SUBJECT: Salem Zoning Board of Appeals Public Hearing 12/15/2010
Attached is a copy of a petition filed in the Salem City Clerk's Office Nov 23,2010 by the
Salem Zoning Board of Appeal regarding 1.79 acres of vacant land located off 434 Lafayette
Street. Salem Attorney Scott M. Grover filed this petition on behalf of John Wharff and property
owner Caryl N. Welch seeking a variance for a subdivision which would consist of six(6)
residential lots at that location.Thirteen abutters on Raymond Road,Raymond Avenue and
Lafayette Street would be impacted by this proposed housing development.Access to this
proposed housing development would be by Raymond Ten-ace.
As an abutter you are intimately familiar with the topography and subsurface conditions of this
land at the rear of your property. I believe the proposed development of this property will create
a hardship on existing single family homes. This property is at a much higher elevation than your
property.
Helen and Pat Curtain, 19 Raymond Avenue(abutters)have graciously offered their home for
a meeting of neighbors impacted by this proposal on Saturday, December 4, 2010 @ l OAM to
discuss this issue
I have asked Ms. Lynn Duncan, Director of the Salem Department of Community
Development to provide me with thirteen(13)sets of plans(1 lxl6)which are enclosed.A much
larger map will be available at the Saturday meeting. I have also enclosed the variances the
petitioner is seeking from the Salem Zoning Ordinance and a copy of his petition,
The Salem Zoning Board of Appeals will hold a public hearing for all persons interested in
this petition of John Wharff requesting variances from minimum lot area, lot width/frontage, and
front yard setbacks on Wednesday, December 15,2010 @ 6:30 PM, in Room 313, 3rd Floor at
120 Washington Street.

STATEMENT OF GROUNDS
The land that is the subject to this petition consists of approximately 1.79 acres and is located in
an existing residential neighborhood of single family homes in the R-1 Zoning District. The
petitioner has entered into a Purchase and Sale Agreement to buy the property, subject to his
ability to obtain the necessary permits to subdivide the property as requested in this petition.
The proposed subdivision would consist of six (6)residential lots. In order to accomplish this
proposed subdivision, several variances from the requirements of the Zoning Ordinance are
required. Specifically, Lots 1-6 shown on the attached plan all require a variance from the
minimum lot size requirement of 15,000 square feet. In addition, Lots 1-4 each require a
variance from the frontage and lot width requirements of the Ordinance. Finally, to maximize
the distance between the existing residences abutting the property and the proposed new
dwellings, each lot requires a variance from the front yard setback requirement.
The special conditions and circumstances which affect this property relate to the topography and
subsurface conditions of the land. The property is at a higher elevation than the surrounding
properties and has significant hard rock ledge. Due to these conditions, the cost of developing
this land is considerably greater than other property in the neighborhood. If the Zoning
Ordinance were strictly enforced, the number of lots which could be developed would not
support the costs of developing the infrastructure. Therefore, without the relief requested, the
land cannot be developed for any economically viable purpose. Since the proposed six lots are
entirely consistent with the size of the other lots throughout the area and the R-1 District, the
relief requested may be granted without substantial detriment to the public good and without
nullifying or substantially derogating from the intent of the district or the purpose of the
Ordinance.

STATEMENT OF GROUNDS
The land that is the subject to this petition consists of approximately 1.79 acres and is located in
an existing residential neighborhood of single family homes in the R-1 Zoning District. The
petitioner has entered into a Purchase and Sale Agreement to buy the property, subject to his
ability to obtain the necessary permits to subdivide the property as requested in this petition.
The proposed subdivision would consist of six (6)residential lots. In order to accomplish this
proposed subdivision, several variances from the requirements of the Zoning Ordinance are
required. Specifically, Lots 1-6 shown on the attached plan all require a variance from the
minimum lot size requirement of 15,000 square feet. In addition, Lots 1-4 each require a
variance from the frontage and lot width requirements of the Ordinance. Finally, to maximize
the distance between the existing residences abutting the property and the proposed new
dwellings, each lot requires a variance from the front yard setback requirement.
The special conditions and circumstances which affect this property relate to the topography and
subsurface conditions of the land. The property is at a higher elevation than the surrounding
properties and has significant hard rock ledge. Due to these conditions, the cost of developing
this land is considerably greater than other property in the neighborhood. If the Zoning
Ordinance were strictly enforced, the number of lots which could be developed would not
support the costs of developing the infrastructure. Therefore, without the relief requested, the
land cannot be developed for any economically viable purpose. Since the proposed six lots are
entirely consistent with the size of the other lots throughout the area and the R-1 District, the
relief requested may be granted without substantial detriment to the public good and without
nullifying or substantially derogating from the intent of the district or the purpose of the
Ordinance.

new, shall be maintained in a safe and sanitary condition. All service equipment,
means of egress, devices and safeguards which are required by this code in a
building or structure, or which were required by a previous statute in a building or
structure, when erected, altered or repaired, shall be maintained in good working
order.
104.2 Owner responsibility: The owner, as defined in Article 2, shall be
responsible for the safe and sanitary maintenance of the building or structure and

Dear Mr. Scully:
Due to a complaint received through the Neighborhood Improvement
Committee hot line, I conducted an inspection of the above mentioned
property and found the following violations:
1. Stone retaining wall at Lafayette Street area is in deplorable
condition and must be repaired.
2. The overgrowth of shrubs and bushes must be cut back from over-
hanging the sidewalk.
Please notify this department upon receipt of this letter as to your
course of action to rectify this situation. Failure to do so will result in
legal action being taken against you.

Please excuse the delay in our response, it has been diffivult for me to reach all involved.
The situation of the wall and overgrown bushes has beery viewed by a Welch family trust
representative. The following course of action will be taken.
1. The stone retaining wall will be repointed. A mason is due to look at the
wall this wcck and will commene- work as soon as his schedule allows
I will notify your office the fast of next week with a time schedule.
2. We have scheduled the shrubs and hushes to be trimmed back. This work should he
completed by April 23rd-
