In order to begin adressing a canplaint, I ask that I please be provided with a clear and direct statement as to what, for the record, the precise canplaint is and what specific section of the zoning law said canplaint violates. I am also requesting that all allegations and responses in this matter be on official record. To begin the record, There have been no canplaints registered by any of my neighbors with me. I do have a neighbor, Phillip D. Moran, who is quite politically active and very much against my husband who is a politically active figure. Mr. Moran has a great deal of anti- pathy toward my husband, for more than one reason. Mr. Moran is the type of man who would contact the Salem Evening News with considerable slandering misinforamation regarding my activities and I do hope that the contents of an article, which was published without the writer contacting me, will not, in any way, prejudice a decision rendered by your office. For the record, I would also like to clarify a quote published in the Salem News on April 9, 1991 . The writer has me stating that I expect the building inspector to shut me dawn. That quote is so out of context as to read very differently fran the real truth. This is one of the reasons that I ask that all statements be on official record and in their entirety. My statement to the writer was, in fact, that I had reviewed all zon- ing regulations, prior to holding any meetings, and felt certain that my activities would in no way violate any of the zoning regulations. I also stated that I felt certain you would NOT find differently "unless certain political pressures would be brought to bear on this by a long disgruntled neighbor, a Mr. Phillip D. Moran, in which case, such a finding could becane a distinct possibility. I further stated to the reporter that I had expected the possi- bility of an eventual canplaint frau one and only.one neighbor - Mr. Moran - because of our relationship. Because my meetings should not have any direct impact, in any way, on my neighbors or affect the quality of their lives, I stated I would be, in fact, quite sur- prised if anyone else had, prior to the inflanmmtory statements printed in the Salem News without verification, issued an authentic or justifiable canplaint. Piemonte, Hacker, LaBrecque and Feeherry. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The Petitioner has requested a variance to allow this property to be used for a total of four dwelling units. A variance is required because the property .in question is in a R-1 district where the proposed use is prohibited. Addition- ally, Petitioner has requested a Special Permit to allow him to convert this property into condominium units. The Board of Appeals, after consideration^of the evidence presented at the public hearing and after viewing the property makes the following findings of fact: 1) The property in question is surrounded by a neighborhood of single family . homes; use of this property as a four-family dwelling will have a negative impact on the area as a whole. 2) Although Petitioner offered evidence to support his contention that this property was previously used as a three-family dwelling, we conclude that the property was never a legal three-family residence. Moreover, any non-conforming use of this property has ceased because of the fact that the property has not been used as even a two_family dwelling for over two years. 3) This area is well known as a location with substantial problems with traffic. The proposed use of this property as a four-family dwelling will necessarily worsen this problem. 4) Although the existing home on this property is a large one, it is not unique to the area. .There is nothing about this property which indicates that it should not be subject to existing zoning. 5) The neighborhood is vehemently opposed to Petitioner's request. 6) Use of this property as a four-family dwelling will have a destabilizing effect on the area. On the basis of the above findings of fact, and other evidence presented at the public hearing, the Board of Appeals concludes as follows: DECISION - JUNE 24, 1981 - MONTIGUE MORRIS - PAGE TWO A. The Petitioner failed to establishcircumstances relating to this property which affect that property but do not generally affect the zoning district in which the property is located. B. The Petitioner failed to establish that a literal enforcement of the provisions of the Salem Zoning Ordinance would involve substantial hardship to the Petitioner. C. The Petitioner failed to establish that the requested variance could be granted without substantial detriment to the public good and without nullifying or sub- stantially derogating from the intent and purposes of the Salem Ordinance.
