing elsewhere.
Also, as you are aware, the original Engineer-of Record left the project before the steel grid was
finished. Our firm was retained to complete the structural platform using the already-installed
piles;this is our sole responsibility. The Architect designed the house structure, including any
wind resistant connectors, if required.
This letter certifies that the completed structural platform is in substantial conformance with
approved drawings, and meets the requirements of the Massachusetts State Building Code and is
safe.
